END USER LICENSE AGREEMENT
This End User License Agreement ("Agreement") is a legal agreement between you ("User" or "You") and EMILYGOLD LIMITED ("Licensor" or "We") for the use of the Asili Forest 2D platformer game ("Game").
BY INSTALLING, COPYING, OR OTHERWISE USING THE GAME, YOU AGREE TO BE BOUND BY THE TERMS AND CONDITIONS OF THIS AGREEMENT. IF YOU DO NOT AGREE TO THE TERMS OF THIS AGREEMENT, DO NOT INSTALL, COPY, OR USE THE GAME.
1. LICENSE GRANT
Subject to the terms of this Agreement, Licensor grants User a non-exclusive, non-transferable, limited license to install and use the Game for personal, non-commercial purposes on compatible devices.
2. INTELLECTUAL PROPERTY RIGHTS
The Game, including all content, trademarks, and copyrights therein, are the property of Licensor and are protected by intellectual property laws. User acknowledges that they do not acquire any ownership rights to the Game.
3. RESTRICTIONS
User shall not:
a. Modify, adapt, translate, reverse engineer, decompile, disassemble, or create derivative works based on the Game;
b. Use the Game for any unlawful purpose or in a manner that violates the rights of any third party;
c. Remove, alter, or obscure any copyright, trademark, or other proprietary notices contained in the Game;
d. Rent, lease, lend, sell, sublicense, distribute, or otherwise transfer the Game to any third party.
4. TERM AND TERMINATION
This Agreement shall remain in effect until terminated by either party. Licensor may terminate this Agreement immediately without notice if User breaches any provision of this Agreement. Upon termination, User must cease all use of the Game and destroy all copies thereof.
5. DISCLAIMER OF WARRANTY
THE GAME IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NONINFRINGEMENT.
6. LIMITATION OF LIABILITY
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL LICENSOR BE LIABLE FOR ANY SPECIAL, INCIDENTAL, INDIRECT, OR CONSEQUENTIAL DAMAGES WHATSOEVER (INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF PROFITS, BUSINESS INTERRUPTION, LOSS OF INFORMATION, OR ANY OTHER PECUNIARY LOSS) ARISING OUT OF THE USE OF OR INABILITY TO USE THE GAME, EVEN IF LICENSOR HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
7. MISCELLANEOUS
This Agreement constitutes the entire agreement between User and Licensor concerning the subject matter hereof and supersedes all prior or contemporaneous oral or written agreements and understandings. This Agreement shall be governed by and construed in accordance with the laws of the United Kingdom. Any dispute arising out of or in connection with this Agreement shall be submitted to the exclusive jurisdiction of the courts of England.
BY INSTALLING, COPYING, OR OTHERWISE USING THE GAME, YOU ACKNOWLEDGE THAT YOU HAVE READ AND UNDERSTAND THIS AGREEMENT AND AGREE TO BE BOUND BY ITS TERMS AND CONDITIONS.
