END USER LICENSE AGREEMENT (EULA)
JOTUNNSLAYER: HORDES OF HEL
This End User License Agreement (“EULA”) is a legally binding agreement between you (“User”, “you”) and Grindstone s.r.o., with its registered seat at Pekná 13, 040 01 Košice, Slovak Republic, ID No.: 48 258 121 (“Grindstone”, “we”, “us”, or “our”), governing your access to and use of the game software entitled Jotunnslayer: Hordes of Hel (the “Game”), including all patches, updates, downloadable content (DLC), expansions, online features, virtual items, and related documentation.
By installing, downloading, accessing, or otherwise using the Game, you agree to be bound by this EULA.
If you do not agree, do not install or use the Game.
1. License Grant
Subject to compliance with this EULA, Grindstone grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to install and use the Game solely for personal, non-commercial entertainment purposes on a device you own or control.
The Game is licensed, not sold.
All rights not expressly granted are reserved.
2. Intellectual Property
All right, title, and interest in and to the Game — including but not limited to:
Gameplay systems
Code (source and object)
Characters, lore, and narrative
Visual assets and UI
Music and sound design
Trademarks, including “Jotunnslayer: Hordes of Hel”
— are owned by Grindstone and/or its licensors and are protected by international intellectual property laws.
No ownership rights are transferred to you.
3. User-Generated Content (UGC)
Where the Game permits user-generated content:
You retain ownership of original content you create.
However, you grant Grindstone a worldwide, non-exclusive, royalty-free, perpetual, irrevocable, sublicensable license to use, reproduce, modify, distribute, display, and promote such content in connection with the Game and related marketing.
You warrant that:
You own necessary rights.
Your content does not infringe third-party rights.
Your content complies with applicable law.
Grindstone may remove content at its discretion.
4. Acceptable Use
You agree not to:
Commercially exploit the Game
Reverse engineer except where legally mandated
Circumvent DRM or anti-cheat
Use cheats, bots, or automation
Violate applicable laws
Infringe third-party rights
Violation may result in suspension or termination.
5. Code of Conduct
Prohibited behavior includes:
Harassment, hate speech, discrimination
Threats or abuse
Cheating or exploit abuse
Impersonation
Commercial advertising inside the Game
Grindstone may issue warnings, suspensions, or permanent bans at its discretion.
6. Online Services
Online services may be modified, interrupted, or discontinued at any time.
Temporary outages or permanent shutdown of online features shall not constitute breach or grounds for refund beyond mandatory legal rights.
7. Updates & DLC
Updates and DLC may be provided at Grindstone’s discretion.
There is no obligation to provide ongoing support or future content.
8. Anti-Cheat & Security
The Game may use anti-cheat and anti-tamper technologies.
By using the Game, you consent to such systems operating to detect unauthorized behavior.
9. Streaming & Creator License
You are granted a limited, revocable license to stream and monetize gameplay footage through platforms such as YouTube or Twitch, provided:
The Game is legitimately obtained
You do not distribute extracted assets
You do not imply official endorsement
You comply with platform rules
Grindstone may request removal of infringing or harmful content.
10. Modding Policy
Unless expressly authorized:
You may not create or distribute mods.
If modding tools are officially enabled:
Mods must be non-commercial
Must not infringe third-party rights
Must not include malware or cheats
Must not contain unlawful content
Grindstone may remove mods at its sole discretion.
11. AI / Machine Learning Restriction
You may not:
Use the Game or any part thereof to train AI or machine learning systems
Scrape gameplay or assets for dataset purposes
Extract or archive assets for automated processing
Unauthorized AI usage constitutes material breach.
12. Privacy & Data Protection
Use of the Game is governed by Grindstone’s Privacy Policy (available on the official website).
13. Disclaimer of Warranties
To the maximum extent permitted by law:
The Game is provided “AS IS” and “AS AVAILABLE.”
All implied warranties, including merchantability, fitness for a particular purpose, and non-infringement, are disclaimed.
Mandatory consumer rights are not excluded.
14. Limitation of Liability
To the fullest extent permitted by law:
Grindstone shall not be liable for:
Loss of profits
Data loss
Business interruption
Indirect or consequential damages
Total liability shall not exceed the amount paid for the Game.
Nothing excludes liability where prohibited by law.
15. Binding Arbitration
PLEASE READ CAREFULLY — THIS AFFECTS YOUR RIGHTS.
For users outside the EU:
All disputes shall be resolved through binding individual arbitration under the rules of the American Arbitration Association (AAA).
Arbitration shall:
Be conducted in English
Take place in the user’s state (or remotely)
Be final and binding
Either party may seek injunctive relief in court for IP violations.
EU users retain mandatory consumer protections.
16. Class Action Waiver
You agree disputes will be resolved individually.
You waive the right to participate in:
Class actions
Representative actions
Consolidated proceedings
If unenforceable, arbitration shall not apply to that claim.
17. EU Digital Services Act (DSA) Compliance
For users in the European Union:
Grindstone complies with Regulation (EU) 2022/2065 (Digital Services Act).
Users may report illegal content via designated reporting channels listed on the official website.
Content moderation decisions may be:
Appealed through internal complaint mechanisms
Subject to out-of-court dispute settlement bodies as required by EU law
Nothing in this EULA limits rights granted under the DSA.
18. Export Compliance
You represent that you are not located in a sanctioned jurisdiction and are not on any restricted party list.
The Game may not be exported in violation of applicable laws.
19. Force Majeure
Grindstone shall not be liable for failure or delay in performance due to events beyond reasonable control, including but not limited to:
Natural disasters
War
Terrorism
Government actions
Sanctions
Internet outages
Cyberattacks
Platform shutdowns
Labor disputes
Such events shall not constitute breach of this EULA.
20. Distribution Platforms
This EULA is between you and Grindstone.
Distribution platforms are third-party beneficiaries and may enforce its terms.
Refunds are governed by platform rules.
21. Term & Termination
This EULA remains effective until terminated.
Grindstone may terminate for breach.
Sections relating to IP, arbitration, liability, AI restrictions, and dispute resolution survive termination.
22. Governing Law
This EULA shall be governed by the laws of the Slovak Republic.
For US users, arbitration provisions apply.
Mandatory consumer protections remain unaffected.
