EULA
This End-User License Agreement ("EULA") is a legal contract between you, either an individual or a single entity ("You" or "Your"), and Chaf ("We", "Us", or "Our") regarding Your use of the Chaf software ("Software"). By installing or using the Software, You agree to be bound by the terms of this EULA. If You do not agree to the EULA, do not use the Software.
1. License Grant
We grant You a non-exclusive, non-transferable, personal license to use the Software on devices that You own or control, according to the terms of this EULA. This License is provided solely for personal use and not for redistribution or use on behalf of any third party. Compliance with minimum system requirements is Your responsibility.
2. Restrictions
You may not modify, distribute, sell, or create derivative works of the Software. You are prohibited from reverse engineering, decompiling, or disassembling the Software, except and only to the extent that such activity is expressly permitted by applicable law notwithstanding this limitation.
3. Intellectual Property
All intellectual property in the Software, including any enhancements, modifications, and updates, is owned by Us or Our licensors. The Software is licensed, not sold. This EULA does not transfer to You any rights of ownership in the Software.
4. User Generated Content
You retain ownership of any original content created by You within the Software ("User Generated Content" or "UGC"). By creating UGC, You grant Us a worldwide, non-exclusive, royalty-free license to use, reproduce, distribute, and display the UGC in connection with the Software.
You warrant that Your UGC does not violate any laws or rights of any third party, including copyright, privacy, and publicity rights. You agree to indemnify Us against any claims arising from Your UGC.
5. Termination
This EULA is effective until terminated by You or Us. You may terminate it at any time by ceasing all use of the Software and deleting all copies. The EULA will terminate immediately without notice if You fail to comply with any term. Upon termination, You must cease all use of the Software and delete all copies.
6. Sale and Dispute Resolution
The sale of the Software is conducted through the Steam platform, and any purchase-related disputes will be governed by the Refund Policy.
7. Governing Law
This EULA and any dispute arising out of or related to it will be governed by the laws of the jurisdiction where We are located, without regard to or application of its conflict of law provisions.
8. Disclaimer of Warranties
The Software is provided "as is," without warranty of any kind, express or implied. We do not warrant that the Software will meet Your requirements or operate without interruption or errors.
9. Limitation of Liability
In no event will We be liable for any indirect, special, incidental, or consequential damages arising out of or related to this EULA or the Software, including, without limitation, damages for lost profits, loss of goodwill, work stoppage, computer failure or malfunction, or any and all other commercial damages or losses.
10. General Provisions
This EULA constitutes the entire agreement between You and Us regarding the Software and supersedes all prior agreements and understandings, whether written or oral. If any part of this EULA is held invalid or unenforceable, that part will be construed to reflect the parties' original intent, and the remaining portions will remain in full force and effect.
11. Amendments
We reserve the right to amend this EULA at any time, at which point the new terms will apply to all existing and future use of the Software. You are advised to review this EULA periodically for any changes.
By installing or using the Software, You acknowledge that You have read this EULA, understand it, and agree to be bound by its terms and conditions.
