Chill Out: The Art of Chaos
This End User License Agreement ("EULA") is a legal agreement between you (referred to herein as "you" or "User") and Lancet Technologies Ltd. (referred to herein as "Company," "we," "us," or "our") for the use of the Chill Out: The Art of Chaos video game software and related materials (collectively referred to as the "Game").
1. Acceptance of Terms
By installing, copying, or otherwise using the Game, you agree to be bound by the terms of this EULA. If you do not agree to these terms, do not install or use the Game.
2. License Grant
Subject to your compliance with this EULA, Company grants you a non-exclusive, non-transferable, limited right and license to use the Game for your personal, non-commercial entertainment purposes on a personal computer owned or controlled by you.
3. Restrictions
a. You may not modify, distribute, transmit, display, perform, reproduce, publish, license, create derivative works from, transfer, or sell any part of the Game.
b. You may not reverse engineer, decompile, disassemble, or attempt to derive the source code of the Game, unless permitted by applicable law.
c. You may not remove or alter any trademark, copyright, or other proprietary notices from the Game.
4. Ownership
The Game is licensed, not sold, to you. Company retains all rights, title, and interest in and to the Game, including all intellectual property rights.
5. User Content
Any content created, shared, or uploaded by you within the Game may be subject to monitoring and moderation by Company. You grant Company a non-exclusive, perpetual, irrevocable, royalty-free, fully paid-up, worldwide license to use, reproduce, distribute, modify, display, and perform such content for the purpose of operating and promoting the Game.
6. Termination
This EULA is effective until terminated. Your rights under this license will terminate automatically without notice if you fail to comply with any term of this EULA.
7. Limitation of Liability
To the maximum extent permitted by applicable law, in no event shall Company be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or in connection with the use of the Game.
8. Governing Law
This EULA is governed by and construed in accordance with the laws of California, USA. Any disputes arising from or related to this EULA shall be subject to the exclusive jurisdiction of the courts located in California, USA.
9. Miscellaneous
This EULA constitutes the entire agreement between you and Company regarding the Game and supersedes all prior or contemporaneous communications, whether oral or written.
