This End User License Agreement ("EULA") is a legal agreement between you (whether an individual or a legal entity) and IndieFist SRL for the use of the Nine Floors software, including physical or electronic media, as well as any printed or online materials associated therewith ("Software").
By installing, copying, or using the Software, you agree to be bound by the terms of this EULA. If you do not agree to these terms, do not install or use the Software.
1. License
IndieFist SRL grants you a personal, non-exclusive, non-transferable, and revocable license to use the Software in accordance with the terms of this EULA.
2. Copyright
The Software is protected by copyright laws and international treaties. All rights to the Software are owned exclusively by IndieFist SRL.
3. Restrictions
You may not:
Modify, adapt, translate, reverse engineer, decompile, disassemble, or create derivative works based on the Software.
Remove or modify any copyright notice, trademark, or other notice of ownership from the Software.
Distribute, sublicense, lease, rent, or lend the Software to third parties.
Use the Software for any illegal or unauthorized purpose.
4. Update Rights
IndieFist SRL may, at its sole discretion, provide updates, enhancements, or modifications to the Software. These updates shall be subject to the terms of this EULA unless additional terms are provided.
5. Warranty Disclaimer
The Software is provided "as is" without warranty of any kind, whether express or implied, including, but not limited to, the implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
6. Limitation of Liability
In no event shall IndieFist SRL be liable for any incidental, special, indirect, or consequential damages arising out of the use or inability to use the Software, even if advised of the possibility of such damages.
7. Technical Support
If you require technical assistance, please refer to the manual included with the software product or visit our website at https://indiefist.com/support where you can find the telephone number for the corresponding help center. All phone charges are the responsibility of the user. IndieFist does not guarantee that technical support will be available at any particular time or for any minimum period of time.
8. Termination of Agreement
IndieFist SRL may terminate this EULA if you fail to comply with any of the terms and conditions herein. Upon termination, you must cease using the Software and destroy all copies thereof in your possession.
9. Modifications
IndieFist SRL reserves the right to modify this EULA at any time. Modifications shall be effective as soon as they are published online or otherwise notified to you.
10. Entire Agreement
This EULA constitutes the entire agreement between you and IndieFist SRL regarding the Software and supersedes any prior agreements or understandings, whether oral or written.
