1. Basic provisions.
1.1. You hereby confirm that you are a person who has reached the age of majority. If you are under the age of majority, your parent or guardian must consent to this Agreement.
1.2. By registering an account for any of our products, downloading, copying, installing or otherwise using our product, you confirm your agreement with the terms of this Agreement and accept it. Otherwise, you shall undertake to stop any use of the product.
1.3. The terms of this Agreement are accepted without any reservations, in full and are not subject to change at the initiative of the user. The provisions of Article 428 of the Civil Code of the Russian Federation on the accession agreement shall apply to the relations of LLC “Gamage” with the user. The requirement to terminate or amend the contract shall not be subject to satisfaction if the signatory knows on what terms he/she concludes the contract.
1.4. This Agreement may be terminated unilaterally by LLC “Gamage” immediately and without notice if you do not comply with your obligations under this Agreement. Without limiting any other rights, this Agreement will terminate automatically if you do not comply with any of the restrictions or requirements described in this document.
1.5. The use of the products of LLC “Gamage” is carried out under a license, not for sale, and by accepting the Agreement, you confirm that no ownership in relation to the products of LLC “Gamage” is transferred or assigned to you. This Agreement is not an agreement for the sale of any rights.
1.6. All programs and all files, without exception delivered to you or made available to LLC “Gamage”, directly or indirectly through an authorized reseller or distributor of LLC “Gamage” (through online access, transfer, download or otherwise), including any “fixes”, “installers”, as well as any updates and modifications of such software products, as well as any copies and derivative works of such software products, are copyright items of LLC “Gamage” and its affiliates.
1.7. If you use the LLC “Gamage” product through a console provider (Steam, PlayStation, XBOX, GOG) or platform (apple, android), that is, outside the jurisdiction of LLC “Gamage”, the use of the product shall be additionally governed by the policies and agreements of the console or platform provider. Any violation of the rules of the platform or console is considered a material violation of this Agreement.
1.8. The use of the LLC “Gamage” product in violation of this Agreement entails prosecution.
1.9. Please note that the legal requirements may vary depending on the country in which you live or use the product of LLC “Gamage”. By accepting this Agreement, you guarantee that you are acting within the framework of the laws of your country of residence, and that you are not using the LLC “Gamage” product for illegal (including fraudulent) purposes.
1.10. A very small percentage of people may experience epileptic seizures or memory lapses when exposed to certain visual images, including, but not limited to, light patterns or flashing lights. If you experience any of the following symptoms while playing, stop using immediately and consult a doctor before resuming the game: blackouts, seizures, dizziness, vision changes, eye or muscle twitching, twitching or shaking of arms or legs, loss of consciousness, disorientation, confusion, any involuntary movements or convulsions.
1.11. “Gamage” product – works of graphics, design, photographic and audiovisual works, computer programs and other copyright items, inventions, utility models, industrial designs, know-how, including any technical specifications, descriptions and instructions related to the specified intellectual property items, as well as any other items recognized as intellectual property in accordance with the law of the Russian Federation created by LLC “Gamage”.
1.12. This Agreement is valid in the territory of countries all over the world.
2. Limited license.
2.1. Upon acceptance of this License Agreement, the User receives a personal, limited, non-exclusive license to install and use the LLC “Gamage” product exclusively for non-commercial purposes, as specified in this Agreement.
2.2. If you agree to this Agreement, you can download and install computer software on your computer for the sole purpose of playing the game.
2.3. The User is prohibited to:
2.3.1. distribute, lease the product of LLC “Gamage” or its copies for a fee to any third parties.
2.3.2. modify, combine, adapt, decompile, disassemble, modify, translate into other languages or in any way alter the product of LLC “Gamage” or any of its components.
2.3.3. create derivative works based on the product of LLC “Gamage”.
2.3.4. use the LLC “Gamage” product in other ways that are not expressly stipulated in this License Agreement.
2.3.5. falsify, delete or disable any copyright information; in particular, links to the author, legal confirmations of copyright or any other messages or instructions, as well as any notes about the origin of the software or other content.
2.4. All objects created by the User based on the products of LLC “Gamage” shall be the property of LLC “Gamage”.
2.5. The User may use the Software during the term of this License Agreement in the above ways anywhere in the world.
2.6. This Agreement does not grant you any rights to receive reissues or replacements of the LLC “Gamage” product. LLC “Gamage” is not obligated to provide software updates, upgrades or extensions for the LLC “Gamage” product, as well as to support the game for an indefinite period of time.
2.7. LLC “Gamage” may change, modify, suspend or terminate any aspect of the game at any time, and may also impose restrictions on certain functions or restrict your access.
2.8. Subject to compliance with this Agreement, you have the right to broadcast, record and publish video content of the gameplay of the LLC “Gamage” product for commercial and non-commercial purposes. For the avoidance of doubt, you may include advertising in such streamed/recorded video content and otherwise monetize such video content by means authorized by the relevant video streaming or sharing websites.
2.9. Access to the products of LLC “Gamage” shall be paid in advance and in full.
2.9.1. By providing payment information, you guarantee that you are the legitimate owner of the card, PIN, key or account associated with the payment.
2.9.2. If the purchase of a LLC “Gamage” product is subject to any use or sale tax, LLC “Gamage” may deduct the amount of such taxes from you.
3. Software update.
3.1. LLC “Gamage” may, without time limit, without notifying the User, restrict access to the product, install or provide fixes, updates, improvements, upgrades and modifications for the product, which must be installed by you in the manner described by LLC “Gamage” for:
3.1.1. performing temporary maintenance, correcting errors, making technical adjustments and implementing improvements;
3.1.2. product updates, including updating its structure, design or layout;
3.1.3. balancing, improvements, product updates;
3.1.4. ensuring safety;
3.1.5. combating illegal and/or malicious actions and the use of unauthorized programs or other actions that violate this Agreement.
3.2. Software updates may cause changes in the operation of the product, including, but not limited to: changes in the system requirements for the product.
4. Disclaimer of warranties.
4.1. The LLC “Gamage” product is provided “as is” without any additional warranties.
4.2. LLC “Gamage” does not guarantee that the product of LLC “Gamage” meets the requirements and expectations of the User.
4.3. LLC “Gamage” does not guarantee that the operation of the product will be uninterrupted and error-free.
4.4. Based on the provisions of the applicable law, neither LLC “Gamage” nor its partners are liable to the user for any damage (including, but not limited to, actual losses, lost profits, indirect losses, lost data) arising in connection with this Agreement and the User’s use of the LLC “Gamage” product.
4.5. LLC “Gamage” is not responsible for the inability to install or launch the LLC “Gamage” product, as well as for possible errors and failures in the operation of the software.
4.6. LLC “Gamage” is not responsible for any actions that may be committed by minors without the permission of their parents or legal representatives.
5. Miscellaneous.
5.1. Termination. This Agreement is valid until it is terminated. Your rights under this Agreement will be terminated immediately and automatically without any notice to LLC “Gamage” if you do not comply with any of the terms and conditions of this Agreement. Immediately upon termination, you must cease all use of the Software and destroy all copies of the LLC “Gamage” product in your possession or under your control. Termination does not limit any other rights or remedies of LLC “Gamage” under the law or contract.
5.2. LLC “Gamage” may, at its sole discretion, assign and/or delegate its rights and obligations under this Agreement or any part thereof to any third party at any time without notifying you. Your rights are personal and not assignable.
5.3. This Agreement constitutes the entire agreement of the Parties between you and LLC “Gamage” regarding the use of the Software by the User and replaces any previous oral and written agreements or oral and written arrangements concluded concurrently with the conclusion of this Agreement with respect to the subject matter of this Agreement, which are incorporated in this Agreement.
5.4. LLC “Gamage” reserves the right to revise the terms of the Agreement by updating the License Agreement on the website.
