End-User License Agreement (EULA) of JustScroll
IMPORTANT - Please read this license agreement in its entirety before installing and/or using this product.
If you use, install, copy or download this product, you agree to be bound by the terms of this license agreement. If you do not agree to the terms of this license agreement, please do not use, install, copy or download this product.
1. Definitions
In this EULA the expressions below shall have the meaning assigned to them in this clause, unless the context requires otherwise:
1.1 “Producer” refers to the legal owner and distributor of this product.
1.2 “Documentation” refers to information provided by the Producer about this product available on the website of the product and/or made publicly available through other means.
1.3 “Use” refers to using, installing, copying or downloading this product.
1.4 “You” refers to you, the ultimate user of the product or the authorized representative of the ultimate user of product.
2. Legal Agreement
2.1 This EULA is a legal agreement between You and the Producer, which governs your use of the product.
2.2 As long as you are fully in compliance with this EULA, the Producer grants you the non-exclusive limited right and license to Use the product on any machine that is used primarily by You.
2.3 The product is licensed, not sold. The Producer is and remains the owner of any intellectual property regarding the product, the purchase of this license or your Use of the product shall not grant you any ownership of the product.
2.4 This EULA may be subject to modification without notice. The changes will be effective upon posting either on the website of the product or on any other similar publicly available media. As such, You take full responsibility for keeping yourself informed of any EULA modifications.
2.5 All rights that are not granted in this EULA are, to the maximum extent permitted by law, reserved to the Producer.
3. Restrictions
You agree to Use the product in accordance with applicable laws and will not:
a. rent, lease, sub-license, loan, lend, sell, redistribute, merge, modify, reproduce, distribute, sublicense the product.
b. Use the product in any illegal or unlawful manner.
c. Disclose confidential information unless required by law.
4. Disclaimer
You use the Product entirely at Your own risk. This product is provided “AS IS” and any express or implied warranties, including, but not limited to, all implied warranties of merchantability and fitness for a particular purpose are disclaimed. The copyright holder or contributors shall not be liable for any direct, indirect, special, incidental, exemplary, or consequential damages (including, but not limited to, procurement of substitute goods or services, loss of use, loss of data, loss of profits, business interruption) however caused and on any theory of liability, negligence or tortious action, arising in any way out of the use or the performance of this software, even if advised of the possibility of such damage.
5. Termination
5.1 The Producer may terminate this EULA immediately and without notice if You fail to comply with the terms and conditions listed in this license agreement.
5.2 Upon the termination of the EULA, you must destroy all copies of this product stored on any of your hard drives or other storage media.
5.3 Upon the termination of the EULA, You must cease all Use of the product.
5.4 You may terminate the EULA at any time by uninstalling the product from your machine and removing it from any storage media that it is copied to.
5.5. All EULA provisions, which by their nature are intended to survive termination, such as but not limited to disclaimers, warranties, proprietary rights, choice of law and jurisdiction, will remain in effect after termination of this EULA.
6. Governing Law and Disputes
This EULA shall be governed by and construed in accordance with the laws of the United Kingdom.
