Final User License Agreement (EULA) for Steam Game Release
1. Agreement Overview
This End User License Agreement ("EULA") is a legal agreement between you (either an individual or a single entity) and Hangzhou Players Rowing Network Technology Co., Ltd for the use of "Descent X" ("the Game"). By installing, copying, or otherwise using the Game, you agree to be bound by the terms of this EULA. If you do not agree to the terms of this EULA, do not install or use the Game.
2. License Grant
Hangzhou Players Rowing Network Technology Co., Ltd grants you a revocable, non-exclusive, non-transferable, limited right to install and use the Game on a single device for your personal, non-commercial use, strictly in accordance with the terms of this EULA.
3. Restrictions
You agree not to, and you will not permit others to:
a. Decompile, reverse engineer, disassemble, attempt to derive the source code of, or decrypt the Game.
b. Make any modification, adaptation, improvement, enhancement, translation, or derivative work from the Game.
c. Violate any applicable laws, rules, or regulations in connection with your access or use of the Game.
d. Remove, alter, or obscure any proprietary notice (including any notice of copyright or trademark) of Hangzhou Players Rowing Network Technology Co., Ltd or its affiliates, partners, suppliers, or licensors.
e. Use the Game for any revenue-generating endeavor, commercial enterprise, or other purpose for which it is not designed or intended.
f. Install, use, or permit the Game to exist on more than one device at a time or on any mobile device or other computer that you do not own or control.
g. Distribute the Game to third parties.
4. Intellectual Property
The Game, including without limitation all copyrights, patents, trademarks, trade secrets, and other intellectual property rights, are and shall remain the sole and exclusive property of Hangzhou Players Rowing Network Technology Co., Ltd. You agree that you do not have any ownership or other interest in any proprietary rights in the Game.
5. Updates and Modifications
Hangzhou Players Rowing Network Technology Co., Ltd may provide updates, patches, and other modifications to the Game that must be installed for the user to continue to use the Game. Hangzhou Players Rowing Network Technology Co., Ltd may update, patch, or modify the Game remotely and access the Game residing on your device for such purpose, and you hereby grant Hangzhou Players Rowing Network Technology Co., Ltd the right to deploy and apply such updates, patches, and modifications.
6. Term and Termination
This EULA is effective from the date you first use the Game and shall continue until terminated. You may terminate this EULA by deleting and removing the Game from all devices on which it is installed. This EULA will terminate immediately, without prior notice from Hangzhou Players Rowing Network Technology Co., Ltd, if you fail to comply with any provision of this EULA. Upon termination, you shall cease all use of the Game and delete all copies of the Game from all devices.
7. Warranty Disclaimer
The Game is provided "AS IS" without warranty of any kind, express or implied, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, and non-infringement. Hangzhou Players Rowing Network Technology Co., Ltd does not warrant that the Game will meet your requirements or that the operation of the Game will be uninterrupted or error-free.
8. Limitation of Liability
To the fullest extent permitted by applicable law, in no event shall Hangzhou Players Rowing Network Technology Co., Ltd, its affiliates, agents, directors, employees, suppliers, or licensors be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (a) your use or inability to use the Game; (b) any unauthorized access to or use of our servers and/or any personal information stored therein; (c) any bugs, viruses, trojan horses, or the like that may be transmitted to or through our Game by any third party; (d) any errors or omissions in any content or for any loss or damage incurred as a result of your use of any content posted, emailed, transmitted, or otherwise made available through the Game; and/or (e) the defamatory, offensive, or illegal conduct of any third party.
9. Miscellaneous
a. This EULA constitutes the entire agreement between you and Hangzhou Players Rowing Network Technology Co., Ltd regarding your use of the Game and supersedes all prior and contemporaneous written or oral agreements between you and Hangzhou Players Rowing Network Technology Co., Ltd.
b. Hangzhou Players Rowing Network Technology Co., Ltd’s failure to enforce any right or provision of this EULA will not be considered a waiver of those rights.
c. If any provision of this EULA is held to be invalid or unenforceable, the remaining provisions of this EULA will remain in effect.
d. You may not assign or transfer this EULA, by operation of law or otherwise, without Hangzhou Players Rowing Network Technology Co., Ltd’s prior written consent. Any attempt by you to assign or transfer this EULA, without such consent, will be null and of no effect. Hangzhou Players Rowing Network Technology Co., Ltd may freely assign or transfer this EULA without restriction.
By using the Game, you acknowledge that you have read and understood this EULA and agree to be bound by its terms and conditions.
