End User License Agreement ("EULA")
You should carefully read the entire following end user license agreement before downloading, installing, using or playing the game or any related software (collectively, the "Game"). This agreement contains important terms that affect your legal rights. By downloading, installing, using or playing the Game, you agree to be bound by all the terms of this agreement. If you do not agree to all the terms of this agreement, please do not (and you are not permitted to) download, install, use or play the Game.
This Agreement is between you and Milos Trickovic ("Developer"). The Developer is solely responsible for the Game and its content. Valve Corporation ("Valve") is not a party to this Agreement and has no obligations or liabilities with respect to the Game or this Agreement.
The Game is distributed through Steam, an online service operated by Valve. You must also agree to the Steam Subscriber Agreement and the Steam Privacy Policy before using Steam or accessing the Game through Steam. The Steam Subscriber Agreement and the Steam Privacy Policy can be found at [1](https://store.steampowered.com/eula/1716740_eula_0) and [2](http://www.valvesoftware.com/privacy.htm) respectively.
The Developer grants you a non-exclusive, non-transferable, revocable, limited license to use the Game for your personal, non-commercial entertainment purposes, in accordance with the terms of this Agreement. You may not copy, modify, distribute, sell, rent, sublicense, or create derivative works of the Game, except as expressly authorized by the Developer or as permitted by law. You may not reverse engineer, decompile, disassemble, or attempt to discover the source code of the Game, except as permitted by law. You may not use the Game for any illegal, immoral, or harmful purposes, or in any manner that violates the Steam Online Conduct Rules [3](http://steampowered.com/index.php?area=online_conduct).
The Game may allow you to create, upload, or share your own content, such as custom maps, characters, skins, or other modifications ("User Generated Content" or "UGC"). You retain all rights and ownership of your UGC, but you grant the Developer a perpetual, irrevocable, worldwide, royalty-free, non-exclusive, sublicensable, and transferable license to use, reproduce, distribute, prepare derivative works of, display, and perform your UGC in connection with the Game and the Developer's business, including for promoting and redistributing part or all of the Game (and derivative works thereof) in any media formats and through any media channels. You also grant each user of the Game a non-exclusive license to access your UGC through the Game, and to use, reproduce, distribute, prepare derivative works of, display, and perform your UGC as permitted by the functionality of the Game and this Agreement.
You are solely responsible for your UGC and the consequences of creating, uploading, or sharing it. You represent and warrant that you have all the rights, power, and authority necessary to grant the rights to your UGC as described in this Agreement. You also represent and warrant that your UGC does not infringe or violate any third-party rights, including but not limited to intellectual property rights, privacy rights, or publicity rights. You agree to indemnify and hold harmless the Developer and Valve from any claims, damages, liabilities, costs, and expenses (including reasonable attorney's fees) arising out of or related to your UGC or your breach of this Agreement.
The Developer respects the intellectual property rights of others and expects you to do the same. If you believe that your work has been copied or used in the Game in a way that constitutes copyright infringement, please contact the Developer at trile_le3@yahoo.com.
The Game may allow you to interact with other users through online features, such as chat, voice, or multiplayer modes. You are solely responsible for your interactions with other users and your use of the online features. You agree to use the online features in a respectful and lawful manner, and in accordance with the Steam Online Conduct Rules [3](http://steampowered.com/index.php?area=online_conduct). The Developer and Valve have no obligation to monitor or moderate the online features, but reserve the right to do so at their sole discretion. The Developer and Valve also reserve the right to remove any content or ban any user from the online features for any reason, without notice or liability.
The Game may require an internet connection and may automatically download and install updates, patches, and other content from the Developer or Valve. These updates, patches, and other content are part of the Game and subject to this Agreement. You agree to receive and accept these updates, patches, and other content as a condition of using the Game. You also agree that the Game may collect and transmit certain technical and usage data to the Developer or Valve for the purposes of improving the Game, providing support, and enforcing this Agreement.
The Game is provided "as is" and "as available", without any warranties of any kind, express or implied. The Developer and Valve disclaim all warranties, including but not limited to the warranties of merchantability, fitness for a particular purpose, non-infringement, and title. The Developer and Valve do not warrant that the Game will be uninterrupted, error-free, secure, or free of viruses or other harmful components. The Developer and Valve do not warrant that the Game will meet your expectations or requirements, or that any defects or errors in the Game will be corrected. The Developer and Valve are not responsible for any loss or damage caused by the Game, your use of the Game, or your inability to use the Game, including but not limited to any loss of data, loss of profits, loss of goodwill, or any indirect, incidental, special, exemplary, or consequential damages. Some jurisdictions do not allow the exclusion or limitation of certain warranties or damages, so some of the above exclusions or limitations may not apply to you.
To the maximum extent permitted by law, the Developer's and Valve's total liability to you for any claims arising out of or related to the Game or this Agreement, whether based on contract, tort, or any other legal theory, is limited to the amount you paid to access the Game, or one hundred U.S. Dollars (USD 100), whichever is greater. You agree that you will not bring any claim against the Developer or Valve more than one year after the date on which your claim arose.
You agree to resolve any dispute with the Developer or Valve arising out of or related to the Game or this Agreement through binding arbitration, and not in a court of law. Arbitration is a less formal and more efficient way of resolving disputes than a lawsuit, and it allows for more limited discovery and appeals than a court proceeding. You agree that any arbitration will take place on an individual basis, and not on a class, collective, or representative basis. You also agree to waive your right to a jury trial and your right to participate in a class action or other representative proceeding. This arbitration agreement is governed by the Federal Arbitration Act and the rules of the American Arbitration Association. If any part of this arbitration agreement is found to be invalid or unenforceable, then that part will be severed and the rest of the agreement will remain in effect. This arbitration agreement will survive the termination of this Agreement and your use of the Game. If you are a customer with residence in the European Union, this arbitration agreement does not apply to you, and you may bring any claim against the Developer or Valve in a court of competent jurisdiction in your country of residence.
This Agreement constitutes the entire agreement between you and the Developer regarding the Game and supersedes any prior or contemporaneous agreements, understandings, or communications. This Agreement may not be modified or amended by you without the written consent of the Developer. The Developer may modify or amend this Agreement at any time by posting the updated terms on Steam or the Game's website. Your continued use of the Game after the updated terms are posted will constitute your acceptance of the updated terms. If any part of this Agreement is found to be invalid or unenforceable, then that part will be severed and the rest of the agreement will remain in effect. This Agreement will be governed by and construed in accordance with the laws of the Republic of Serbia and the United States of America, without regard to any conflict of law principles. The United Nations Convention on Contracts for the International Sale of Goods does not apply to this Agreement. You agree to comply with all applicable laws and regulations in connection with your use of the Game, including but not limited to export control laws and sanctions. The Developer may assign or transfer its rights and obligations under this Agreement to any person or entity without your consent. You may not assign or transfer your rights and obligations under this Agreement to anyone else without the written consent of the Developer. This Agreement does not create any rights or benefits for any third parties, except for Valve and its affiliates, who are intended third-party beneficiaries of this Agreement and may enforce its terms. The failure of the Developer or Valve to enforce any provision of this Agreement does not constitute a waiver of that provision or the right to enforce it in the future. The headings and captions in this Agreement are for convenience only and have no legal or contractual effect. The words "include" and "including" are not limiting and mean "include without limitation" and "including without limitation". The terms "you" and "your" refer to the individual who downloads, installs, uses, or plays the Game, or the legal entity that you represent if you are acting on behalf of such entity.
