This End User License Agreement ("EULA") is a legal agreement between you (either an individual or a single entity) and Outsider Comet ("Developer") for the software product "Yume No Office" ("Software"). By installing, copying, or otherwise using the Software, you agree to be bound by the terms of this EULA.
1. License Grant
Subject to the terms and conditions of this EULA, Developer grants you a non-exclusive, non-transferable, limited license to use the Software solely for personal, non-commercial purposes. This license does not permit you to sublicense, sell, or distribute the Software in any manner.
2. Modifications
You may create modifications ("Mods") of the Software for personal, non-commercial use only. You may not distribute Mods commercially or in any way that infringes upon the rights of Developer.
3. Ownership
The Software is licensed, not sold. Developer retains all rights, title, and interest in and to the Software, including all intellectual property rights therein.
4. Restrictions
You may not:
Modify, adapt, translate, reverse engineer, decompile, disassemble, or create derivative works based on the Software.
Use the Software in any manner that violates the rights of Developer or any third party.
Remove or alter any copyright, trademark, or other proprietary notices from the Software.
5. Termination
This EULA is effective until terminated. Your rights under this license will terminate automatically without notice from Developer if you fail to comply with any term(s) herein. Upon termination, you must cease all use of the Software and destroy all copies of the Software in your possession.
6. Disclaimer of Warranty
THE SOFTWARE IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, DEVELOPER DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NONINFRINGEMENT OF THIRD PARTY RIGHTS.
7. Limitation of Liability
IN NO EVENT SHALL DEVELOPER BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES ARISING OUT OF OR IN CONNECTION WITH THE SOFTWARE OR THIS EULA, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES, EVEN IF DEVELOPER HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
8. Governing Law
This EULA shall be governed by and construed in accordance with the laws of El Salvador. Any dispute arising out of or in connection with this EULA shall be exclusively resolved by the courts located in El Salvador.
9. Entire Agreement
This EULA constitutes the entire agreement between you and Developer regarding the Software and supersedes all prior or contemporaneous understandings and agreements, whether written or oral, relating to the Software.
10. Acceptance
By installing, copying, or otherwise using the Software, you acknowledge that you have read this EULA, understand it, and agree to be bound by its terms and conditions.
