END USER LICENSE AGREEMENT
for Lost Colony (the "Game")

IMPORTANT: PLEASE READ THIS END USER LICENSE AGREEMENT ("EULA") CAREFULLY BEFORE INSTALLING OR USING THE GAME. BY INSTALLING OR USING THE GAME, YOU AGREE TO BE BOUND BY THE TERMS OF THIS EULA. IF YOU DO NOT AGREE TO THE TERMS OF THIS EULA, DO NOT INSTALL OR USE THE GAME.
1. License Grant. Subject to the terms of this EULA, Digital Sagas LLC ("Company") grants you a limited, non-exclusive, non-transferable, revocable license to use the Game for your personal, non-commercial use.
2. Restrictions. You shall not:
a. Copy or reproduce the Game except for backup purposes or as otherwise expressly permitted by applicable law;
b. Modify, adapt, translate, reverse engineer, decompile, or disassemble the Game;
c. Create derivative works based on the Game;
d. Remove or alter any copyright, trademark, or other proprietary notices contained in the Game;
e. Rent, lease, lend, sell, sublicense, distribute, or otherwise transfer the Game to any third party;
f. Use the Game for any unlawful purpose or in any manner that violates this EULA or any applicable laws or regulations.
3. Ownership. The Game, including all intellectual property rights therein, is and shall remain the property of Company and its licensors. Except for the limited license granted to you in Section 1, you have no right, title, or interest in or to the Game.
4. Updates. Company may, from time to time, in its sole discretion, provide updates, upgrades, or patches to the Game. Your continued use of the Game after any such update, upgrade, or patch shall constitute your acceptance of such update, upgrade, or patch.
5. Termination. This EULA is effective until terminated by either party. You may terminate this EULA by uninstalling the Game and destroying all copies of the Game in your possession. Company may terminate this EULA at any time if you fail to comply with any term or condition of this EULA. Upon termination of this EULA, you shall cease all use of the Game and destroy all copies of the Game in your possession.
6. Disclaimer of Warranty. THE GAME IS PROVIDED "AS IS" WITHOUT ANY WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, COMPANY DISCLAIMS ALL WARRANTIES, INCLUDING, BUT NOT LIMITED TO, WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. COMPANY DOES NOT WARRANT THAT THE GAME WILL BE UNINTERRUPTED OR ERROR-FREE, THAT DEFECTS WILL BE CORRECTED, OR THAT THE GAME IS FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
7. Limitation of Liability. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL COMPANY BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING, BUT NOT LIMITED TO, DAMAGES FOR LOSS OF PROFITS, REVENUE, DATA, USE, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO YOUR USE OR INABILITY TO USE THE GAME, EVEN IF COMPANY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN NO EVENT SHALL COMPANY'S AGGREGATE LIABILITY FOR ANY AND ALL CLAIMS ARISING OUT OF OR RELATING TO THIS EULA EXCEED THE AMOUNT PAID BY YOU FOR THE GAME.
8. Governing Law. This EULA shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflicts of law principles.
9. Entire Agreement. This EULA constitutes the entire agreement between you and Company regarding the Game and supersedes all prior and contemporaneous agreements and understandings, whether written or oral.
10. Severability. If any provision of this EULA is held to be invalid or unenforceable, the remaining provisions of this EULA shall remain in full force and effect.
11. Waiver. The failure of Company to enforce any right or provision of this EULA shall not constitute a waiver of such right or provision.
