END USER LICENSE AGREEMENT
THIS SOFTWARE IS LICENSED, NOT SOLD. The owner and developer of this software, Yasin KÜÇÜK, retains all rights not expressly granted to you. The products subject to this license, collectively referred to as "PRODUCTS," include Game Software, Editors, New Materials, and Additional Content (each as defined below).
This is a legal agreement between you and Yasin KÜÇÜK. Before installing, downloading, opening, or configuring the game ("Bondman Of Traps"), editing software, or any part of the game software that allows you to create various productions ("EDITORS"), or any material, editing, modification, adaptation, copy, improvement, or similar content ("NEW MATERIALS") created using Editors, and/or any other downloadable content provided or offered for sale by Yasin KÜÇÜK ("ADDITIONAL CONTENT"), please carefully review this End User License Agreement ("AGREEMENT"). The game software includes all software included in the video game, related media, any updates and upgrades not distributed under a separate license, and all copies of such software.
Please seek information about any parts you do not understand. If you are not eighteen (18) years old, show this Agreement to your parents.
IMPORTANT – READ CAREFULLY: BY INSTALLING, DOWNLOADING, OPENING, COPYING, AND/OR USING THIS GAME SOFTWARE, EDITORS, NEW MATERIALS, OR ADDITIONAL CONTENT, YOU CONFIRM THAT YOU HAVE READ THIS AGREEMENT AND AGREE TO BE BOUND BY ITS TERMS. THIS AGREEMENT IS APPLICABLE TO ALL USERS OF THE GAME SOFTWARE, EDITORS, NEW MATERIALS, AND ADDITIONAL CONTENT, INCLUDING USERS CONTRIBUTING TO THE SOFTWARE, CONTENT, INFORMATION, AND OTHER MATERIALS. IF YOU DO NOT AGREE TO THE TERMS OF THIS AGREEMENT, DO NOT INSTALL, OPEN, COPY, OR OTHERWISE USE THE PRODUCT. IF YOU ARE DISSATISFIED WITH THE GAME SOFTWARE, EDITORS, NEW MATERIALS, ADDITIONAL CONTENT, OR OTHER CONTENT OR INFORMATION PROVIDED BY OR THROUGH Yasin KÜÇÜK, STOP USING THE PRODUCTS. YOUR AGREEMENT TO COMPLY WITH THIS AGREEMENT IS EFFECTIVE UPON YOUR USE OF THE PRODUCTS. IF YOU DO NOT ACCEPT THE CONDITIONS STATED IN THIS AGREEMENT, DO NOT DOWNLOAD OR USE THE GAME SOFTWARE, EDITORS, NEW MATERIALS, OR ADDITIONAL CONTENT. Yasin KÜÇÜK WILL NOT ALLOW YOU TO INSTALL OR USE THE PRODUCTS.
1-ACCEPTANCE AND APPROVAL OF USER CONDITIONS
The Game Software, Editors, New Materials, and/or Additional Content are provided to you subject to your compliance with all the terms and conditions contained in this and other rules, policies, and procedures. Additionally, certain applications directly or indirectly linked to the Game Software, Editors, New Materials, or Additional Content may be subject to additional terms and conditions implemented by Yasin KÜÇÜK at various times. Your continued use of the Game Software, Editors, New Materials, or Additional Content after a change to this Agreement constitutes your acceptance of such changes.
2-LIMITED USE LICENSE
Subject to your compliance with the terms and conditions of the agreement, Yasin KÜÇÜK grants you a non-exclusive, non-transferable, limited, revocable license solely for your personal and non-commercial use to install, access, and use one (1) copy of the Game Software and/or (including all New Materials) Editors and/or Additional Content. All uses of Editors or all New Materials are for your personal and non-commercial use only, in connection with the applicable Game Software and/or Additional Content purchased by you. This Agreement also covers any patches, updates, and improvements you may acquire for any of the Products. Any reproduction or distribution, for any purpose, of the Game Software, Editors, New Materials, Additional Content, or related information or materials to any server or location is expressly prohibited unless otherwise stated in the Agreement. All rights not expressly granted under this Agreement are hereby retained by Yasin KÜÇÜK and, where applicable, its licensors.
Without the prior written approval of an authorized representative of Yasin KÜÇÜK, you may not cause or permit the sale, commercial distribution, or commercial use (including, without limitation, renting, licensing, sublicensing, leasing, broadcasting, uploading, downloading, transmitting) of any product, including all New Materials. This includes the distribution of any New Materials that are part of any copyright created by you or other users.
New Materials may only be distributed, at no charge (i.e., never on a commercial basis), to other authorized users who have official copies of such products for their personal and non-commercial use, and you may distribute them in compliance with all applicable laws and regulations.
3-NO OWNERSHIP RIGHTS
YOU ACKNOWLEDGE AND AGREE THAT YOU HAVE NO OWNERSHIP OR OTHER PROPERTY INTEREST IN THE GAME SOFTWARE, EDITORS, NEW MATERIALS, OR ADDITIONAL CONTENT, AND MORE IMPORTANTLY, ALL SUCH RIGHTS BELONG TO YASIN KÜÇÜK IN PERPETUITY, AND YOU HEREBY CONFIRM AND ACCEPT THAT THEY OPERATE IN FAVOR OF YASIN KÜÇÜK. Except as expressly licensed to you, all rights, titles, and interests in and to the Game Software, Editors, New Materials, and Additional Content, including all copyright, trademark, and intellectual property rights therein and thereto, and all copies thereof (including but not limited to all patches, updates, copies, derivative works, names, computer code, themes, objects, characters, character names, stories, dialogues, lines, locations, concepts, drawings, pictures, animations, sounds, music compositions, sound effects, and visual effects, texts, methods of operation, moral rights; any "mini-applications" in the Game Software, Editors, Additional Content, and any related documentation) are owned by or licensed to Yasin KÜÇÜK.
Any rights, titles, and interests in and to any New Materials you create and any rights, names, and shares therein are assigned to and will be the exclusive property of Yasin KÜÇÜK and/or Yasin KÜÇÜK's licensors. You agree not to assert, even if specified, any copyright or similar rights you may have in any New Material against Yasin KÜÇÜK or Yasin KÜÇÜK's affiliated companies, distributors, or licensors. Additionally, you permit other users to freely use all New Materials while using the Products.
Under the laws, by creating any New Materials, you automatically grant Yasin KÜÇÜK an irrevocable, perpetual, royalty-free sublicense to use, reproduce, modify, adapt, display, distribute, and otherwise exploit and/or edit the New Materials (or any part thereof) in any manner and for any purpose, including, but not limited to, all applicable copyright rights, as well as the right to sublicense such rights at the discretion of Yasin KÜÇÜK or its representatives.
The Products are protected by the copyright laws of the Republic of Turkey, international copyright treaties and conventions, and other laws. All rights are reserved. The Products may contain certain licensed materials, and Yasin KÜÇÜK and its licensors may enforce their rights in cases of violation of this Agreement.
This license does not grant you any title or ownership rights in the Game Software, Editors, New Materials, or Additional Content and should not be construed to suggest that you can sell or transfer any intellectual property related to the Game Software, Editors, New Materials, or Additional Content.
4-SALE OR TRANSFER PROHIBITED
Yasin KÜÇÜK does not recognize the transfer of the Game Software, Editors, New Materials, or Additional Content. Therefore, you may not give, sell, auction, purchase, bid on, trade, or otherwise transfer or offer to sell or transfer any rights, responsibilities, or obligations under this Agreement without the prior written permission of Yasin KÜÇÜK.
5-LICENSE CONDITIONS
You agree to use the Game Software, Editors, New Materials, or Additional Content, or any part thereof, in a manner that does not violate the rules of this Agreement and agree NOT TO:
(a) Commercially operate the Game Software, Editors, New Materials, or Additional Content, or any part thereof, in any place, including but not limited to cybercafes, computer game centers, or similar venues;
(b) Use or allow the use of the Game Software, Editors, New Materials, or Additional Content on more than one computer, game console, portable device, handheld device, or Personal Digital Assistant simultaneously;
(c) Use, allow the use, or offer the use of the Game Software, Editors, New Materials, or Additional Content on any network, in a multiplayer environment, in remote access environments, or in any other environment where it may be made available to other users for download;
(d) Sell, lease, rent, license, or distribute the Game Software, Editors, New Materials, or Additional Content, or any copies thereof;
(e) Apply reverse engineering, decompile, disassemble, obtain source code, modify, compile, copy, or create derivative works from the Game Software, Editors, or Additional Content (except for appropriate use of Editors and within the limits permitted by existing laws, excluding the situations specified in paragraph (i) below. In such cases, any modifications, adaptations, copies, improvements, etc., will be the property of Yasin KÜÇÜK and/or the product's licensors);
(f) Remove, disable, or circumvent any security protections, registration notices, or labels on the Game Software, Editors, New Materials, or Additional Content;
(g) Export the Game Software, Editors, New Materials, or Additional Content, or any copies thereof, or export adaptations that violate existing laws or regulations;
(h) Create data or applications that imitate data or functions in the Game Software, Editors, or Additional Content unless otherwise specified in paragraph (i) below;
(i) Not use the Editors to produce content such as: (A) creating any application files; (B) creating content that is defamatory, racist, obscene, insulting, violates the privacy or publicity of any third party, or defames individuals; (C) infringing trademarks, copyrights, or any third party's intellectual property; (D) using for any commercial purpose (whether based on pay-to-play, time-share, or other methods). Changes, adaptations, copies, improvements, etc., made in such cases will be the exclusive property of Yasin KÜÇÜK and/or the product's licensors;
(j) Guarantee and assume responsibility that any New Materials you send will not be discriminatory, racist, obscene, defamatory, inappropriate, illegal, or adversely affect the reputation and respect of Yasin KÜÇÜK's company. You guarantee and assume responsibility that the use or exploitation of the New Materials sent by you or published by Yasin KÜÇÜK will not violate the intellectual property rights of any person (whether legal or not), and in the event of any such situation, Yasin KÜÇÜK's company will not be held responsible.
In case of any violation of the terms of this Agreement, your right to use the Game Software, Editors, New Materials, or Additional Content obtained under this Agreement will be revoked without notice. Any such violation in this section constitutes a violation of this Agreement, current copyright laws, and other intellectual property laws and treaties, and is subject to legal and criminal sanctions.
6. WARRANTY TERMS; LIMITATION OF LIABILITY
By accepting, you agree to adhere to the security and usage instructions, as well as the user manual or other written documents accompanying the product.
Under the possibilities offered by applicable laws, you assume all risks of these products in terms of satisfactory quality, performance accuracy, and time spent entirely and completely. Within the limits of applicable laws, all game software, editors, new materials, and/or additional content similar materials are provided in their "current" and "as-is" conditions, without any warranties or guarantees, including but not limited to, all implied warranties of merchantability, satisfactory quality, fitness for a particular purpose, accuracy, uninterrupted use, and non-infringement. Without limiting the foregoing, we do not guarantee that (A) the game software, editors, new materials, and/or additional content will meet your requirements, (B) the game software, editors, new materials, and/or additional content will operate uninterrupted, timely, secure, or error-free, (C) the game software, editors, new materials, and/or additional content will be compatible with or run in conjunction with other software, or (D) the results obtained from the use of the game software, editors, new materials, and/or additional content will be effective, accurate, or reliable. No written or oral information, statement, or warranty provided by Yasin KÜÇÜK or its authorized representatives creates a warranty in this regard.
In the future, it is likely that the game software, editors, new materials, and/or additional content will become outdated, and Yasin KÜÇÜK does not guarantee the updating of these products. The conditions of non-acceptance of responsibility include but are not limited to damages or injuries arising from defects, deficiencies, interruptions, deletions, leaks, delays in operation or transmission, computer viruses, connection problems, theft, or destruction; unauthorized use and modification of game software, editors, new materials, and/or additional content; violation of contracts; unfair behavior; negligence; or similar actions. The use of game software, editors, new materials, and/or additional content, whether by download or through game software editors or related means, is entirely at your discretion, and the risks are entirely yours. Any damage or data loss on your computer system resulting from such use is entirely your responsibility.
Yasin KÜÇÜK makes no statement regarding the accuracy of the information contained in the game software, editors, new materials, additional content, information, and/or related graphic publications. The game software, editors, new materials, additional content, information, and related graphic publications that are part of the products may contain technical inaccuracies or typographical errors. You are deemed to have understood and accepted that temporary interruptions in game software, editors, new materials, or additional content are normal occurrences. Also, you acknowledge and accept that Yasin KÜÇÜK has no control over the supply of game software, editors, new materials, or additional content through third-party channels, and therefore, any delays or interruptions are entirely beyond the control of Yasin KÜÇÜK.
You acknowledge and agree that the resolution of any dispute with Yasin KÜÇÜK is to stop using the products. You acknowledge and agree that, in the event that the liability of applicable game software imposes such responsibility, Yasin KÜÇÜK, its affiliated companies, or authorized agents will not exceed the amount you paid. Yasin KÜÇÜK or its affiliated companies, regardless of whether Yasin KÜÇÜK has been informed of the possibility of such damages, will not assume responsibility for damages arising from the use, inability to use, or misuse of game software, editors, new materials, and/or additional content. Such damages include but are not limited to personal injury, property damage, loss of data or profit, property damage, computer failure, or malfunction, regardless of the form of action, whether based on the theory of liability, negligence, or other reasons.
In some states or jurisdictions where the denial or limitation of subsequent or incidental damages is prohibited, the liability of Yasin KÜÇÜK and affiliated parties is limited to the extent permitted by these laws.
7. INDEMNITY
Upon Yasin KÜÇÜK's request, you agree to exempt Yasin KÜÇÜK and its affiliates from any and all obligations, claims, losses, and expenses, including attorney's fees, arising from (a) your use or activity related to the products; (b) any breach of the Agreement by you; or (c) any claims arising from the infringement of copyright, trademark, trade secrets, confidentiality, or other intellectual property or third-party rights by any new content you provide through the provision of game software, editors, new materials, or additional content. Yasin KÜÇÜK reserves the right to defend and control any matter not covered by your indemnification, and you must cooperate with Yasin KÜÇÜK in applying existing defenses in such a situation.
8. EMAIL, MESSAGING, BLOGGING, AND CHAT
Yasin KÜÇÜK may offer options for email, messaging, blogging, or chat (collectively referred to as "COMMUNICATION SOFTWARE") directly or through a third-party provider through game software, editors, new materials, or additional content. Yasin KÜÇÜK is not responsible for communications made by other users through the Communication Software. We are not responsible for communications made by you through Communication Software. You understand and agree that your communication with Communication Software is public and that you have no privacy concerns with Communication Software. You understand and agree that personal information you share through Communication Software may be seen and used by others, and as a result, the information may be made publicly available. If you do not want your personal information to be public, we recommend that you do not share any personal information through Communication Software.
9. INTERNATIONAL USE
Although the Game Software, Editors, New Materials, and Additional Content are accessible worldwide, we make no representation that the use of the Game Software, Editors, New Materials, and Additional Content, or the content they contain, is appropriate or legally permissible outside of Turkey. Those who choose to access the Game Software, Editors, New Materials, and Additional Content from other locations do so on their own initiative and are responsible for compliance with local laws. Any offers or information regarding the Game Software in places where access is prohibited are void. Products cannot be exported or re-exported to (a) countries under U.S. embargo (or residents thereof), or (b) individuals or entities on the U.S. Treasury Department's Specially Designated Nationals list or the U.S. Commerce Department's Denied Persons or Entities List, among others.
10. TERMINATION AND DURATION OF TERMS
This Agreement will remain in full force and effect until terminated by either party. You understand and agree that no amount paid to Yasin KÜÇÜK will be refunded upon termination. It is within your discretion to terminate or end your use of the Game Software, Editors, New Materials, and Additional Content and this Agreement. Without prejudice to any other rights of Yasin KÜÇÜK, failure to comply with the terms and conditions of this Agreement will result in automatic termination. After termination, you must destroy all copies of the Game Software, Editors, New Materials, and Additional Content in your possession. The provisions in Sections 3, 4, 6, 7, 8, 10, 11, and 12 will not be affected by any termination of this Agreement.
11. GOVERNING LAW
If any provision of this Agreement is not implemented definitively, you agree that Yasin KÜÇÜK, at his option and without the necessity of any written agreement or other evidence or proof of damages being required, shall be entitled to seek injunctive and other equitable remedies, in addition to any other remedies available to him under applicable law, for any threatened or actual failure by you to perform or by you to comply with the terms of this Agreement.
12. MISCELLANEOUS
You acknowledge that Yasin KÜÇÜK collects and may collect data derived from your use of the Game and/or any product, including but not limited to information about your computer and IP address accessible during the operation of your operating system. Such data collection and storage of the above-mentioned data and gameplay are for the sole purpose of facilitating the existing functionality of the products, assisting Yasin KÜÇÜK in evaluating improvements based on the general course of his game and digital management purposes.
This Agreement represents the entire agreement between you and Yasin KÜÇÜK regarding the Game Software, Editors, New Materials, and/or Additional Content and supersedes all prior agreements, representations, warranties, or understandings between you and Yasin KÜÇÜK concerning the same subject matter. Yasin KÜÇÜK reserves the right to amend or modify this Agreement, in whole or in part, at any time, without any liability to Yasin KÜÇÜK, and this Agreement shall be binding on you without any affirmative expression of intent by Yasin KÜÇÜK.
If any part of this Agreement is determined to be invalid or unenforceable, such invalidity or unenforceability shall not affect the validity or enforceability of the remainder of the Agreement, which shall remain in full force and effect. The failure of Yasin KÜÇÜK to enforce or exercise any right under this Agreement shall not be deemed a waiver of that right. Yasin KÜÇÜK may assign this Agreement, in whole or in part, at any time. However, you may not assign, transfer, or sublicense any of your rights or obligations under this Agreement without the prior written consent of Yasin KÜÇÜK.
The performance of this Agreement by Yasin KÜÇÜK is subject to existing laws and legal processes, and anything not included in this Agreement is subject to the right of Yasin KÜÇÜK to comply with requests and requirements for disclosure by governmental and regulatory authorities, to comply with any subpoenas or court orders, and to enforce or defend his rights and properties. In addition to any relief afforded by statute, the failure of Yasin KÜÇÜK to comply with any term of this Agreement or the failure to exercise any right under this Agreement shall not constitute a waiver of such right or term. Yasin KÜÇÜK shall not be liable for failure to deliver or for delays in delivery arising from circumstances beyond his reasonable control, including but not limited to acts of God, war, terrorism, fires, denial-of-service attacks, internet interruptions, accidents, adverse weather conditions, inadequacies in secure shipments, government activities or regulations, or other events or causes beyond his reasonable control.
Nothing in this Agreement gives any third party any benefit or any right to enforce any term of this Agreement. The 1999 Contracts (Rights of Third Parties) Act is expressly excluded from application.
The parties agree that all correspondence regarding this Agreement will be conducted in the English language. This Agreement will be analyzed under the laws of England and Wales, and you consent to the exclusive jurisdiction of the English courts.

Except as expressly licensed to you, all rights, titles, and interests in and to the Game Software, Editors, New Materials, and Additional Content, including all copyright, trademark, and intellectual property rights therein and thereto, and all copies thereof (including but not limited to all patches, updates, copies, derivative works, names, computer code, themes, objects, characters, character names, stories, dialogues, lines, locations, concepts, drawings, pictures, animations, sounds, music compositions, sound effects, and visual effects, texts, methods of operation, moral rights; any "mini-applications" in the Game Software, Editors, Additional Content, and any related documentation) are owned by or licensed to Yasin KÜÇÜK.
Any rights, titles, and interests in and to any New Materials you create and any rights, names, and shares therein are assigned to and will be the exclusive property of Yasin KÜÇÜK and/or Yasin KÜÇÜK's licensors. You agree not to assert, even if specified, any copyright or similar rights you may have in any New Material against Yasin KÜÇÜK or Yasin KÜÇÜK's affiliated companies, distributors, or licensors. Additionally, you permit other users to freely use all New Materials while using the Products.
Under the laws, by creating any New Materials, you automatically grant Yasin KÜÇÜK an irrevocable, perpetual, royalty-free sublicense to use, reproduce, modify, adapt, display, distribute, and otherwise exploit and/or edit the New Materials (or any part thereof) in any manner and for any purpose, including, but not limited to, all applicable copyright rights, as well as the right to sublicense such rights at the discretion of Yasin KÜÇÜK or its representatives.
The Products are protected by the copyright laws of the Republic of Turkey, international copyright treaties and conventions, and other laws. All rights are reserved. The Products may contain certain licensed materials, and Yasin KÜÇÜK and its licensors may enforce their rights in cases of violation of this Agreement.
This license does not grant you any title or ownership rights in the Game Software, Editors, New Materials, or Additional Content and should not be construed to suggest that you can sell or transfer any intellectual property related to the Game Software, Editors, New Materials, or Additional Content.
4-SALE OR TRANSFER PROHIBITED
Yasin KÜÇÜK does not recognize the transfer of the Game Software, Editors, New Materials, or Additional Content. Therefore, you may not give, sell, auction, purchase, bid on, trade, or otherwise transfer or offer to sell or transfer any rights, responsibilities, or obligations under this Agreement without the prior written permission of Yasin KÜÇÜK.
5-LICENSE CONDITIONS
You agree to use the Game Software, Editors, New Materials, or Additional Content, or any part thereof, in a manner that does not violate the rules of this Agreement and agree NOT TO:
(a) Commercially operate the Game Software, Editors, New Materials, or Additional Content, or any part thereof, in any place, including but not limited to cybercafes, computer game centers, or similar venues;
(b) Use or allow the use of the Game Software, Editors, New Materials, or Additional Content on more than one computer, game console, portable device, handheld device, or Personal Digital Assistant simultaneously;
(c) Use, allow the use, or offer the use of the Game Software, Editors, New Materials, or Additional Content on any network, in a multiplayer environment, in remote access environments, or in any other environment where it may be made available to other users for download;
(d) Sell, lease, rent, license, or distribute the Game Software, Editors, New Materials, or Additional Content, or any copies thereof;
(e) Apply reverse engineering, decompile, disassemble, obtain source code, modify, compile, copy, or create derivative works from the Game Software, Editors, or Additional Content (except for appropriate use of Editors and within the limits permitted by existing laws, excluding the situations specified in paragraph (i) below. In such cases, any modifications, adaptations, copies, improvements, etc., will be the property of Yasin KÜÇÜK and/or the product's licensors);
(f) Remove, disable, or circumvent any security protections, registration notices, or labels on the Game Software, Editors, New Materials, or Additional Content;
(g) Export the Game Software, Editors, New Materials, or Additional Content, or any copies thereof, or export adaptations that violate existing laws or regulations;
(h) Create data or applications that imitate data or functions in the Game Software, Editors, or Additional Content unless otherwise specified in paragraph (i) below;
(i) Not use the Editors to produce content such as: (A) creating any application files; (B) creating content that is defamatory, racist, obscene, insulting, violates the privacy or publicity of any third party, or defames individuals; (C) infringing trademarks, copyrights, or any third party's intellectual property; (D) using for any commercial purpose (whether based on pay-to-play, time-share, or other methods). Changes, adaptations, copies, improvements, etc., made in such cases will be the exclusive property of Yasin KÜÇÜK and/or the product's licensors;
(j) Guarantee and assume responsibility that any New Materials you send will not be discriminatory, racist, obscene, defamatory, inappropriate, illegal, or adversely affect the reputation and respect of Yasin KÜÇÜK's company. You guarantee and assume responsibility that the use or exploitation of the New Materials sent by you or published by Yasin KÜÇÜK will not violate the intellectual property rights of any person (whether legal or not), and in the event of any such situation, Yasin KÜÇÜK's company will not be held responsible.
In case of any violation of the terms of this Agreement, your right to use the Game Software, Editors, New Materials, or Additional Content obtained under this Agreement will be revoked without notice. Any such violation in this section constitutes a violation of this Agreement, current copyright laws, and other intellectual property laws and treaties, and is subject to legal and criminal sanctions.
6. WARRANTY TERMS; LIMITATION OF LIABILITY
By accepting, you agree to adhere to the security and usage instructions, as well as the user manual or other written documents accompanying the product.
Under the possibilities offered by applicable laws, you assume all risks of these products in terms of satisfactory quality, performance accuracy, and time spent entirely and completely. Within the limits of applicable laws, all game software, editors, new materials, and/or additional content similar materials are provided in their "current" and "as-is" conditions, without any warranties or guarantees, including but not limited to, all implied warranties of merchantability, satisfactory quality, fitness for a particular purpose, accuracy, uninterrupted use, and non-infringement. Without limiting the foregoing, we do not guarantee that (A) the game software, editors, new materials, and/or additional content will meet your requirements, (B) the game software, editors, new materials, and/or additional content will operate uninterrupted, timely, secure, or error-free, (C) the game software, editors, new materials, and/or additional content will be compatible with or run in conjunction with other software, or (D) the results obtained from the use of the game software, editors, new materials, and/or additional content will be effective, accurate, or reliable. No written or oral information, statement, or warranty provided by Yasin KÜÇÜK or its authorized representatives creates a warranty in this regard.
In the future, it is likely that the game software, editors, new materials, and/or additional content will become outdated, and Yasin KÜÇÜK does not guarantee the updating of these products. The conditions of non-acceptance of responsibility include but are not limited to damages or injuries arising from defects, deficiencies, interruptions, deletions, leaks, delays in operation or transmission, computer viruses, connection problems, theft, or destruction; unauthorized use and modification of game software, editors, new materials, and/or additional content; violation of contracts; unfair behavior; negligence; or similar actions. The use of game software, editors, new materials, and/or additional content, whether by download or through game software editors or related means, is entirely at your discretion, and the risks are entirely yours. Any damage or data loss on your computer system resulting from such use is entirely your responsibility.
Yasin KÜÇÜK makes no statement regarding the accuracy of the information contained in the game software, editors, new materials, additional content, information, and/or related graphic publications. The game software, editors, new materials, additional content, information, and related graphic publications that are part of the products may contain technical inaccuracies or typographical errors. You are deemed to have understood and accepted that temporary interruptions in game software, editors, new materials, or additional content are normal occurrences. Also, you acknowledge and accept that Yasin KÜÇÜK has no control over the supply of game software, editors, new materials, or additional content through third-party channels, and therefore, any delays or interruptions are entirely beyond the control of Yasin KÜÇÜK.
You acknowledge and agree that the resolution of any dispute with Yasin KÜÇÜK is to stop using the products. You acknowledge and agree that, in the event that the liability of applicable game software imposes such responsibility, Yasin KÜÇÜK, its affiliated companies, or authorized agents will not exceed the amount you paid. Yasin KÜÇÜK or its affiliated companies, regardless of whether Yasin KÜÇÜK has been informed of the possibility of such damages, will not assume responsibility for damages arising from the use, inability to use, or misuse of game software, editors, new materials, and/or additional content. Such damages include but are not limited to personal injury, property damage, loss of data or profit, property damage, computer failure, or malfunction, regardless of the form of action, whether based on the theory of liability, negligence, or other reasons.
In some states or jurisdictions where the denial or limitation of subsequent or incidental damages is prohibited, the liability of Yasin KÜÇÜK and affiliated parties is limited to the extent permitted by these laws.
7. INDEMNITY
Upon Yasin KÜÇÜK's request, you agree to exempt Yasin KÜÇÜK and its affiliates from any and all obligations, claims, losses, and expenses, including attorney's fees, arising from (a) your use or activity related to the products; (b) any breach of the Agreement by you; or (c) any claims arising from the infringement of copyright, trademark, trade secrets, confidentiality, or other intellectual property or third-party rights by any new content you provide through the provision of game software, editors, new materials, or additional content. Yasin KÜÇÜK reserves the right to defend and control any matter not covered by your indemnification, and you must cooperate with Yasin KÜÇÜK in applying existing defenses in such a situation.
8. EMAIL, MESSAGING, BLOGGING, AND CHAT
Yasin KÜÇÜK may offer options for email, messaging, blogging, or chat (collectively referred to as "COMMUNICATION SOFTWARE") directly or through a third-party provider through game software, editors, new materials, or additional content. Yasin KÜÇÜK is not responsible for communications made by other users through the Communication Software. We are not responsible for communications made by you through Communication Software. You understand and agree that your communication with Communication Software is public and that you have no privacy concerns with Communication Software. You understand and agree that personal information you share through Communication Software may be seen and used by others, and as a result, the information may be made publicly available. If you do not want your personal information to be public, we recommend that you do not share any personal information through Communication Software.
9. INTERNATIONAL USE
Although the Game Software, Editors, New Materials, and Additional Content are accessible worldwide, we make no representation that the use of the Game Software, Editors, New Materials, and Additional Content, or the content they contain, is appropriate or legally permissible outside of Turkey. Those who choose to access the Game Software, Editors, New Materials, and Additional Content from other locations do so on their own initiative and are responsible for compliance with local laws. Any offers or information regarding the Game Software in places where access is prohibited are void. Products cannot be exported or re-exported to (a) countries under U.S. embargo (or residents thereof), or (b) individuals or entities on the U.S. Treasury Department's Specially Designated Nationals list or the U.S. Commerce Department's Denied Persons or Entities List, among others.
10. TERMINATION AND DURATION OF TERMS
This Agreement will remain in full force and effect until terminated by either party. You understand and agree that no amount paid to Yasin KÜÇÜK will be refunded upon termination. It is within your discretion to terminate or end your use of the Game Software, Editors, New Materials, and Additional Content and this Agreement. Without prejudice to any other rights of Yasin KÜÇÜK, failure to comply with the terms and conditions of this Agreement will result in automatic termination. After termination, you must destroy all copies of the Game Software, Editors, New Materials, and Additional Content in your possession. The provisions in Sections 3, 4, 6, 7, 8, 10, 11, and 12 will not be affected by any termination of this Agreement.
11. GOVERNING LAW
If any provision of this Agreement is not implemented definitively, you agree that Yasin KÜÇÜK, at his option and without the necessity of any written agreement or other evidence or proof of damages being required, shall be entitled to seek injunctive and other equitable remedies, in addition to any other remedies available to him under applicable law, for any threatened or actual failure by you to perform or by you to comply with the terms of this Agreement.
12. MISCELLANEOUS
You acknowledge that Yasin KÜÇÜK collects and may collect data derived from your use of the Game and/or any product, including but not limited to information about your computer and IP address accessible during the operation of your operating system. Such data collection and storage of the above-mentioned data and gameplay are for the sole purpose of facilitating the existing functionality of the products, assisting Yasin KÜÇÜK in evaluating improvements based on the general course of his game and digital management purposes.
This Agreement represents the entire agreement between you and Yasin KÜÇÜK regarding the Game Software, Editors, New Materials, and/or Additional Content and supersedes all prior agreements, representations, warranties, or understandings between you and Yasin KÜÇÜK concerning the same subject matter. Yasin KÜÇÜK reserves the right to amend or modify this Agreement, in whole or in part, at any time, without any liability to Yasin KÜÇÜK, and this Agreement shall be binding on you without any affirmative expression of intent by Yasin KÜÇÜK.
If any part of this Agreement is determined to be invalid or unenforceable, such invalidity or unenforceability shall not affect the validity or enforceability of the remainder of the Agreement, which shall remain in full force and effect. The failure of Yasin KÜÇÜK to enforce or exercise any right under this Agreement shall not be deemed a waiver of that right. Yasin KÜÇÜK may assign this Agreement, in whole or in part, at any time. However, you may not assign, transfer, or sublicense any of your rights or obligations under this Agreement without the prior written consent of Yasin KÜÇÜK.
The performance of this Agreement by Yasin KÜÇÜK is subject to existing laws and legal processes, and anything not included in this Agreement is subject to the right of Yasin KÜÇÜK to comply with requests and requirements for disclosure by governmental and regulatory authorities, to comply with any subpoenas or court orders, and to enforce or defend his rights and properties. In addition to any relief afforded by statute, the failure of Yasin KÜÇÜK to comply with any term of this Agreement or the failure to exercise any right under this Agreement shall not constitute a waiver of such right or term. Yasin KÜÇÜK shall not be liable for failure to deliver or for delays in delivery arising from circumstances beyond his reasonable control, including but not limited to acts of God, war, terrorism, fires, denial-of-service attacks, internet interruptions, accidents, adverse weather conditions, inadequacies in secure shipments, government activities or regulations, or other events or causes beyond his reasonable control.
Nothing in this Agreement gives any third party any benefit or any right to enforce any term of this Agreement. The 1999 Contracts (Rights of Third Parties) Act is expressly excluded from application.
The parties agree that all correspondence regarding this Agreement will be conducted in the English language. This Agreement will be analyzed under the laws of England and Wales, and you consent to the exclusive jurisdiction of the English courts.
