END USER LICENSE AGREEMENT (EULA) For "Don't Puke!"
This End User License Agreement ("Agreement") is a legal agreement between you (either an individual or a single entity) and DIVR LABS s.r.o. ("DIVR LABS"), with its registered office at nám. Jiřího z Poděbrad 6, 130 00 Praha 3, Czech Republic, company number 05214378, for the software product "Don't Puke!" ("Software").
By installing, copying, or otherwise using the Software, you agree to be bound by the terms of this Agreement. If you do not agree to the terms of this Agreement, do not install or use the Software.
1. Grant of License: DIVR LABS grants you a non-exclusive, non-transferable license to use the Software for personal, non-commercial purposes as set forth in this Agreement.
2. Ownership: The Software is licensed, not sold. This Agreement does not provide you with title or ownership of the Software, but only a limited right of use.
3. Use Restrictions: You may not reverse engineer, decompile, or disassemble the Software, except and only to the extent that such activity is expressly permitted by applicable law notwithstanding this limitation.
4. Multiplayer/Online Conduct: When participating in multiplayer or online services, you must comply with all applicable laws and regulations, and respect other players.
5. Updates and Modifications: DIVR LABS reserves the right to update or modify the Software at any time, without prior notice to you.
6. Termination: Without prejudice to any other rights, DIVR LABS may terminate this Agreement if you fail to comply with the terms and conditions. In such event, you must destroy all copies of the Software.
7. Disclaimer of Warranty: The Software is provided "as is" without warranty of any kind, either express or implied, including, but not limited to, any implied warranties of merchantability or fitness for a particular purpose.
8. Limitation of Liability: DIVR LABS shall not be liable for any special, incidental, or consequential damages resulting from the possession, use, or malfunction of the Software.
9. Governing Law: This Agreement shall be governed by the laws of the Czech Republic, without regard to its conflict of laws principles.
10. Acknowledgment: By using the Software, you acknowledge that you have read this Agreement, understand it, and agree to be bound by its terms and conditions.
