End User License Agreement (EULA) for Asha Empire: Exodus
1. Introduction
This End User License Agreement ("Agreement") is a legal agreement between you ("User" or "You") and Asha Empire Team ("Company" or "We") for the use of the software product, Asha Empire: Exodus ("Software" or "Game").
By installing, copying, or otherwise using the Software, You agree to be bound by the terms of this Agreement. If You do not agree to the terms of this Agreement, do not install or use the Software.
2. Grant of License
The Company grants You a personal, non-exclusive, non-transferable, limited license to install and use the Software on a single device for personal, non-commercial purposes, in accordance with the terms of this Agreement.
3. Restrictions
You agree not to, and You will not permit others to:
1. Reverse engineer, decompile, disassemble, or attempt to derive the source code of the Software, except to the extent that such activity is expressly permitted by applicable law notwithstanding this limitation.
2. Modify, adapt, translate, or create derivative works based on the Software.
3. Rent, lease, loan, sell, distribute, or sublicense the Software.
4. Remove, alter, or obscure any proprietary notices, labels, or marks from the Software.
5. Use the Software for any unlawful purposes or in a manner that could damage, disable, overburden, or impair the Software.
4. Ownership
The Software is licensed, not sold. This Agreement does not grant You any rights to patents, copyrights, trade secrets, trademarks, or any other rights, functions, or licenses in respect of the Software. The Company retains all right, title, and interest in and to the Software, including all intellectual property rights therein.
5. Termination
This Agreement is effective until terminated. Your rights under this Agreement will terminate automatically without notice from the Company if You fail to comply with any term(s) of this Agreement. Upon termination, You must cease all use of the Software and destroy all copies, full or partial, of the Software.
6. Disclaimer of Warranties
To the maximum extent permitted by applicable law, the Software is provided "as is" and "as available", with all faults and without warranty of any kind. The Company hereby disclaims all warranties and conditions with respect to the Software, either express, implied, or statutory, including, but not limited to, the implied warranties and/or conditions of merchantability, fitness for a particular purpose, accuracy, quiet enjoyment, and non-infringement.
7. Limitation of Liability
To the maximum extent permitted by applicable law, in no event shall the Company or its suppliers be liable for any special, incidental, indirect, or consequential damages whatsoever (including, but not limited to, damages for loss of profits, loss of data, business interruption, personal injury, loss of privacy, failure to meet any duty including of good faith or of reasonable care, for negligence, and for any other pecuniary or other loss whatsoever) arising out of or in any way related to the use of or inability to use the Software, the provision of or failure to provide support or other services, information, software, and related content through the Software, or otherwise under or in connection with any provision of this Agreement, even in the event of the fault, tort (including negligence), misrepresentation, strict liability, breach of contract, or breach of warranty of the Company or any supplier, and even if the Company or any supplier has been advised of the possibility of such damages.
8. Governing Law
This Agreement will be governed by and construed in accordance with the laws, without regard to its conflict of laws principles.
9. Entire Agreement
This Agreement constitutes the entire agreement between You and the Company regarding the use of the Software and supersedes all prior or contemporaneous understandings regarding such subject matter. No amendment to or modification of this Agreement will be binding unless in writing and signed by the Company.
