Dayou Space App License and Service Agreement

Introduction and Preface
Welcome to use the Dayou Space App and services!
To use the Dayou Space App (hereinafter referred to as "this App") and services (hereinafter referred to as "this service"), you should read and comply with the "Dayou Space App License and Service Agreement" (hereinafter referred to as "this agreement") and the "Dayou Space App Privacy Agreement." Please read carefully and fully understand the content of each clause. If you have any questions about the content of this agreement or the information on the page, please contact customer service first.
Unless you have fully read, completely understood, and accepted all the terms of this agreement, you have no right to install or use this App and/or related services. By clicking "Agree" or by your installation, use, login, or any other means of express or implied acceptance, you are deemed to have read and agreed to be bound by this agreement. This agreement then becomes a legally binding document between you and the Dayou Space App.
No minors under the age of 18 are permitted to register an account or use the Services. We will rely on the personal information you provide to determine if the user is a minor. Furthermore, if you do not have full civil capacity, please read and decide whether to agree to this Agreement under the supervision of your legal guardian (hereinafter referred to as "Guardian").
1. Scope of the Agreement
1.1 This Agreement is an agreement between you and Hangzhou Shijian Lejian Technology Co., Ltd. (hereinafter referred to as "Shijian Lejian" or "we") regarding your installation, login, and use of this software and the Services.
1.2 The content of this agreement includes but is not limited to the following agreements, rules, and regulations related to this software and/or this service, as well as other relevant agreements, rules, and regulations that we may continuously release regarding this software and/or this service. Once the aforementioned content is officially released, it becomes an inseparable part of this agreement and constitutes a unified whole, which you should also comply with:
(1) "Dayou Space App License and Service Agreement";
(2) "Dayou Space App Privacy Agreement."
1.3 Shijian Lejian, as the operator of this software and service provider, has the right to change the software operator and/or service provider without further notice. The changed entity will continue to provide services to you according to the provisions of this agreement, and the change of the entity will not affect your rights under this agreement.
2. Description of the Services
2.1 You acknowledge and agree that due to the special nature of network services, in case of technological upgrades, service system upgrades, business strategy adjustments, or in cooperation with national significant technological, legal, and policy changes, Shijian Lejian may update or adjust the content of this software and/or the Services as needed, or even suspend or terminate all or part of the services provided to you. Such actions do not constitute a breach of contract by Shijian Lejian, and you are not entitled to claim any liability from Shijian Lejian.
3. About the Software
3.1 This software refers to the software developed by Shijian Lejian or its affiliated companies and authorized for installation, login, and use by users according to this Agreement.
3.2 Shijian Lejian grants you a personal, non-transferable, and non-exclusive license to use this software and related services in accordance with the scope and manner limited by this Agreement and other agreements and rules between us and you. You may use it solely for non-commercial purposes.
3.2.1 You may install, use, and log in to this software for non-commercial purposes.
3.2.2 You may make one backup copy of this software solely for backup purposes. The backup copy must contain all copyright information included in the original software.
3.2.3 Any other rights not explicitly granted in this Agreement are reserved by Shijian Lejian, and you must obtain written permission from Shijian Lejian to exercise those rights. Failure of Shijian Lejian to exercise any of the aforementioned rights does not constitute a waiver of those rights.
3.3 To improve user experience or enhance service security and ensure consistency of functionality, Shijian Lejian has the right to update the software or change part of the software's functions and services.
4. Service Accounts
4.1 Before using the Services, you need to register an account (hereinafter referred to as "Account") with your mobile phone number and set a login password. Shijian Lejian has the right to change the rules for applying, using, and retrieving accounts, subject to the announcements of Shijian Lejian.
4.2 During the process of registering an account or using the Services, you may need to provide certain necessary information. If required by applicable laws and regulations (referred to as "laws and regulations" in this Agreement), you need to provide true, accurate, legal, and valid identity information (including but not limited to mobile phone numbers, identification documents, etc.). If the information you provide is untrue, inaccurate, illegal, or non-compliant, we have the right to refuse to provide you with the relevant services, and you may not be able to use the software and related services or may be restricted in some functions. If the registration information you provide is illegal, untrue, inaccurate, or incomplete, you shall bear the corresponding responsibilities and consequences, and Shijian Lejian reserves the right to terminate your use of the Services.
4.3 Users are obliged to properly keep their account and password and use them correctly and securely. You are fully responsible for any activities conducted under your service account, including but not limited to any statements made, purchases, and payments (if any) made through the software. If you fail to fulfill these obligations and your account password is lost or your account is stolen, resulting in damage to the civil rights of yourself and others, you shall bear the resulting legal responsibilities.
4.4 The ownership of the service account belongs to Shijian Lejian. Upon completing the application and registration procedures, the user only obtains the right to use the account, which solely belongs to the initial applicant. The initial applicant may not give, lend, rent, transfer, sell, or otherwise permit non-initial applicants to use the account. Non-initial applicants may not use the account through gift, inheritance, lease, transfer, or any other means.
4.5 You understand and agree that your account must not violate national laws and regulations or the relevant rules of the software. Your account name, avatar, and other personal information must not contain illegal or undesirable information. Without permission, you must not open accounts in the name of others (including but not limited to using names, logos, avatars, etc., in a way that causes confusion). You must comply with relevant laws and regulations during account registration and use and must not engage in any actions that harm national interests, infringe on the lawful rights of other citizens, or harm social morals.
5. Protection of Users' Personal Information
5.1 Protecting users' personal information is a fundamental principle of Shijian Lejian. Shijian Lejian will collect, use, store, and share your personal information in accordance with this Agreement and the "Dayou Space App Privacy Agreement." If this Agreement does not explicitly address personal information protection, the content of the "Dayou Space App Privacy Agreement" shall prevail.
5.2 Shijian Lejian will not transfer or disclose your personal information to any third party, except in the following cases:
(1) As required by relevant laws and regulations or judicial, administrative authorities;
(2) For the purpose of completing mergers, divisions, acquisitions, or asset transfers;
(3) As necessary to provide the services you request;
(4) Situations where the transfer or disclosure to any third party is permitted under the "Dayou Space App Privacy Agreement" or other relevant agreements and rules.
5.3 To better provide you with the Services, upon obtaining your explicit consent, Shijian Lejian may use your service account's nickname, avatar, and related operation information within the software (hereinafter referred to as "such information") and display such information to you or other users within the software.
5.4 When you use a specific function of the Services, Shijian Lejian may, upon obtaining your explicit consent, use relevant permissions, interfaces, and related information of your terminal device to achieve the corresponding function. You can choose not to provide Shijian Lejian with the relevant permissions, interfaces, and information, but this may result in the relevant service functions not being realized.
5.5 You should fully respect the personal information you come into contact with through the software and/or the Services, including but not limited to the personal information of other users. You must not collect, copy, store, transmit, or use such information in any way, otherwise, you shall bear the consequences.
6. User Conduct Guidelines
6.1 Prohibited User Conduct
You shall comply with relevant laws, regulations, this Agreement, rules, and specifications during the use of the software and/or the Services and shall not engage in or facilitate the following conduct:
6.1.1 Conduct prohibited by laws and regulations
You must comply with laws and regulations when using the Services and must not produce, copy, publish, or disseminate information containing the following content, or engage in related activities, nor facilitate the production, copying, publishing, or dissemination of such information or related activities:
(1) Opposing the basic principles set forth in the Constitution;
(2) Endangering national security, leaking state secrets, subverting state power, or undermining national unity;
(3) Damaging the nation's honor and interests;
(4) Inciting ethnic hatred or discrimination, or undermining ethnic unity;
(5) Undermining national religious policy, promoting cults and superstitions;
(6) Spreading rumors, disrupting social order, and undermining social stability;
(7) Spreading obscenity, pornography, gambling, violence, murder, terror, or inciting crime;
(8) Insulting or slandering others, infringing on others' legitimate rights and interests;
(9) Violating the "seven bottom lines" requirements of the legal and regulatory bottom line, socialist system bottom line, national interest bottom line, citizen legal rights bottom line, social public order bottom line, moral customs bottom line, and information authenticity bottom line;
(10)Other behaviors prohibited by laws and regulations, this agreement, or other rules for using this software.
6.1.2 Software Usage
Unless permitted by laws and regulations or with written permission from Shijian Lejian, you must not engage in the following activities:
(1) Removing copyright information from the software and its copies;
(2) Performing reverse engineering, disassembly, decompilation, or attempting to discover the source code of the software by any other means;
(3) Using, renting, lending, copying, modifying, linking, reproducing, compiling, publishing, establishing mirror sites, or engaging in other actions concerning content owned by Shijian Lejian's intellectual property rights;
(4) Copying, modifying, adding, deleting, linking, running, or creating any derivative works from the software or any data released to any terminal memory during the software operation, the interactive data between the client and the server during software operation, and the system data necessary for software operation. This includes but is not limited to using plugins, add-ons, or unauthorized third-party tools/services to access the software and related systems;
(5) Modifying or forging instructions and data during software operation, adding, deleting, or altering the software's functionality or operational effects, or operating or disseminating software and methods for the aforementioned purposes to the public, regardless of whether these actions are for commercial purposes;
(6) Logging in or using the software and/or services through third-party software, plugins, add-ons, or systems not developed or authorized by Shijian Lejian, or creating, publishing, and disseminating such tools;
(7) Interfering with the software and/or services, and their components, modules, data, etc., by yourself, authorizing others, or using third-party software;
(8) Other behaviors that may affect or interfere with the normal operation of the software and/or services.
6.1.3 Data Acquisition and Use
To protect data security, you must not engage in the following behaviors, including but not limited to, nor provide convenience for such behaviors: (1) Collecting, copying, storing, using, or transmitting other users' data without their explicit consent or without truthfully disclosing data usage and scope to other users, thereby infringing on their legal rights; (2) Using other users' account numbers, nicknames, and other personal information for any purposes not authorized by the users and Shijian Lejian; (3) Attempting to backtrack, trace, associate, mine, or obtain users' account numbers, phone numbers, birth dates, and other personal information; (4) Scraping any user information or any information and data related to the software and/or services through various programs, software, etc.; (5) Viewing or obtaining any information and data contained in the software and/or services that pertain to Shijian Lejian, its partners, or users through unauthorized third-party software, plugins, add-ons, systems, etc., without Shijian Lejian's authorization; (6) Other behaviors that endanger data security.
6.2 Legal Liability
6.2.1 You understand and agree that if you violate laws, regulations, this agreement, and/or other agreements and rules of Shijian Lejian, Shijian Lejian has the right to take one or more of the following measures at any time based on the corresponding situation (the specific measures and the duration of the measures will be determined by Shijian Lejian according to the severity of your violation):
(1) Issue a warning to you;
(2) Delete illegal or non-compliant information;
(3) Restrict your use of some or all functions of the software and/or services;
(4) Suspend or terminate your use of the corresponding service account (referred to as "account ban");
(5) Take other reasonable and legal measures;
(6) Transfer the matter to relevant administrative authorities for administrative punishment, or report it to relevant authorities for criminal responsibility.
6.2.2 If you violate laws, regulations, this agreement, and/or other agreements and rules of Shijian Lejian, and Shijian Lejian takes any action or measure against you or the software and/or services you use, resulting in your temporary or permanent inability to use the service account, you shall bear the corresponding consequences (including but not limited to communication interruption, clearance, or inability to use user data and related data). You shall bear any losses caused by this yourself.
6.2.3 If you cause damage to any third party, you shall independently bear the responsibility; if Shijian Lejian suffers any loss as a result, you shall also compensate for such loss.
6.3 Responsibility for Your Actions
You fully understand and agree that you must be responsible for all your actions when using the software and/or services, including any content you publish and any consequences arising therefrom. You should independently judge the content you access while using the software and/or services, including the risks arising from relying on the correctness, completeness, or usefulness of the content, and bear the corresponding risks. Within the scope permitted by law, Shijian Lejian is not responsible for any loss or damage caused by the aforementioned risks.
7.Intellectual Property
7.1 Shijian Lejian is the holder of the intellectual property rights for this software. The copyrights, trademark rights, patent rights, trade secrets, and other intellectual property rights of this software, as well as all related information content (including but not limited to text, images, audio, video, charts, interface design, layout framework, relevant data, or electronic documents), are protected by laws, regulations, and corresponding international treaties. Shijian Lejian legally enjoys the aforementioned related intellectual property rights, except for the rights that relevant rights holders should enjoy according to legal provisions.
7.2 Without the written consent of Shijian Lejian or the relevant rights holders, you shall not implement, utilize, or transfer the above intellectual property rights for any commercial or non-commercial purposes, nor permit any third party to do so.
7.3 You promise that you have full copyright or have obtained legal authorization for the content you upload through this software (including but not limited to text, images, videos, audio, and/or music works, sounds in videos, audio, etc.), and that it does not infringe the legal rights of any third party.
7.4 If you find any content in this software and related websites that infringes your rights, please immediately notify Shijian Lejian via email at connect@dayou.art, providing preliminary evidence of your rights. Shijian Lejian will handle your complaint in a timely manner as required by laws and regulations.
8.Third-Party Software or Technology
8.1 This software may use third-party software or technology (including open-source code and public domain code, etc., hereinafter the same). Such use has obtained legal authorization.
8.2 If this software uses third-party software or technology, Shijian Lejian will, in accordance with relevant regulations or agreements, display the relevant agreements or other documents. This may be done through attachments to this agreement, by packaging them in a specific folder within the software installation package, etc. They may be expressed in the form of "Software Use License Agreement," "Authorization Agreement," "Open Source Code License," or other forms.
8.3 The aforementioned related agreements or other documents are an integral part of this agreement and have the same legal effect as this agreement. You should comply with these requirements. If you do not comply with these requirements, the third party or state authorities may file a lawsuit, impose fines, or take other sanctions against you, and request Shijian Lejian's assistance. You should bear the legal responsibility yourself.
9.Majeure and Other Exemptions
9.1 You understand and agree that during the use of this service, you may encounter risk factors such as force majeure that could affect this service. Force majeure refers to objective events that are unforeseeable, insurmountable, and unavoidable, and that have a significant impact on one or both parties, including but not limited to natural disasters such as floods, earthquakes, epidemics, and storms, as well as social events such as wars, riots, and government actions. In such cases, Shijian Lejian will make efforts to cooperate with relevant units promptly and strive to handle it in a timely manner. However, Shijian Lejian shall be exempt from liability for any loss caused to you to the extent permitted by law.
9.2 To the extent permitted by law, Shijian Lejian is not responsible for service interruptions or obstructions caused by the following circumstances:
(1) Destruction by computer viruses, trojans, or other malicious programs, or hacker attacks. (2) Malfunctions in computer software, systems, hardware, or communication lines of the user or Shijian Lejian. (3) Improper user operations or the use of this service through unauthorized means by Shijian Lejian. (4) Outdated program versions, aging of equipment, and/or compatibility issues. (5) Other situations beyond the control or reasonable foresight of Shijian Lejian.
9.3 Shijian Lejian will make commercially reasonable efforts to ensure the security of your data stored in this service. However, Shijian Lejian cannot provide a complete guarantee, including but not limited to the following circumstances:
(1) Shijian Lejian is not responsible for the deletion or storage failure of your relevant data in this software and/or service caused by reasons not attributable to Shijian Lejian. (2) You should back up the data, information stored in this software and/or service, or data and information related to this software and/or service yourself, unless otherwise agreed upon by both parties. (3) If you stop using this software and/or service, or if your use of this service is canceled or terminated due to your violation of laws, regulations, or this agreement, Shijian Lejian has the right to permanently delete your data from the server. After your service is stopped, terminated, or canceled, Shijian Lejian is not obligated to return any data to you.
9.4 You understand and agree that during the use of this service, you may encounter risks brought by network information or other user behaviors. Shijian Lejian does not bear any responsibility for the authenticity, applicability, or legality of any information, nor is it responsible for any damages caused to you by infringing behaviors. These risks include but are not limited to: (1) Information from others that contains threats, defamation, offensive or illegal content, whether anonymous or impersonated. (2) Being misled, deceived, or experiencing any psychological, physical harm, or economic loss caused by others. (3) Other risks caused by network information or user behavior.
9.5 You should be cautious not to disclose important information such as various property accounts, bank cards, credit cards, third-party payment accounts, and corresponding passwords while using this software and/or service. Otherwise, you shall bear any loss resulting from such disclosure. You should also avoid publishing, uploading, or spreading other personal information through this platform.
9.6 You understand and agree that in order to provide you with effective services, this software may use the processor and bandwidth resources of your terminal device. The use of this software may generate data traffic fees, and users need to consult with their carriers about the relevant charges and bear the associated costs themselves.
9.7 Based on factors such as user experience, operational safety of the software or related services, compliance with rules, and the healthy development of the platform, Shijian Lejian has the right to select the target of service provision, decide on function settings, and determine the objects and scope of function availability, data interfaces, and related data disclosure. In the following circumstances, Shijian Lejian has the right to suspend or terminate the provision of relevant services based on specific situations, including but not limited to: (1) Violations of laws, regulations, or this agreement. (2) Affecting the service experience. (3) Existence of security risks. (4) Violations of the operating principles and standards of this software or service, or non-compliance with other management requirements of Shijian Lejian.
10.Miscellaneous
10.1 Shijian Lejian reserves the right to modify the terms of this agreement when necessary. You can review the latest version of the agreement terms on the relevant service page. If you continue to use the software or services provided by Shijian Lejian after the changes to the terms, it will be deemed that you have accepted the modified agreement.
10.2 The place of signing this agreement is Yuhang District, Hangzhou City, Zhejiang Province, People's Republic of China.
10.3 The formation, validity, performance, interpretation, and dispute resolution of this agreement shall be governed by the laws of the mainland area of the People's Republic of China (excluding conflict of laws).
10.4 In the event of any disputes or controversies between you and Shijian Lejian, the parties should first attempt to resolve them amicably through negotiation; if negotiation fails, the disputes or controversies shall be submitted to the Hangzhou Arbitration Commission for arbitration in accordance with its arbitration rules (the arbitration location is Hangzhou, and the arbitration language is Chinese).
10.5 The headings of all clauses in this agreement are for convenience of reading only and have no actual meaning. They cannot be used as a basis for interpreting the meaning of this agreement.
10.6 If any clause of this agreement is partially invalid or unenforceable for any reason, the remaining clauses shall remain valid and binding on both parties.

5.5 You should fully respect the personal information you come into contact with through the software and/or the Services, including but not limited to the personal information of other users. You must not collect, copy, store, transmit, or use such information in any way, otherwise, you shall bear the consequences.
6. User Conduct Guidelines
6.1 Prohibited User Conduct
You shall comply with relevant laws, regulations, this Agreement, rules, and specifications during the use of the software and/or the Services and shall not engage in or facilitate the following conduct:
6.1.1 Conduct prohibited by laws and regulations
You must comply with laws and regulations when using the Services and must not produce, copy, publish, or disseminate information containing the following content, or engage in related activities, nor facilitate the production, copying, publishing, or dissemination of such information or related activities:
(1) Opposing the basic principles set forth in the Constitution;
(2) Endangering national security, leaking state secrets, subverting state power, or undermining national unity;
(3) Damaging the nation's honor and interests;
(4) Inciting ethnic hatred or discrimination, or undermining ethnic unity;
(5) Undermining national religious policy, promoting cults and superstitions;
(6) Spreading rumors, disrupting social order, and undermining social stability;
(7) Spreading obscenity, pornography, gambling, violence, murder, terror, or inciting crime;
(8) Insulting or slandering others, infringing on others' legitimate rights and interests;
(9) Violating the "seven bottom lines" requirements of the legal and regulatory bottom line, socialist system bottom line, national interest bottom line, citizen legal rights bottom line, social public order bottom line, moral customs bottom line, and information authenticity bottom line;
(10)Other behaviors prohibited by laws and regulations, this agreement, or other rules for using this software.
6.1.2 Software Usage
Unless permitted by laws and regulations or with written permission from Shijian Lejian, you must not engage in the following activities:
(1) Removing copyright information from the software and its copies;
(2) Performing reverse engineering, disassembly, decompilation, or attempting to discover the source code of the software by any other means;
(3) Using, renting, lending, copying, modifying, linking, reproducing, compiling, publishing, establishing mirror sites, or engaging in other actions concerning content owned by Shijian Lejian's intellectual property rights;
(4) Copying, modifying, adding, deleting, linking, running, or creating any derivative works from the software or any data released to any terminal memory during the software operation, the interactive data between the client and the server during software operation, and the system data necessary for software operation. This includes but is not limited to using plugins, add-ons, or unauthorized third-party tools/services to access the software and related systems;
(5) Modifying or forging instructions and data during software operation, adding, deleting, or altering the software's functionality or operational effects, or operating or disseminating software and methods for the aforementioned purposes to the public, regardless of whether these actions are for commercial purposes;
(6) Logging in or using the software and/or services through third-party software, plugins, add-ons, or systems not developed or authorized by Shijian Lejian, or creating, publishing, and disseminating such tools;
(7) Interfering with the software and/or services, and their components, modules, data, etc., by yourself, authorizing others, or using third-party software;
(8) Other behaviors that may affect or interfere with the normal operation of the software and/or services.
6.1.3 Data Acquisition and Use
To protect data security, you must not engage in the following behaviors, including but not limited to, nor provide convenience for such behaviors: (1) Collecting, copying, storing, using, or transmitting other users' data without their explicit consent or without truthfully disclosing data usage and scope to other users, thereby infringing on their legal rights; (2) Using other users' account numbers, nicknames, and other personal information for any purposes not authorized by the users and Shijian Lejian; (3) Attempting to backtrack, trace, associate, mine, or obtain users' account numbers, phone numbers, birth dates, and other personal information; (4) Scraping any user information or any information and data related to the software and/or services through various programs, software, etc.; (5) Viewing or obtaining any information and data contained in the software and/or services that pertain to Shijian Lejian, its partners, or users through unauthorized third-party software, plugins, add-ons, systems, etc., without Shijian Lejian's authorization; (6) Other behaviors that endanger data security.
6.2 Legal Liability
6.2.1 You understand and agree that if you violate laws, regulations, this agreement, and/or other agreements and rules of Shijian Lejian, Shijian Lejian has the right to take one or more of the following measures at any time based on the corresponding situation (the specific measures and the duration of the measures will be determined by Shijian Lejian according to the severity of your violation):
(1) Issue a warning to you;
(2) Delete illegal or non-compliant information;
(3) Restrict your use of some or all functions of the software and/or services;
(4) Suspend or terminate your use of the corresponding service account (referred to as "account ban");
(5) Take other reasonable and legal measures;
(6) Transfer the matter to relevant administrative authorities for administrative punishment, or report it to relevant authorities for criminal responsibility.
6.2.2 If you violate laws, regulations, this agreement, and/or other agreements and rules of Shijian Lejian, and Shijian Lejian takes any action or measure against you or the software and/or services you use, resulting in your temporary or permanent inability to use the service account, you shall bear the corresponding consequences (including but not limited to communication interruption, clearance, or inability to use user data and related data). You shall bear any losses caused by this yourself.
6.2.3 If you cause damage to any third party, you shall independently bear the responsibility; if Shijian Lejian suffers any loss as a result, you shall also compensate for such loss.
6.3 Responsibility for Your Actions
You fully understand and agree that you must be responsible for all your actions when using the software and/or services, including any content you publish and any consequences arising therefrom. You should independently judge the content you access while using the software and/or services, including the risks arising from relying on the correctness, completeness, or usefulness of the content, and bear the corresponding risks. Within the scope permitted by law, Shijian Lejian is not responsible for any loss or damage caused by the aforementioned risks.
7.Intellectual Property
7.1 Shijian Lejian is the holder of the intellectual property rights for this software. The copyrights, trademark rights, patent rights, trade secrets, and other intellectual property rights of this software, as well as all related information content (including but not limited to text, images, audio, video, charts, interface design, layout framework, relevant data, or electronic documents), are protected by laws, regulations, and corresponding international treaties. Shijian Lejian legally enjoys the aforementioned related intellectual property rights, except for the rights that relevant rights holders should enjoy according to legal provisions.
7.2 Without the written consent of Shijian Lejian or the relevant rights holders, you shall not implement, utilize, or transfer the above intellectual property rights for any commercial or non-commercial purposes, nor permit any third party to do so.
7.3 You promise that you have full copyright or have obtained legal authorization for the content you upload through this software (including but not limited to text, images, videos, audio, and/or music works, sounds in videos, audio, etc.), and that it does not infringe the legal rights of any third party.
7.4 If you find any content in this software and related websites that infringes your rights, please immediately notify Shijian Lejian via email at connect@dayou.art, providing preliminary evidence of your rights. Shijian Lejian will handle your complaint in a timely manner as required by laws and regulations.
8.Third-Party Software or Technology
8.1 This software may use third-party software or technology (including open-source code and public domain code, etc., hereinafter the same). Such use has obtained legal authorization.
8.2 If this software uses third-party software or technology, Shijian Lejian will, in accordance with relevant regulations or agreements, display the relevant agreements or other documents. This may be done through attachments to this agreement, by packaging them in a specific folder within the software installation package, etc. They may be expressed in the form of "Software Use License Agreement," "Authorization Agreement," "Open Source Code License," or other forms.
8.3 The aforementioned related agreements or other documents are an integral part of this agreement and have the same legal effect as this agreement. You should comply with these requirements. If you do not comply with these requirements, the third party or state authorities may file a lawsuit, impose fines, or take other sanctions against you, and request Shijian Lejian's assistance. You should bear the legal responsibility yourself.
9.Majeure and Other Exemptions
9.1 You understand and agree that during the use of this service, you may encounter risk factors such as force majeure that could affect this service. Force majeure refers to objective events that are unforeseeable, insurmountable, and unavoidable, and that have a significant impact on one or both parties, including but not limited to natural disasters such as floods, earthquakes, epidemics, and storms, as well as social events such as wars, riots, and government actions. In such cases, Shijian Lejian will make efforts to cooperate with relevant units promptly and strive to handle it in a timely manner. However, Shijian Lejian shall be exempt from liability for any loss caused to you to the extent permitted by law.
9.2 To the extent permitted by law, Shijian Lejian is not responsible for service interruptions or obstructions caused by the following circumstances:
(1) Destruction by computer viruses, trojans, or other malicious programs, or hacker attacks. (2) Malfunctions in computer software, systems, hardware, or communication lines of the user or Shijian Lejian. (3) Improper user operations or the use of this service through unauthorized means by Shijian Lejian. (4) Outdated program versions, aging of equipment, and/or compatibility issues. (5) Other situations beyond the control or reasonable foresight of Shijian Lejian.
9.3 Shijian Lejian will make commercially reasonable efforts to ensure the security of your data stored in this service. However, Shijian Lejian cannot provide a complete guarantee, including but not limited to the following circumstances:
(1) Shijian Lejian is not responsible for the deletion or storage failure of your relevant data in this software and/or service caused by reasons not attributable to Shijian Lejian. (2) You should back up the data, information stored in this software and/or service, or data and information related to this software and/or service yourself, unless otherwise agreed upon by both parties. (3) If you stop using this software and/or service, or if your use of this service is canceled or terminated due to your violation of laws, regulations, or this agreement, Shijian Lejian has the right to permanently delete your data from the server. After your service is stopped, terminated, or canceled, Shijian Lejian is not obligated to return any data to you.
9.4 You understand and agree that during the use of this service, you may encounter risks brought by network information or other user behaviors. Shijian Lejian does not bear any responsibility for the authenticity, applicability, or legality of any information, nor is it responsible for any damages caused to you by infringing behaviors. These risks include but are not limited to: (1) Information from others that contains threats, defamation, offensive or illegal content, whether anonymous or impersonated. (2) Being misled, deceived, or experiencing any psychological, physical harm, or economic loss caused by others. (3) Other risks caused by network information or user behavior.
9.5 You should be cautious not to disclose important information such as various property accounts, bank cards, credit cards, third-party payment accounts, and corresponding passwords while using this software and/or service. Otherwise, you shall bear any loss resulting from such disclosure. You should also avoid publishing, uploading, or spreading other personal information through this platform.
9.6 You understand and agree that in order to provide you with effective services, this software may use the processor and bandwidth resources of your terminal device. The use of this software may generate data traffic fees, and users need to consult with their carriers about the relevant charges and bear the associated costs themselves.
9.7 Based on factors such as user experience, operational safety of the software or related services, compliance with rules, and the healthy development of the platform, Shijian Lejian has the right to select the target of service provision, decide on function settings, and determine the objects and scope of function availability, data interfaces, and related data disclosure. In the following circumstances, Shijian Lejian has the right to suspend or terminate the provision of relevant services based on specific situations, including but not limited to: (1) Violations of laws, regulations, or this agreement. (2) Affecting the service experience. (3) Existence of security risks. (4) Violations of the operating principles and standards of this software or service, or non-compliance with other management requirements of Shijian Lejian.
10.Miscellaneous
10.1 Shijian Lejian reserves the right to modify the terms of this agreement when necessary. You can review the latest version of the agreement terms on the relevant service page. If you continue to use the software or services provided by Shijian Lejian after the changes to the terms, it will be deemed that you have accepted the modified agreement.
10.2 The place of signing this agreement is Yuhang District, Hangzhou City, Zhejiang Province, People's Republic of China.
10.3 The formation, validity, performance, interpretation, and dispute resolution of this agreement shall be governed by the laws of the mainland area of the People's Republic of China (excluding conflict of laws).
10.4 In the event of any disputes or controversies between you and Shijian Lejian, the parties should first attempt to resolve them amicably through negotiation; if negotiation fails, the disputes or controversies shall be submitted to the Hangzhou Arbitration Commission for arbitration in accordance with its arbitration rules (the arbitration location is Hangzhou, and the arbitration language is Chinese).
10.5 The headings of all clauses in this agreement are for convenience of reading only and have no actual meaning. They cannot be used as a basis for interpreting the meaning of this agreement.
10.6 If any clause of this agreement is partially invalid or unenforceable for any reason, the remaining clauses shall remain valid and binding on both parties.
