This End User License Agreement ("EULA") is a legal agreement between you (the "End User" or "You") and [G4rr3tt], the developer and owner of the video game "[The Wicked West]" (the "Game"). By installing, accessing, or playing the Game, you agree to be bound by the terms and conditions of this EULA.
1. License Grant
[G4rr3tt] grants You a non-exclusive, non-transferable, limited license to use the Game for personal, non-commercial purposes on a single device, provided that You comply with all terms of this EULA.
2. Restrictions
You may not:
a. Modify, reverse engineer, decompile, or disassemble the Game or any part of it.
b. Distribute, sell, lease, rent, sublicense, or otherwise transfer your rights to the Game to any third party.
c. Use the Game for commercial purposes without the express written consent of [G4rr3tt].
3. Ownership
The Game is protected by copyright and other intellectual property laws. [G4rr3tt] retains all rights, title, and interest in the Game, including any content provided with the Game, such as graphics, sounds, and music.
4. Support and Updates
[G4rr3tt] may, but is not obligated to, provide updates, patches, or customer support for the Game. This EULA does not give you any right to such updates, unless otherwise stated by [G4rr3tt].
5. Termination
This EULA is effective until terminated by either party. You may terminate it by uninstalling the Game from your device. [G4rr3tt] may terminate this EULA if You breach any of its terms. Upon termination, You must cease all use of the Game and destroy any copies in your possession.
6. Warranty Disclaimer
The Game is provided "as is" without any warranties, either expressed or implied, including, but not limited to, the implied warranties of merchantability and fitness for a particular purpose.
7. Limitation of Liability
In no event shall [G4rr3tt] be liable for any direct, indirect, special, incidental, or consequential damages arising out of the use or inability to use the Game.
8. Governing Law
This EULA is governed by and construed in accordance with the laws of [Rhode Island, USA]. Any disputes arising under or in connection with this EULA shall be subject to the exclusive jurisdiction of the state and federal courts located within [Rhode Island, USA].
9. Entire Agreement
This EULA constitutes the entire agreement between You and [G4rr3tt] and supersedes all prior or contemporaneous understandings, whether written or oral.
By installing, accessing, or playing the Game, You acknowledge that You have read and understood this EULA and agree to be bound by its terms and conditions. If You do not agree to these terms, do not install, access, or play the Game.
[G4rr3tt] reserves the right to modify this EULA at any time. Updated versions of the EULA will be posted on the official [G4rr3tt] website or within the Game, and your continued use of the Game will be subject to the most current version of the EULA.
