End-User License Agreement (EULA)
A present license agreement (hereinafter: “Agreement”) is a legal paper; it is concluded between you (physical or juridical person) and THE DEVELOPER AND THE PUBLISHER OF THIS SOFTWARE (hereinafter: “LES JEUX DE MILEN”). The complete installation of LES JEUX DE MILEN software implies the acceptance by you of the present Agreement. If you do not accept the conditions of the present Agreement, you should delete LES JEUX DE MILEN software from your storage device without delay.
LICENSE FOR LES JEUX DE MILEN SOFTWARE
1. EXTENT OF LICENSE.
LES JEUX DE MILEN grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use one copy of LES JEUX DE MILEN software product (hereinafter “Program” or “Software”).
The present Agreement entitles you to use one copy of this Software on one terminal connected with one computer or one computer. The Program is considered used on a computer if it is loaded into temporary memory (i.e. RAM), or if it is installed in a fixed memory (for example, a hard disk, CD-ROM, another storage device) of this computer. It is not allowed to use the Program in-network on more than one computer or terminal simultaneously. There is no physical or juridical person that can distribute the Program without LES JEUX DE MILEN has written permission including distributors through the Internet.
2. PHOTOSENSITIVE SEIZURE WARNING.
A very small percentage of individuals may experience epileptic seizures when exposed to certain light patterns or flashing lights, including some of the visual effects that appear in certain video games. Symptoms may even be experienced by individuals with no history of epilepsy or photosensitivity. If you or anyone in your family have an epileptic or photosensitivity condition, please consult your physician before playing any of our video games.
If you experience any of the following symptoms while playing any of our video games, immediately discontinue use and consult your physician before resuming play: dizziness, altered vision, eye or muscle twitches, loss of awareness, disorientation, any involuntary movement, or convulsions.
3. LAW OF COPYRIGHT.
The Program is an intellectual property of LES JEUX DE MILEN and its suppliers. On this basis you should treat the Program in the same way as any other material protected by law of copyright, with the exception that you may a) make one copy solely as a backup or archive copy; b) copy the Program onto a hard disk upon condition that the original is saved as a backup or archive copy. Copying of the printed material supplied with the Program is prohibited.
4. TERMINATION OF THE LICENSE.
This License is valid until it is not terminated. You may terminate this License at any moment by deleting the Program and all its copies from the storage device. Should you breach any of the conditions of this License, the License terminates immediately without notice on the part of LES JEUX DE MILEN. Upon termination of the License, you are obliged to delete the Program and all its copies from the storage devices.
5. RESTRICTIONS.
The limited license granted in this Agreement does not give you any right to, and you may not, sell, copy (except under applicable legal exceptions such as the “private copy” exception under applicable law), loan, lease, distribute, disassemble, decompile, decrypt, hack, derive source code from, reverse engineer (except where permitted under applicable legal exceptions deriving from EU Directive 2009/24 or other applicable law), modify or commercialize this software.
6. GUARANTEE LIMITATION.
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE PRESENT SOFTWARE IS SUBMITTED TO YOU "AS IS," "AS AVAILABLE," AND "WITH ALL FAULTS".
LES JEUX DE MILEN DOESN'T MAKE ANY REPRESENTATIONS, WARRANTIES, PROMISES, OR GUARANTEES OF ANY KIND WHATSOEVER AS TO THE SOFTWARE OR THE CONTENT WHETHER EXPRESS OR IMPLIED, STATUTORY OR OTHERWISE.
LES JEUX DE MILEN DOESN'T WARRANT THAT THE SOFTWARE WILL BE ACCURATE OR RELIABLE, SECURE, ERROR-FREE, OR FREE OF VIRUSES.
THE PRESENT SOFTWARE IS SUBMITTED WITHOUT ANY GUARANTEE. LES JEUX DE MILEN RELIEVES ITSELF FROM ANY POSSIBLE RESPONSIBILITY INCLUDING LIABILITY FOR COMMERCIAL VALUE OR CONFORMANCE TO CERTAIN GOALS. ALL RISK ON THE SOFTWARE USAGE OR OPERATION FALLS ON YOU. UNDER NO CIRCUMSTANCES LES JEUX DE MILEN AND ITS DESIGNERS AS WELL AS ALL INVOLVED IN ITS CREATION DO NOT BEAR ANY RESPONSIBILITY FOR ANY DAMAGE (INCLUDING ALL WITHOUT EXCEPTION CASES OF LOST PROFIT, VIOLATION OF BUSINESS FUNCTIONING, INFORMATION LOSS OR OTHER DAMAGES) AS A RESULT OF USAGE OR IMPOSSIBILITY OF USAGE OF THE PRESENT SOFTWARE, EVEN IF LES JEUX DE MILEN WAS NOTIFIED ABOUT A POSSIBILITY OF SUCH LOSSES. LES JEUX DE MILEN SUMMARY RESPONSIBILITY BEFORE YOU FOR DAMAGE, LOSSES AND OTHER FORCED MEASURES UNDER NO CIRCUMSTANCES SHOULD NOT EXCEED THE SUM PAID BY YOU FOR LES JEUX DE MILEN SOFTWARE.
7. Changes to this EULA.
LES JEUX DE MILEN reserves the right to modify or replace this EULA at any time. Continued use of the Software after changes indicates acceptance of the new terms.
