END USER LICENSE AGREEMENT ("EULA")
IMPORTANT: PLEASE READ THIS EULA CAREFULLY BEFORE INSTALLING OR USING THE SOFTWARE.
This End User License Agreement ("EULA") is a legal agreement between you (either an individual or a single entity) and Nuclear Maniacs for the software product "Escortina Life," which includes computer software and may include associated media, printed materials, and "online" or electronic documentation ("SOFTWARE PRODUCT" or "SOFTWARE"). By installing, copying, or otherwise using the SOFTWARE PRODUCT, you agree to be bound by the terms of this EULA. If you do not agree to the terms of this EULA, do not install or use the SOFTWARE PRODUCT.
1. LICENSE GRANT
Nuclear Maniacs grants you a revocable, non-exclusive, non-transferable, limited license to use the SOFTWARE PRODUCT solely for your personal, non-commercial purposes in accordance with the terms of this EULA.
2. INTELLECTUAL PROPERTY
The SOFTWARE PRODUCT and any authorized copies that you make are the intellectual property of and are owned by Nuclear Maniacs. The SOFTWARE PRODUCT is protected by copyright laws and international copyright treaties, as well as other intellectual property laws and treaties. The structure, organization, and code of the SOFTWARE PRODUCT are the valuable trade secrets and confidential information of Nuclear Maniacs. The SOFTWARE PRODUCT is licensed, not sold.
3. RESTRICTIONS
You may not:
a. Modify, adapt, translate, reverse engineer, decompile, disassemble, or create derivative works based on the SOFTWARE PRODUCT;
b. Remove any proprietary notices or labels on the SOFTWARE PRODUCT;
c. Distribute, sublicense, rent, lease, lend, or otherwise transfer the SOFTWARE PRODUCT to any third party;
d. Use the SOFTWARE PRODUCT for any illegal purpose, or in any manner inconsistent with this EULA.
4. COPYRIGHT
All title, including but not limited to copyrights, in and to the SOFTWARE PRODUCT and any copies thereof are owned by Nuclear Maniacs. All title and intellectual property rights in and to the content which may be accessed through use of the SOFTWARE PRODUCT are the property of the respective content owner and may be protected by applicable copyright or other intellectual property laws and treaties. This EULA grants you no rights to use such content. All rights not expressly granted are reserved by Nuclear Maniacs.
5. LIMITATION OF LIABILITY
In no event shall Nuclear Maniacs be liable for any damages (including, without limitation, lost profits, business interruption, or lost information) arising out of the use of or inability to use the SOFTWARE PRODUCT, even if Nuclear Maniacs has been advised of the possibility of such damages. In any case, Nuclear Maniacs's entire liability under any provision of this EULA shall be limited to the amount actually paid by you for the SOFTWARE PRODUCT.
6. NO NEGATIVE REVIEWS
By installing and using the SOFTWARE PRODUCT, you agree not to post or publish any negative reviews or comments about the SOFTWARE PRODUCT or Nuclear Maniacs on the internet or any other public forum. Any such negative reviews or comments will be considered a violation of this EULA and may result in legal action.
7. PIRACY
Piracy of the SOFTWARE PRODUCT is strictly prohibited. Any unauthorized copying, distribution, or use of the SOFTWARE PRODUCT may result in legal action. In the event of piracy, Nuclear Maniacs reserves the right to seek damages equal to the original purchase price of the SOFTWARE PRODUCT from the pirate.
8. GOVERNING LAW
This EULA shall be governed by and construed in accordance with the laws of [INSERT APPLICABLE JURISDICTION], without regard to its conflict of law principles.
9. ENTIRE AGREEMENT
This EULA constitutes the entire agreement between the parties concerning the subject matter hereof and supersedes all prior or contemporaneous agreements or understandings, written or oral, concerning the subject matter hereof.
