END USER LICENCE AGREEMENT AND PRIVACY POLICY

PLEASE READ THIS END USER LICENCE AGREEMENT and the PRIVACY POLICY CAREFULLY. This End User License Agreement (“EULA”) governs your use of the videogame, application, software, their associated upgrades, patches, and updates and related services (the “Product”) currently provided or which will be provided by GeamGames.
This EULA sets out the basis on which GeamGames makes the Products available to you (“User” or ”You”) and on which You may use them. GeamGames Privacy Policy (« Privacy Policy ») forms an integral part of this EULA. By installing or using the Product, You agree to accept and to be bound by (1) this EULA and (2) the Privacy Policy at all time. If You do not agree with one of these, please do not install or use the Product.
GeamGames reserves the right to change, modify, add or delete articles in this EULA and Privacy Policy at any time, in accordance with the procedures described below in Section 6 (EULA).

END USER LICENCE AGREEMENT
1. GRANT OF LICENSE.

1.1 GeamGames (or its licensors) grants You a non-exclusive, non-transferable, non-sublicensed, non-commercial and personal license to install and/or use the Product (in whole or in part) and any Product (the “License”), for such time until either You or GeamGames terminates this EULA. You must in no event use, nor allow others to use,the Product or this License for commercial purposes without obtaining a licence to do so from GeamGames. Updates, upgrades, patches and modifications may be necessary in order to be able to continue to use the Product on certain hardware.
1.2 You shall not, directly or indirectly (i) sell, rent out, lease, license, distribute, market, exploit the Product or any of its parts commercially, (ii) reverse engineer, decompile, disassemble, adapt, reproduce, or create derivate works of this Product in whole or in part; (iii) create, use and/or distribute “auto”, “trainer”, “script” or “macro” computer programs or other “cheat” or “hack” programs or software applications for this Product (whether in an online multiplayer game or in a single player game over the internet or in local area network); (iv) remove, alter, disable or circumvent any copyright and trademark indications or other authorship and origin information, notices or labels contained on or within this Product and (v) export or re-export this Product or any copy of adaptation in violation of any applicable laws or regulations.
1.3 While using the Product, You agree to comply will all applicable laws, rules and regulations. You also agree to comply with certain rules of conduct that govern Your use of the Product (“Rules of Conduct”), which are not meant to be exhaustive and can be modified at any time by GeamGames. In all cases, You may only use the Product according to anticipated use of the Product.
For example purposes, and without limiting GeamGames rights to take action against You, You may not:
a. create, use, share and/or publish by any means in relation to the Product any material (text, words, images, sounds, videos, etc.) which would breach of a duty of confidentiality, infringe any intellectual property right or an individual’s right to privacy or which would incite the committing of an unlawful act (in particular, piracy, cracking or circulation of counterfeit software);

b. modify, distort, block, abnormally burden, disrupt, slow down and/or hinder the normal functioning of all or part of the Product, or their accessibility to other users, or the functioning of the partner networks of the Product, or attempt to do any of the above;

c. transmit or propagate any virus, trojan horse, worm, bomb, corrupted file and/or similar destructive device or corrupted data in relation to the Product, and/or organise, participate in or be involved in any way in an attack on GeamGames servers and/or the Product and/or those of its service providers and partners;

d. create, supply or use alternative methods of using the Products, for example server emulators;

e. spamming chat, whether for personal or commercial purposes, by disrupting the flow of conversation with repeated postings of a similar nature;

f. transmitting or communicating any material or content which, in the sole and exclusive discretion of GeamGames, is believed or deemed offensive, including, but not limited to, language that is harmful, threatening, unlawful, abusive, harassing, defamatory, disparaging, obscene, sexually explicit, or racially, ethnically, or otherwise objectionable;

g. harassing or threatening any other users in the Product;

h. make inappropriate use of the help service or the claim buttons or send untruthful reports to members of GeamGames personnel;

i. falsely claim to be an employee or representative of GeamGames or its partners and/or agents;

j. falsely claim an endorsement in connection with the Product or with GeamGames.

2. OWNERSHIP.
All title, ownership rights and intellectual property rights in and to the Product (including, without limitation, all text, graphics, music or sounds, all messages or items of information, fictional characters, names, themes, objects, scenery, costumes, effects, dialogues, slogans, places, characters, diagrams, concepts, choreographies, videos, audio-visual effects, domain names and any other elements which are part of the Product, individually or in combination) and any and all copies thereof are owned by GeamGames or its licensors. The Product is protected by national and international laws, copyright treaties and conventions and other laws. This Product may contain certain licensed materials and, in that event, GeamGames licensors may protect their rights in the event of any violation of this Agreement. Any reproduction or representation of these licensed materials in any way and for any reason is prohibited without GeamGames prior permission and, if applicable, GeamGames licensors’ and representatives’. Except as expressly set forth in this EULA, all rights not granted hereunder to You are expressly reserved by GeamGames.
This License confers no title or ownership in the Product and should not be construed as a sale of any rights in the Product.
3. ACCESS TO AND USE OF THE PRODUCT
3.1 To access some features of the Product You may have to create an Account within the Product. (For example, but not limited to the use and view of the In-game Leaderboards) For this purpose GeamGames uses tools from Microsoft Azure PlayFab. More information on this can be found in the privacy policy.
3.2 Information such as, but not limited to, the in-game level, progress and settings are stored locally on your device in so-called SaveGames and are not transferred to GeamGames. GeamGames cannot be held responsible for any loss of product-related game data.
3.3 We want to emphasize that GeamGames is not responsible for any damage to your device, including but not limited to, hardware, software, or any other components, that may occur during the use of Product. This includes, but is not limited to, potential damage resulting from changes in graphic settings, modifications, or updates made to your device.
The user acknowledges and agrees that they use the Product at their own risk. We recommend exercising caution and ensuring that your device meets the necessary requirements and specifications outlined in our system requirements documentation.
4. Disclaimers and Limitation of Liability
The Product includes the Unreal® Engine code and other code, materials, and information (the “Epic Materials”) from Epic Games, Inc. (“Epic”). All Epic Materials are provided on an “as is” and “as available” basis, “with all faults” and without warranty of any kind. GeamGames, Epic, and Epic’s affiliates disclaim all warranties, conditions, common law duties, and representations (express, implied, oral, and written) with respect to the Epic Materials, including without limitation all express, implied, and statutory warranties and conditions of any kind, such as title, non-interference with your enjoyment, authority, non-infringement, merchantability, fitness or suitability for any purpose (whether or not Epic knows or has reason to know of any such purpose), system integration, accuracy or completeness, results, reasonable care, workmanlike effort, lack of negligence, and lack of viruses, whether alleged to arise under law, by reason of custom or usage in the trade, or by course of dealing. Without limiting the generality of the foregoing, GeamGames, Epic, and Epic’s affiliates make no warranty that (1) any of the Epic Materials will operate properly, including as integrated in the Product, (2) that the Epic Materials will meet your requirements, (3) that the operation of the Epic Materials will be uninterrupted, bug free, or error free in any or all circumstances, (4) that any defects in the Epic Materials can or will be corrected, (5) that the Epic Materials are or will be in compliance with a platform manufacturer’s rules or requirements, or (6) that a platform manufacturer has approved or will approve this Product, or will not revoke approval of this Product for any or no reason. Any warranty against infringement that may be provided in Section 2-312 of the Uniform Commercial Code or in any other comparable statute is expressly disclaimed by GeamGames and Epic. GeamGames, Epic, and Epic’s affiliates do not guarantee continuous, error-free, virus-free, or secure operation of or access to the Epic Materials. This paragraph will apply to the maximum extent permitted by applicable law.
To the maximum extent permitted by applicable law, neither GeamGames, Epic, Epic’s licensors, nor its or their affiliates, nor any of GeamGames or Epic’s service providers, shall be liable in any way for loss or damage of any kind resulting from the use or inability to use the Epic Materials or otherwise in connection with this Agreement, including but not limited to loss of goodwill, work stoppage, computer failure, or malfunction, or any and all other commercial damages or losses. In no event will GeamGames, Epic, Epic’s licensors, nor its or their affiliates, nor any of GeamGames or Epic’s service providers be liable for any loss of profits or any indirect, incidental, consequential, special, punitive, or exemplary damages, or any other damages arising out of or in connection with this Agreement or the Epic Materials, or the delay or inability to use or lack of functionality of the Epic Materials, even in the event of GeamGames, Epic’s, or Epic’s affiliates’ fault, tort (including negligence), strict liability, indemnity, product liability, breach of contract, breach of warranty, or otherwise and even if GeamGames, Epic or Epic’s affiliates have been advised of the possibility of such damages. These limitations and exclusions regarding damages apply even if any remedy fails to provide adequate compensation.
Because some states or jurisdictions do not allow the exclusion or the limitation of liability for consequential or incidental damages, in such states or jurisdictions, the liability of GeamGames, Epic, Epic’s licensors, its and their affiliates, and any of GeamGames or Epic’s service providers shall be limited to the full extent permitted by law.
5. TERMINATION.
The EULA is effective from the earlier of the date You purchase, download or use the Product, until terminated according to its terms. You and GeamGames (or its licensors) may terminate this EULA, at any time, for any reason. Termination by GeamGames will be effective upon (a) notice to You or (b) termination of Your GeamGames Account (if any) or (c) at the time of GeamGames decision to discontinue offering and/or supporting the Product. This EULA will terminate automatically if You fail to comply with any of the terms and conditions of this EULA. Upon termination for any reason, You must immediately uninstall the Product and destroy all copies of the Product in Your possession.
6. CHANGES TO THIS EULA OR TO THE PRODUCT.
GeamGames reserves the right, in its sole and absolute discretion, to revise, update, change, modify, add to, supplement, or delete certain terms of this EULA for security, legal, best practice or regulatory reasons. Such changes will be effective with or, as applicable, without prior notice to You. You can review the most current version of this EULA by clicking on the “EULA” link located on the Product.
You are responsible for checking this EULA periodically for changes. If any future changes to this EULA are unacceptable to You or cause You to no longer be in agreement or compliance with this EULA, You may terminate this EULA in accordance with Section 5 and must immediately uninstall the Product and destroy all copies of the Product. Your continued use of the Product following any revision to this EULA constitutes Your complete and irrevocable acceptance of any and all such changes.
GeamGames may modify the Product for any reason or without any specific reason, at any time and at its entire discretion, in particular for technical reasons such as updates, maintenance operations and/or resets to improve and/or optimize the Product. You agree that the Product may install or download the modifications automatically. You agree that GeamGames may stop to support previous versions of the Product upon availability of an updated version. GeamGames channel partners and associated service providers shall have no obligation to furnish any maintenance or customer support with respect to the Product. GeamGames also reserves the right to amend the Rules of Conduct set out in Section 1 to place limits on the use of the Product.
THIS EULA IS APPLICABLE ONLY TO THE EXTENT AUTHORISED BY LAW.


PRIVACY POLICY

At GeamGames, we strive to create unique gaming experiences with our products. In order to enable you to use our products, we collect personal data from you. To understand how we utilize this data and to be aware of your rights, please read the following sections.
1. What is Personal Data?
"Personal Data" (or "Data") refers to any information through which you can be identified, including:
-Directly, such as your name, email address, and phone number.
-Indirectly, such as your username, IP address, cookie identifier, or game-related data.
For detailed information on the data collected by GeamGames, please refer to Section 2, "Under what circumstances does GeamGames collect your data and for what purpose?"
2. Under what circumstances does GeamGames collect your data and for what purpose?
We collect your data at the following instances:
a) Creating a GeamGames Account within the Product:
-We collect your username, password, email address, and country. Certain data, such as your username, may be publicly displayed, for instance, next to your achieved score or lap time, for other players to see.
In connection with your Account, you may receive emails from GeamGames or Microsoft Azure PlayFab (for example, if you forget your password and wish to reset it).
b) Using the Product on Your Device (e.g., PC):
We collect, for example:
-Your gameplay data to enhance your gaming experience and the security of our services, such as achieved lap times, scores, or playtime. This data may also be made visible to other players on leaderboards.
-Your connection and navigation data to enable the functioning and security of our services, such as every API call, including actions like logging in, retrieving leaderboards, or to send lap times.
c) Contacting Us via Email:
If you contact us by email, the data you provide will be stored by us for six months to process the request and address follow-up questions. We do not share this data without your consent.
4. How long does GeamGames store your personal data?
We retain your data only as long as necessary for the operations for which it was collected, unless the law prescribes a different retention period. For example, data associated with your user account is stored until its closure. Prolonged retention may occur if you violate the terms of service mentioned in the next section, requiring an extended data retention for sanctions.
5. The following section is closely related to your data and is intended to ensure fair use of your account and our services:
-The following is a non-exhaustive list of unacceptable behaviors that may lead to investigations by our staff and sanctions, such as, but not limited to, the banning of your account, deletion of your account, or resetting of your in-game progress or scores.
a. Creating a user account with false registration data (email address).
b. Creating or using an inappropriate username. This can lead to the deletion of your account or renaming to a generic name. This includes, in particular, the use of names:
-Containing obscenities, sexual innuendos, or elements of hate speech, or implicitly accepting terrorism, fascism, or child abuse; or
-That are in any way religious or political or tend to provoke controversy or division.
c. Fraudulently impersonating another user or one of our representatives. This includes, for example:
-Creating a user account that is very similar to an already existing user account, with the clear intention of pretending to be that other user without permission.
-Leaving comments or creating a user account that gives other users the impression that they come from our representative or someone with similar powers.
d. Using or distributing "auto" or "macro" computer programs, especially the use and/or distribution of cheats, hacks, bots, scripts, training programs, or user software.
e. Any other type of manipulation that gives a user (and/or fellow player(s)) an unfair advantage or affects the gaming experience of other users.
f. Exploiting glitches or bugs that give an unfair advantage over other users or threaten the general balance or economy of the service.
6. With whom does GeamGames share your personal data?
We may share your data with:
-Microsoft Azure PlayFab, as their services are used for creating and managing accounts. For more information, you can refer to Section 3.3 on this webpage: https://playfab.com/terms/
-Administrative and judicial authorities to verify the proper use of GeamGames data or for responding to a request for information, adhering to legally provided conditions. GeamGames always reviews the legal basis of information requests. In these cases, your data may be transmitted to countries outside the European Union that ensure an equivalent level of protection. When transmitting to other countries, the protection of your data is ensured, in particular, through the use of standard contractual clauses approved by the European Commission.
7. What rights do you have, and how can you exercise them?
-Receive a copy of your data – "Access and Data Portability": You can request a copy of the data associated with your account at any time, such as to consult, use, or transmit it to a service provider. If you have been sanctioned on our services, we cannot provide information about the data associated with your sanction to maintain our ability to identify or combat such behaviors.

-Correct data – "Rectification": You have the right to correct your data if it is inaccurate or incomplete (e.g., changing your delivery address).
-Give or withdraw your consent – "Objection and Withdrawal": You can withdraw your consent at any time or refuse to receive newsletters or promotional emails, personalize advertisements, or exchange your data with our service providers (except subsidiaries and technical service providers).

-Delete your account – "Right to be Forgotten": You can request the closure of your user account, and the associated data will be deleted. If you have been sanctioned on our services, we cannot delete the data associated with your sanction to maintain the sanction.
-Restrict the use of your data – "Restriction of Processing": You also have the right to request that your data is no longer used or deleted until your request is processed.

If you believe that your rights have not been respected after contacting us, you have the option to lodge a complaint with the supervisory authority of your country.
