1. Introduction
This End User License Agreement ("EULA") is a legal agreement between you ("User" or "You") and Patryk Pezacki/HognatusGames ("Licensor", "We", or "Us") for the use of the software application THE BALL ("Game"). By installing, copying, or otherwise using the Game, You agree to be bound by the terms of this EULA. If You do not agree to the terms of this EULA, do not install or use the Game.
2. Grant of License
The Licensor grants You a non-exclusive, non-transferable, limited right to use the Game on a single device. This license does not allow You to use the Game on any device that You do not own or control.
3. Restrictions
You agree not to:
Reverse engineer, decompile, or disassemble the Game, except and only to the extent that such activity is expressly permitted by applicable law notwithstanding this limitation.
Rent, lease, lend, sell, redistribute, or sublicense the Game.
Copy, modify, or create derivative works of the Game, any updates, or any part thereof.
Remove, alter, or obscure any proprietary notices or labels on the Game.
4. Ownership
All right, title, and interest in and to the Game, including but not limited to any content, titles, computer code, themes, objects, characters, stories, dialogue, catch phrases, locations, concepts, artwork, animations, sounds, musical compositions, audio-visual effects, methods of operation, moral rights, and any related documentation, are owned by Licensor or its licensors. This EULA does not grant You any rights to trademarks or service marks of Licensor.
5. Termination
This EULA is effective until terminated. Your rights under this EULA will terminate automatically without notice from the Licensor if You fail to comply with any term(s) of this EULA. Upon termination of this EULA, You shall cease all use of the Game and destroy all copies, full or partial, of the Game.
6. Disclaimer of Warranties
The Game is provided "AS IS" and with all faults. To the maximum extent permitted by applicable law, Licensor disclaims all warranties, whether express, implied, or statutory, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, and non-infringement of third-party rights. Licensor does not guarantee that the operation of the Game will be uninterrupted or error-free, or that defects in the Game will be corrected.
7. Limitation of Liability
To the maximum extent permitted by applicable law, in no event shall Licensor be liable for any special, incidental, indirect, or consequential damages whatsoever (including, but not limited to, damages for loss of profits, loss of data, business interruption, personal injury, or loss of privacy arising out of or in any way related to the use of or inability to use the Game, even if Licensor has been advised of the possibility of such damages.
8. Governing Law
This EULA shall be governed by and construed in accordance with the laws of Poland, without regard to its conflict of law principles. You agree to submit to the personal and exclusive jurisdiction of the courts located within Gdynia.
9. Amendments
Licensor reserves the right to amend this EULA at any time by posting the amended terms on its website, which shall be effective immediately. Your continued use of the Game following the posting of the amended terms constitutes Your acceptance of those terms.
10. Miscellaneous
If any provision of this EULA is found to be invalid or unenforceable, the remaining provisions of this EULA will remain in full force and effect. This EULA constitutes the entire agreement between You and Licensor regarding the Game and supersedes all prior or contemporaneous understandings regarding such subject matter.
By clicking "I Agree" or by installing, copying, or otherwise using the Game, You acknowledge that You have read and understood this EULA and agree to be bound by its terms.
