**END USER LICENSE AGREEMENT (EULA)**
This End User License Agreement (the "Agreement") is a legal agreement between you (the "End User" or "You") and 3DI LLC, a company registered under the laws of Virginia ("Licensor" or "we"), regarding the use of the software and associated documentation (the "Software") provided by Licensor. By installing, copying, or otherwise using the Software, you agree to be bound by the terms and conditions of this Agreement. If you do not agree to the terms of this Agreement, do not install, copy, or use the Software.
**1. LICENSE GRANT:**
Licensor hereby grants to You a limited, non-exclusive, non-transferable, and revocable license to use the Software for your personal, non-commercial use. This license does not transfer any ownership rights in the Software.
**2. RESTRICTIONS:**
You may not:
- **Reverse Engineer:** Reverse engineer, decompile, or disassemble the Software, or otherwise attempt to derive the source code for the Software.
- **Modify or Create Derivative Works:** Modify, adapt, translate, or create derivative works based upon the Software.
- **Use for Commercial Purposes:** Use the Software for commercial purposes without prior written consent from the Licensor.
**3. INTELLECTUAL PROPERTY:**
- **Patents and Copyrights:** The glasses tracking system integrated into the Software is patented and copyrighted by Licensor. You acknowledge and agree that any unauthorized use of the glasses tracking system is a violation of intellectual property rights and applicable laws.
**4. DISCLAIMER OF WARRANTY:**
THE SOFTWARE IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, LICENSOR DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NONINFRINGEMENT OF THIRD-PARTY RIGHTS.
**5. LIMITATION OF LIABILITY:**
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL LICENSOR BE LIABLE FOR ANY SPECIAL, INCIDENTAL, INDIRECT, OR CONSEQUENTIAL DAMAGES WHATSOEVER (INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF BUSINESS PROFITS, BUSINESS INTERRUPTION, LOSS OF BUSINESS INFORMATION, OR ANY OTHER PECUNIARY LOSS) ARISING OUT OF THE USE OF OR INABILITY TO USE THE SOFTWARE, EVEN IF LICENSOR HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
**6. TERMINATION:**
This Agreement is effective until terminated. Licensor may terminate this Agreement at any time without notice if You breach any provision of this Agreement. Upon termination, You must destroy all copies of the Software in your possession or control.
**7. GOVERNING LAW:**
This Agreement shall be governed by and construed in accordance with the laws of Virginia, without regard to its conflict of law principles.
**8. LIABILITY FOR PERSONAL INJURY, COLORED LENSES, AND SPATIAL EFFECTS:**
You acknowledge and agree that the Software may include features that utilize glasses with colored lenses and spatial effects, including 3D stereo effects. Licensor shall not be liable for any personal injury, discomfort, motion sickness, adverse health effects, or any other physical or psychological reactions resulting from the use of glasses with colored lenses or the Software's spatial effects and 3D stereo effects.
It is your responsibility to use glasses with colored lenses and the Software's spatial effects responsibly and in accordance with any guidelines provided. If you experience any discomfort, dizziness, adverse reactions, or health issues while using the Software, including those related to the colored lenses or spatial effects, you should immediately discontinue use and consult a qualified professional.
You hereby release Licensor, its affiliates, agents, employees, and licensors from any and all liability, claims, demands, causes of action, costs, and expenses arising out of or in any way connected with personal injury, discomfort, motion sickness, adverse health effects, or any other physical or psychological reactions resulting from the use of glasses with colored lenses or the Software's spatial effects.
By accepting this Agreement and using the Software, you assume all risks associated with glasses with colored lenses and the Software's spatial effects, and you agree to hold Licensor harmless from any and all liability related to their use.
**9. ENTIRE AGREEMENT:**
This Agreement constitutes the entire agreement between You and Licensor regarding the Software and supersedes all prior and contemporaneous understandings, agreements, representations, and warranties.
By installing, copying, or otherwise using the Software, You acknowledge that You have read, understood, and agree to be bound by the terms and conditions of this Agreement.
