This End User License Agreement ("Agreement") is a legal agreement between you ("User") and Brandon194 Studios ("Developer") for the use of the video game "Darkness Consumes" ("Game").
By installing, accessing, or using the Game, you agree to be bound by the terms and conditions of this Agreement. If you do not agree to the terms of this Agreement, you may not install, access, or use the Game.
1. License Grant:
Developer grants User a non-exclusive, non-transferable, limited license to install and use the Game solely for personal, non-commercial purposes in accordance with this Agreement.
2. Restrictions:
User may not:
Modify, adapt, translate, reverse engineer, decompile, disassemble, or create derivative works based on the Game.
Rent, lease, loan, sell, distribute, or sublicense the Game or any part thereof.
Remove, alter, or obscure any copyright, trademark, or other proprietary rights notices contained in the Game.
Use the Game for any illegal or unauthorized purpose.
3. Ownership:
All title, ownership rights, and intellectual property rights in and to the Game and any copies thereof are owned by Developer. This Agreement does not convey to User any interest in or to the Game, but only a limited right of use in accordance with this Agreement.
4. Termination:
This Agreement is effective until terminated. Developer may terminate this Agreement at any time without notice if User fails to comply with any term herein. Upon termination, User must cease all use of the Game and destroy all copies thereof.
5. Disclaimer of Warranty:
The Game is provided "as is" without warranty of any kind, express or implied. Developer disclaims all warranties, including, but not limited to, the implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
6. Limitation of Liability:
In no event shall Developer be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, arising from the use of the Game.
7. Governing Law:
This Agreement shall be governed by and construed in accordance with the laws of Canada, without regard to its conflict of law principles.
8. Entire Agreement:
This Agreement constitutes the entire agreement between User and Developer concerning the subject matter hereof and supersedes all prior or contemporaneous agreements and understandings, whether written or oral.
