This end-user license agreement (the AGREEMENT) is an agreement between you (individual or single entity), and the author (ClickPhase) of FlightTracker3D (the SOFTWARE).
The SOFTWARE is the property of its author (ClickPhase) and is protected by copyright laws and international copyright treaties. The SOFTWARE is not sold, it is licensed.
If you accept the terms and conditions of this AGREEMENT, you have certain rights and obligations as follow:
YOU MAY:
1. Use the SOFTWARE for personal means only, on computers you own, use or personally responsible for.
2. Make a copy of the SOFTWARE for archival purposes only.
YOU MAY NOT:
1. Copy and distribute the SOFTWARE or any portion of it except as expressly provided in this Agreement.
2. Sublicense, rent, lease or transfer your licensed copy of this SOFTWARE.
3. Sublicense, rent or lease the SOFTWARE or any portion of it.
4. Decompile, disassemble, reverse engineer or otherwise modify the SOFTWARE or any portion of it, or make any attempt to bypass, unlock, or disable any protective or initialization system on the SOFTWARE.
5. Include the SOFTWARE in any commercial products intended for manufacture, distribution, or sale.
6. Use the SOFTWARE on the computers configured as multi-user Remote Desktop servers.
7. Use the SOFTWARE on the computers intended for public access, such as kiosks and terminals.
THE SOFTWARE IS PROVIDED "AS IS", WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NONINFRINGEMENT. IN NO EVENT SHALL THE AUTHORS OR COPYRIGHT HOLDERS BE LIABLE FOR ANY CLAIM, DAMAGES OR OTHER LIABILITY, WHETHER IN AN ACTION OF CONTRACT, TORT OR OTHERWISE, ARISING FROM, OUT OF OR IN CONNECTION WITH THE SOFTWARE OR THE USE OR OTHER DEALINGS IN THE SOFTWARE.
