Digital Drank EULA Agreement (lone.AI)
lone.AI, a game provided by Digital Drank, located in Michigan, U.S.A. ("Digital Drank," "we," "us," or "our"). This EULA agreement governs your use of lone.AI and any related services provided by Digital Drank. By accessing or using lone.AI, you agree to comply with and be bound by these Terms. If you do not agree to these Terms, please do not use lone.AI.
1. Eligibility: You must be at least 13 years old to use lone.AI. By using lone.AI, you represent and warrant that you are at least 13 years old. lone.AI is intended for a PG-13 audience but is not officially rated. Contains some violence.
2. Game Account: The game does not require account creation, and it is primarily played through your Steam account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
3. User Content: a. lone.AI may allow you to submit or share content, such as text, images, and videos.
b. By sharing content on lone.AI, you grant Digital Drank a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, adapt, publish, translate, distribute, and display such content.
4. Prohibited Conduct: You agree not to; a. Violate any applicable laws or regulations.
b. Use lone.AI for any unauthorized or illegal purpose.
c. Engage in any conduct that violates the intellectual property or other rights of Digital Drank or any third party under your account.
5. Resale and Copying Prohibition: You agree not to resell, distribute, or copy lone.AI, including but not limited to its software, content, and any associated materials, without the explicit written permission of Digital Drank. This prohibition includes, but is not limited to, the unauthorized reproduction, distribution, or resale of lone.AI through physical or digital means.
6. Termination: We may terminate or suspend your access to lone.AI without prior notice or liability for any reason, including, but not limited to, a breach of these Terms.
7. Changes to the EULA: We reserve the right to modify or update these Terms at any time. Your continued use of lone.AI after any changes will constitute your acceptance of such changes.
8. Changes to Game: a. The Alpha Version is an early version of the game, subject to testing and improvement.
b. Existing features, content, or functionalities may be modified, expanded, or removed.
c. Additional features, content, or functionalities may be added to the game.
9. Disclaimer of Warranties: lone.AI is provided "as is" and "as available" without any warranties of any kind, either express or implied.
10. Limitation of Liability: To the fullest extent permitted by applicable law, Digital Drank shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues.
11. Refunds: Refunds for the Early Access Version are subject to Digital Drank's and/or Steams refund policy, if applicable.
12. Governing Law: These Terms are governed by and construed in accordance with the laws of the United States and state of Michigan, U.S.A., without regard to its conflict of law principles.
