END USER LICENSE AGREEMENT (EULA)
1. OVERVIEW
This End User License Agreement ("Agreement") is made and entered into by and between FiftyEight Studios ("Licensor") and the individual who downloads or utilizes the game ContractVille ("Game") ("User"). This document delineates the User's entitlements and limitations regarding the utilization of the Game.
2. LICENSE GRANT
FiftyEight Studios ("Licensor") provides the User with a restricted, non-transferable, non-exclusive right to download and utilize the Game for personal and non-commercial use, in accordance with the stipulations of this Agreement.
3. RESTRICTIONS ON LICENSE
The individual is prohibited from:
- Distribute, lease, sublicense, or convey the Game.
- Alter, produce derivative creations from, reverse engineer, or decompile the Game.
- Utilize the Game in any illegal manner or in breach of this Agreement.
4. INTELLECTUAL PROPERTY RIGHTS
The Game and all associated intellectual property rights are held by FiftyEight Studios and/or its licensors. This Agreement does not convey any intellectual property rights to the User.
5. CONTENT CREATED BY USERS
The Game may permit individuals to create, upload, or share content ("User-Generated Content"). By submitting any User-Generated Content, the User provides FiftyEight Studios with a non-exclusive, worldwide, royalty-free, perpetual license to utilize, distribute, and showcase such content within the Game and associated promotional materials. The User guarantees that any content created by them does not violate any rights held by third parties.
6. GATHERING INFORMATION
The Licensor reserves the right to gather information concerning the User's actions within the Game, which may encompass gameplay statistics, achievements, and other pertinent details. Furthermore, the Licensor gathers information pertaining to error reports and various technical challenges that could occur while utilizing the Game. This information is utilized to enhance the gaming experience, address issues, and for other reasons outlined in the FiftyEight Studios' Privacy Policy.
7. CONFIDENTIALITY
The data gathered from the User's engagement with the Game, encompassing details about gameplay actions and error notifications, will be handled in line with FiftyEight Studios' Privacy Policy. The Privacy Policy is available for review at [https://www.fiftyeightstudios.com/privacy-policy].
8. SOFTWARE FROM EXTERNAL SOURCES
The Game might incorporate third-party software or services, each subject to its own terms and conditions. By utilizing the Game, the User consents to adhere to the terms set forth by any third-party software or services incorporated within the Game.
9. AGREEMENTS AND REMUNERATION
Some aspects or elements within the Game may necessitate a fee or a subscription. The User consents to cover all relevant charges linked to these features. All payments are final and cannot be refunded, except as mandated by relevant regulations.
10. LIMITATION OF WARRANTIES
FiftyEight Studios denies any and all warranties, whether expressed or implied, including but not limited to implied warranties regarding merchantability, suitability for a specific purpose, and non-infringement. The User accepts full responsibility for choosing and utilizing the Game to attain the desired outcomes.
11. COMPENSATION FOR DAMAGES
The User consents to protect and defend FiftyEight Studios and its affiliates against any claims, damages, losses, or expenses that may result from the User's engagement with the Game, which includes, but is not limited to, breaches of this Agreement or violations of any third-party rights.
12. MODIFICATIONS TO THIS AGREEMENT OR TO THE PRODUCT
FiftyEight Studios retains the authority to amend this Agreement or the Game at any moment. Should any modifications occur, FiftyEight Studios will inform the User through suitable channels, including posting a notification on its website or within the Game. The User's ongoing engagement with the Game after any modifications signifies agreement to the updated terms.
13. APPLICABLE LAW AND JURISDICTION
This Agreement is governed by the laws of Türkiye, without reference to its choice of law provisions. Each party hereby irrevocably consents to the exclusive jurisdiction of İstanbul Commercial Courts and İstanbul Mediation Offices.
14. RESTRICTIONS ON EXPORTS
The User acknowledges the obligation to adhere to all relevant export and import laws and regulations. The Game cannot be sent or transferred to any nations or individuals that are restricted by relevant regulations.
15. SEVERABILITY
If any part of this Agreement is determined to be invalid or unenforceable by a court with proper authority, the other parts will continue to be in full force and effect.
The Game is offered in its current state and as it is accessible. FiftyEight Studios makes no guarantees that the Game will be free from errors, interruptions, or security issues. FiftyEight Studios will not be responsible for any damages resulting from the use or inability to use the Game.
16. GENERAL PROVISIONS
This Agreement represents the complete understanding between the parties concerning the use of the Game and replaces any previous agreements or understandings, whether documented or verbal, pertaining to its subject matter.
