END USER LICENSE AGREEMENT (EULA)
This End User License Agreement ("EULA") is a legal agreement between you ("User" or "You") and Screaming Tree Studios ("Developer") for the use of Bird Year ("Game"), which includes computer software and may include associated media, printed materials, and "online" or electronic documentation. By installing, copying, or otherwise using the Game, you agree to be bound by the terms of this EULA. If you do not agree to the terms of this EULA, do not install or use the Game.
1. License Grant
Developer grants you a personal, non-exclusive, non-transferable, limited license to use the Game solely for your personal, non-commercial purposes in accordance with the terms of this EULA.
2. Ownership
The Game and all intellectual property rights therein are owned by Developer and are protected by intellectual property laws and treaties. Developer reserves all rights not expressly granted to you under this EULA.
3. Restrictions
You may not:
Reverse engineer, decompile, disassemble, or create derivative works based on the Game.
Sell, rent, lease, sublicense, or otherwise transfer rights to the Game.
Remove or alter any proprietary notices or labels on the Game.
Use the Game for any commercial purpose without Developer's prior written consent.
4. Termination
This EULA is effective until terminated. Your rights under this EULA will terminate automatically without notice if you fail to comply with any term of this EULA. Upon termination, you must cease all use of the Game and destroy all copies of the Game in your possession.
5. Disclaimer of Warranty
THE GAME IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NONINFRINGEMENT. THE ENTIRE RISK ARISING OUT OF USE OR PERFORMANCE OF THE GAME REMAINS WITH YOU.
6. Limitation of Liability
DEVELOPER SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, OR CONSEQUENTIAL DAMAGES (INCLUDING, BUT NOT LIMITED TO, PROCUREMENT OF SUBSTITUTE GOODS OR SERVICES; LOSS OF USE, DATA, OR PROFITS; OR BUSINESS INTERRUPTION) HOWEVER CAUSED AND ON ANY THEORY OF LIABILITY, WHETHER IN CONTRACT, STRICT LIABILITY, OR TORT (INCLUDING NEGLIGENCE OR OTHERWISE) ARISING IN ANY WAY OUT OF THE USE OF THIS SOFTWARE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGE.
7. Governing Law
This EULA shall be governed by and construed in accordance with the laws of the United States of America. Any dispute arising under this EULA shall be resolved exclusively in the courts located in the United States of America.
8. Entire Agreement
This EULA constitutes the entire agreement between the parties concerning the subject matter hereof and supersedes all prior or contemporaneous agreements or understandings, written or oral, concerning such subject matter.
9. Updates
Developer may provide updates or upgrades to the Game. You consent to receive such updates or upgrades automatically.
By installing or using the Game, you acknowledge that you have read this EULA, understand it, and agree to be bound by its terms and conditions.
