This End-User License Agreement ("EULA") is a legal agreement between you (either an individual or a single entity) and Geoffrey Ruis for the use of Mall Manager ("the Game"). By installing, copying, or otherwise using the Game, you agree to be bound by the terms of this EULA. If you do not agree to the terms of this EULA, do not install or use the Game.
1. License Grant:
Geoffrey Ruis grants you a non-exclusive, non-transferable, limited license to install and use the Game solely for your personal or internal business purposes.
2. Restrictions:
You may not sublicense, rent, lease, lend, distribute, sell, or otherwise transfer the Game. You may not modify, adapt, translate, reverse engineer, decompile, or disassemble the Game, or create derivative works based on the Game.
3. Ownership:
Geoffrey Ruis retains all right, title, and interest in and to the Game, including all intellectual property rights therein.
4. Termination:
This EULA is effective until terminated. Your rights under this license will terminate automatically without notice from Geoffrey Ruis if you fail to comply with any term(s) of this EULA. Upon termination of this license, you shall cease all use of the Game and destroy all copies, full or partial, of the Game.
5. Disclaimer of Warranty:
The Game is provided "as is," without warranty of any kind. Geoffrey Ruis makes no warranties, express or implied, including without limitation, merchantability, fitness for a particular purpose, or non-infringement.
6. Limitation of Liability:
In no event shall Geoffrey Ruis be liable for any consequential, incidental, indirect, special, punitive, or other damages whatsoever (including, without limitation, damages for loss of business profits, business interruption, loss of business information, or other pecuniary loss) arising out of this EULA or the use of or inability to use the Game, even if Geoffrey Ruis has been advised of the possibility of such damages.
7. Governing Law:
This EULA shall be governed by and construed in accordance with the laws of the Netherlands, without regard to its conflicts of law provisions.
8. Entire Agreement:
This EULA constitutes the entire agreement between you and Geoffrey Ruis regarding the Game and supersedes all prior or contemporaneous understandings or agreements, written or oral, relating to the Game.
By installing or using the Game, you acknowledge that you have read this EULA, understand it, and agree to be bound by its terms and conditions.
