End User License Agreement (EULA) for Jim's Nightmare
IMPORTANT – READ CAREFULLY:
This End User License Agreement ("EULA") is a legal agreement between you (either an individual or a single entity) and Sky Den Games and Pumpkiny Games for the software product titled "Jim's Nightmare," which includes computer software and may include associated media, printed materials, and online or electronic documentation (collectively, the "Software").
By installing, copying, or otherwise using the Software, you agree to be bound by the terms of this EULA. If you do not agree to the terms of this EULA, do not install or use the Software.
SOFTWARE LICENSE
1.1 Grant of License. This EULA grants you the following rights:
Installation and Use. You may install and use one copy of the Software on a single computer.
Backup Copy. You may make a single backup copy of the Software. You may use this copy solely for archival purposes.
DESCRIPTION OF OTHER RIGHTS AND LIMITATIONS
Limitations on Reverse Engineering, Decompilation, and Disassembly. You may not reverse engineer, decompile, or disassemble the Software.
Rental. You may not rent, lease, or lend the Software.
Support Services. Sky Den Games and Pumpkiny Games may provide you with support services related to the Software.
Compliance with Applicable Laws. You must comply with all applicable laws regarding the use of the Software.
TERMINATION
Without prejudice to any other rights, Sky Den Games and Pumpkiny Games may terminate this EULA if you fail to comply with the terms and conditions of this EULA. In such event, you must destroy all copies of the Software and all of its component parts.
COPYRIGHT
The Software is protected by copyright laws and international copyright treaties, as well as other intellectual property laws and treaties. The Software is licensed, not sold.
LIMITED WARRANTY
No Warranties. Sky Den Games and Pumpkiny Games expressly disclaim any warranty for the Software. The Software and any related documentation are provided "as is" without warranty of any kind, either express or implied, including, without limitation, the implied warranties of merchantability or fitness for a particular purpose.
No Liability for Damages. In no event shall Sky Den Games or Pumpkiny Games be liable for any damages whatsoever (including, without limitation, damages for loss of business profits, business interruption, loss of business information, or any other pecuniary loss) arising out of the use of or inability to use this Software.
MISCELLANEOUS
This EULA is governed by the laws of the jurisdiction where Sky Den Games is located.
ACKNOWLEDGEMENT
By installing and using "Jim's Nightmare," you acknowledge that you have read this EULA, understand it, and agree to be bound by its terms and conditions.
