This is for your safety, ours, and anyone from the outside who tangentially becomes involved with us.

If you don't agree with this EULA - you can't play. If you're fine with that, just click "Exit Game" below. We can't let you proceed without accepting the EULA.

BEFORE WE START
This EULA is essentially a Contract between you and 5th Step Games (subsequently, "5th Step and "We"), telling you how you're allowed to use our game, 'Poly Beats'.
For the rest of the EULA, the term 'Poly Beats' refers to the actual software of the video game, all its components (like source code) and its music.

It'll also apply to every single update of our game, unless we say otherwise in a separate Agreement. In the event of this needing to occur, you'll be explicitly notified as a player.

By the way, if you're a minor (or, below the age of contractual consent in your country), get your parent, legal guardian, or some other trusted adult to read this EULA and agree to it, since you can't. you baby.

STUFF ABOUT STEAM
Our game is distributed currently through Steam by Valve Incorporated, and they have their own Terms & Conditions, that we don't have any right over how to enforce - their Terms & Conditions overrule ours if they overlap, unless Valve themselves say that specific Terms & Conditions by us, matter more (which would be an honor.)

HEALTH AND SAFETY
Poly Beats is a rhythm game (and a pretty good one, at that) so your fingers, wrists... whatever you use to play the game, navigate through menus, and all that other stuff, can get sore after a while. Apart from that, you could experience pain, or numbness in said body parts. If those happen, take a break, and possibly see a doctor.

Also, Poly Beats has content that could trigger epileptic seizures and photosensitivity. If you're susceptible to be affected or have a reaction in any way due to that factor, please don't play Poly Beats.

Okay... so now; knowing this and accepting this EULA, you're playing at your own risk. It's your responsibility to know your limits and if you are fit to play. We aren't liable for any health issues that happen in places where we provided reasonable warnings, and instructions (like the Health and Safety screen every time you start the base game with no additional software that modifies the game's code).

Nothing in this EULA limits or excludes any liability we're required to accept though, for example, liability for personal injury caused by our own shortcomings in taking proper care of our game (negligence in legal terms, yo).

LICENSING AND OWNERSHIP
We're giving you the right to get Poly Beats (well, a license), so that you can download, install, and play it for your own personal enjoyment.
What we will not permit you doing, is:
- using our game, or our DLC content for commercial purposes unless we say you can explicitly (for that, email us at developers@5thstepgames.co.uk.)
- Grant a sublicense to ANY of our paid content, that including, licences to 'Encore Support' (our Supporter tier DLC), or any of our DLCs, both retroactively and future planned.
- Copy our game, apart from the stuff associated with it that's necessary to run the game - like temporary files (obviously.)
- Sell, rent, lease, or, well, basically distribute Poly Beats in any way.
- Edit, merge, distribute, translate, reverse engineer, decompile, or otherwise dissassemble Poly Beats. (unless if making non-malicious mods for the game that doesn't distribute or edit our code.)
- Cheat, deliberately exploit bugs and glitches, deliberately harass or grief other players, or utilize ANY software that does that sorta stuff in Poly Beats.
- Remove or bypass any systems used in Poly Beats to mitigate misuse of the game.
- Misuse Poly Beats in a way that's literally illegal - including moral rules.

We keep all the ownership rights to Poly Beats, everything included in the game's files - except external plugins we use (such as the Steam API, Discord Social SDK, etc.) user-generated content such as Custom Chart-Maps, and Custom Themes (which we'll talk about later.) No proprietary rights are given to you, through this agreement. 'Kay?

We reserve the right to unilaterally deploy patches and updates to Poly Beats to fix bugs, glitches, or any other issues, for example, preventing misuse of the game or breach of the EULA, and of course, making our game more fire. (legally, i mean "enhancing gameplay", with things like providing more additional content.)

This will be so, while not removing core functionality you reasonably expect when acquiring the game.

We want our game to be a safe space, so be polite and considerate when using any of our online features, especially when interacting with other players. Don't use offensive or rude usernames ANYWHERE on our platform, because we can, and will take appropriate action against you (these can range from changing your username, to blocking your access to Poly Beats.)

USER GENERATED CONTENT
Any content you upload to either our servers ("content" including things such as Custom Chart-Maps, Custom Themes, and more things in future), or our Steam Workshop (referred to as the "Poly Beats Marketplace" for the rest of the EULA) are YOUR responsibility. You own the rights, licenses, and permissions to the content you create - and you authorize 5th Step Games, and Valve Incorporated (only through the fact they own Steam Workshop, nothing else though), to use patents, trademarks, trade secrets, and copyright in your stuff to allow for inclusion on our Poly Beats Marketplace.

You also grant us (both 5th Step Games and Valve Incorporated through Steam Workshop) a non-exclusive licence to publish it on our servers, including anything reasonably related to it (like storing, displaying, and reformatting it). 5th Step Games won't sell your content to 3rd-Parties without your explicit consent.

However, amidst all this, you're responsible for the content you upload, or post to the Poly Beats Marketplace. This means you're the one who's picking up all risks related to it. For example, if someone relies on your content for some reason and it's incorrect, or if there's a claim about IPs tied to your stuff. Basically, if your content causes trouble, it's your fault.

By posting content you didn't create to the Poly Beats Marketplace, you're basically saying you have the right to do so. If you don't, then that'll be fun for you to discuss with the owners (if they actually do bother to reach out to you, in which, if they do, it's probably [INSERT COMPANY WHO'LL SUE IF WE SAY THEIR NAME]), because we assume no responsibility for whatever you have going on between the owners and yourself.

both 5th Step Games and Valve Incorporated have no responsibility whatsoever in these cases.

LIABILITY
We give you all the rights to Poly Beats 'as is' - to the extent permitted by applicable law.

What that means is that we don't guarantee you that Poly Beats works perfectly without any bugs, glitches, or other issues. realistically, no game dev can, for their own game.

For as much as the law allows, we don't take any responsibilities or liability for Poly Beats having any issues, bugs, or glitches.

TERMINATION
If you breach this agreement, we have the right to terminate it without any notice period.
If it comes to this (and we're really hoping it doesn't. we like you) you'll lose all rights granted in this EULA, including the right to use Poly Beats.

DISPUTE, DISPUTE, RESOLUTION (Governing Law and Dispute Resolution)
This EULA, your use of Poly Beats, and any claims or issues related to this agreement — including damages from breaking it or any unfair benefits — are all handled under the laws of the United Kingdom (ignoring conflict-of-law stuff, so we're not dealing with jurisdiction's laws in other places.)

if there’s a dispute, you're gonna benefit from consumer protection rights under the place you live. In those cases, you can bring legal proceedings either in the UK, or in local courts.

CHANGES TO THE EULA
We're allowed to make changes to this agreement, and reserve the right to.
In such cases, we'll tell you to read the new one, and take reasonable steps to draw your attention to it.

The changes come into effect 14 days after we post the amended EULA online, unless we say it's for longer, or less time.

If you don't agree to the changes, you can terminate the EULA by just not using Poly Beats.
If you continue to use Poly Beats after the fact, it'll be assumed that you agree to the new EULA in its entirety.

OTHER LEGAL STUFF
You can't give this EULA to anyone else.

For as much as the law allows, we'll stick to everything in this agreement. If any part isn't valid or enforced, the rest still will.
