Terms of Use

This agreement stipulates the terms and conditions for using the software "Wizlite: Everybody Loved RPGs" (hereinafter referred to as "the Software") provided by 5dims Inc. (hereinafter referred to as "the Company"). Please read and agree to these terms before using the Software.

Article 1 (Definitions)
The terms used in this agreement are defined as follows:
1.User
Any individual who uses the Software.
2.Intellectual Property
Inventions, creations, plant varieties, designs, works of authorship, and other outcomes of human creative activity (including discoveries or clarifications of natural laws or phenomena with industrial utility), trademarks, trade names, and other identifiers used in business activities, as well as trade secrets and other technical or operational information useful for business activities.
3.Intellectual Property Rights
Rights defined by law or legally protected interests related to patents, utility models, breeder’s rights, designs, copyrights, trademarks, and other forms of intellectual property.

Article 2 (Consent to Terms)
1.Users may use the Software only after agreeing to these Terms of Use.
2.By downloading or installing the Software and completing the consent procedure, a usage agreement based on these terms is deemed established between the User and the Company.
3.If the User is a minor, the consent of a legal guardian is required to use the Software.
4.If a minor User falsely claims to have obtained consent from a legal guardian or misrepresents their age as an adult, or uses fraudulent means to make the Company believe they have legal capacity, the User cannot revoke any legal acts related to the Software.
5.If a minor User uses the Software after reaching the age of majority, the User is deemed to have ratified all agreements and actions related to the Software.

Article 3 (Changes to Terms)
1.The Company may revise these terms at any time without obtaining the User’s consent, and the User agrees to this without objection.
2.The Company will notify Users of any amendments to these terms through methods deemed appropriate by the Company.
3.Amendments to the terms take effect at the time the Company issues the notification described in the previous clause.
4.By continuing to use the Software after amendments, the User is deemed to have consented to the revised terms.

Article 4 (Prohibited Acts)
The Company prohibits the following acts when using the Software. If the Company determines that a User has violated any of these prohibitions, it may suspend their use of the Software or take other necessary actions:
1.Acts that infringe on the intellectual property rights of the Company or third parties.
2.Acts that damage the reputation or credibility of the Company or third parties, or constitute defamation.
3.Acts that infringe on the property of the Company or third parties, or acts that may lead to such infringement.
4.Acts that cause economic harm to the Company or third parties.
5.Threatening behavior toward the Company or third parties.
6.Use of or inducing computer viruses or other harmful programs.
7.Other acts deemed inappropriate by the Company.

Article 5 (Disclaimers)
1.The Company assumes no responsibility for damages arising from changes, interruptions, or termination of the Software’s content.
2.The Company is not responsible for the User’s environment for using the Software.
3.The Company does not guarantee that the Software meets specific purposes, expected functionality, accuracy, or utility, or that it is free of defects.
4.The Company endeavors to ensure that the Software operates smoothly in the recommended environment. However, the Company assumes no responsibility for any issues arising from the use of the Software outside the recommended environment or due to the User’s device environment.
5.Users acknowledge that changes to the terms or policies of software stores such as Steam may restrict the use of all or part of the Software.
6.The Company is not liable for direct or indirect damages caused by using the Software.
7.The above provisions do not apply in cases of intentional misconduct or gross negligence by the Company, or if the User qualifies as a consumer under applicable consumer protection laws.

Article 6 (External Links)
The Software may provide links to external websites ("Linked Sites") for convenience. The Company is not responsible for the content or handling of personal information on Linked Sites. Users are advised to review the terms and privacy policies of Linked Sites and use them at their own responsibility.

Article 7 (Prohibition of Assignment)
1.Users may not transfer their status, rights, or obligations under these terms to any third party without prior written consent from the Company or a method designated by the Company.
2.The Company may transfer its rights and obligations under these terms, including those related to the Software, at its discretion.

Article 8 (Severability)
If any provision of these terms is deemed invalid or unenforceable, the remaining provisions shall remain in full effect.

Article 9 (Contacting the Company)
For inquiries about the Software, please use the inquiry form provided on the Software or the Company’s website, or contact the Company via other designated methods.

Article 10 (Governing Law and Jurisdiction)
1.These terms shall be governed by and construed in accordance with Japanese law.
2.Any disputes shall be subject to the exclusive jurisdiction of the Tokyo District Court or Tokyo Summary Court, depending on the amount in controversy.
