END-USER LICENSE AGREEMENT (EULA)

1. NOTICE
Please read this agreement carefully. By installing or using UFDS - Ukrainian Fight Drone Simulator (hereinafter referred to as the "UFDS Simulator"), you agree to all the terms and conditions of this End-User License Agreement entered into between you (hereinafter the "User") and SIMTEC SOLUTIONS LLC (company registration code: 45281083) (hereinafter the "Licensor").
2. GRANT OF LICENSE
The Licensor grants you a personal, limited, non-exclusive, non-transferable, revocable license to install, launch, and use the UFDS Simulator solely for non-commercial, educational, or recreational purposes.
3. RESTRICTIONS
The User is prohibited from:
Copying, Modifying, and Distributing:
a) Copying, modifying, adapting, translating, creating derivative works from, or otherwise altering the UFDS Simulator or any related materials without prior written consent from the rights holder.
b) Distributing, transmitting, publishing, or making the UFDS Simulator or any parts thereof accessible to third parties, including by placing it on the Internet.
Reverse Engineering and Other Technical Interference:
a) Performing reverse engineering, decompilation, disassembly, or attempting to gain access to the source code of the UFDS Simulator or its components.
b) Analyzing or scanning the Simulator to identify the architecture, algorithms, or other technical solutions implemented in the software.
Commercial Use and Transfer of Rights:
a) Selling, sublicensing, leasing, lending, or otherwise transferring the UFDS Simulator or any of its components to third parties, especially for commercial purposes, without prior written consent from the rights holder.
b) Using the UFDS Simulator or its parts as a component of other software products or services.
Bypassing Protection Mechanisms:
It is prohibited to bypass, disable, damage, or otherwise neutralise any technical protection measures, including Digital Rights Management (DRM) tools, implemented in the UFDS Simulator to prevent unauthorised access, copying, or use of the software.
4. INTELLECTUAL PROPERTY RIGHTS
All intellectual property rights in and to the UFDS Simulator—including but not limited to copyrights, trademarks, trade names, branding, patents (if applicable), design rights, databases, source code, programming objects, user interface visual elements, 3D models, audio and video content, and any other textual, graphical, multimedia or software content used in or in connection with the UFDS Simulator—are owned by the Licensor or by relevant third parties (affiliates, partners, sublicensees, or licensors of the Licensor) who have authorized their use.
The User acknowledges that:
a) All the above-mentioned elements are protected under applicable Ukrainian intellectual property laws, including international treaties and national legislation;
b) Nothing in this Agreement shall be construed as a transfer of ownership rights to any intellectual property to the User;
c) The User is granted a limited, non-exclusive, revocable, non-transferable right to use the UFDS Simulator solely to the extent necessary for their personal (non-commercial) use, in accordance with the terms of this Agreement;
d) Any unauthorised use, copying, modification, or distribution of protected content, as well as any attempts to infringe upon the Licensor’s intellectual property rights, may result in the User being held liable under applicable law.
5. TERMINATION OF THE AGREEMENT
This license becomes effective upon the User’s acceptance of the terms of this Agreement and shall remain in force until terminated under the provisions set forth below.
You may terminate this Agreement at any time at your sole discretion by permanently deleting the UFDS Simulator and all its components from your device.
The Licensor reserves the right to terminate this license at any time without prior notice if you breach any provision of this Agreement.
In the event of such a breach:
a) your license shall automatically terminate without the need for further notice;
b) you agree to immediately cease all use of the UFDS Simulator; c) you agree to permanently delete all copies of the UFDS Simulator in your possession or under your control.
Termination of the license does not relieve the User of liability for any breaches committed during its validity, nor does it affect any other rights or legal remedies available to the Licensor under applicable law.
6. DISCLAIMER OF WARRANTIES AND LIABILITY
The Licensor shall not be liable for any direct, indirect, incidental, special, or consequential damages, including but not limited to:
a) loss or corruption of data;
b) malfunction or damage to software or hardware;
c) loss of profit, business interruption, or loss of business information;
d) any other tangible or intangible losses arising from the use or inability to use the UFDS Simulator.
7. GOVERNING LAW AND DISPUTE RESOLUTION
This Agreement shall be governed by the laws of Ukraine.
All disputes or claims arising in connection with this Agreement shall be resolved by the competent courts of Ukraine in accordance with applicable law.
8. UPDATES AND AMENDMENTS
The Licensor reserves the right to modify or amend this End User License Agreement at any time without prior notice to the User.
The updated and valid version of the Agreement will always be available for review on the Licensor’s official website. The User agrees to independently monitor any updates to the Agreement.
Continued use of the UFDS Simulator following any changes constitutes the User’s acceptance of the revised terms. If you do not agree with the updated version of the Agreement, you must discontinue use of the UFDS Simulator and delete it from all devices on which it has been installed.
