END USER LICENSE AGREEMENT
IMPORTANT: PLEASE READ THIS END USER LICENSE AGREEMENT ("EULA") CAREFULLY. BY INSTALLING, COPYING, OR OTHERWISE USING THE "NO PRESSURE: HIVE WAR" GAME SOFTWARE (DEFINED BELOW) DISTRIBUTED BY ETHEREAL INDUSTRIES ON THE STEAM PLATFORM, YOU AGREE TO BE BOUND BY THE TERMS OF THIS EULA. IF YOU DO NOT AGREE TO THE TERMS OF THIS EULA, YOU MAY NOT INSTALL, COPY, OR USE THE GAME SOFTWARE.
This EULA is a legal agreement between you ("You" or "Your") and Ethereal Industries ("Company"). This EULA governs Your use of the "No Pressure: Hive War" game software and any associated materials, including, but not limited to, printed materials, online documentation, and updates (collectively, the "Game Software"). The Game Software is licensed, not sold, to You.
1. LICENSE GRANT
Subject to Your compliance with the terms of this EULA, Company grants You a non-exclusive, non-transferable, limited license to install and use the Game Software for personal and non-commercial entertainment purposes only.
2. LICENSE RESTRICTIONS
You may not:
a. Use the Game Software for any commercial purpose or in any manner that is inconsistent with this EULA.
b. Copy or reproduce the Game Software, except for backup or archival purposes, as expressly permitted by applicable law.
c. Sell, rent, lease, sublicense, distribute, or otherwise transfer the Game Software or any rights therein to any third party.
d. Modify, adapt, reverse engineer, decompile, disassemble, or attempt to derive the source code of the Game Software, except as and only to the extent this restriction is prohibited by applicable law.
e. Remove, alter, or obscure any proprietary notices or labels on the Game Software.
f. Use the Game Software in any way that could harm, disable, overburden, or impair the Company's servers or networks.
g. Use cheats, automation software (bots), hacks, mods, or any other unauthorized third-party software designed to modify or interfere with the Game Software's functionality.
h. Violate any applicable laws or regulations, or encourage or enable others to do so, while using the Game Software.
3. INTELLECTUAL PROPERTY
The Game Software, including all related intellectual property rights, is the property of Company and is protected by copyright, trademark, and other laws. This EULA does not grant You any ownership rights to the Game Software.
4. TERMINATION
This EULA is effective until terminated by You or Company. Your rights under this EULA will terminate automatically without notice from Company if You fail to comply with any term(s) of this EULA. Upon termination of this EULA, you shall cease all use of the Game Software and destroy all copies, full or partial, of the Game Software.
5. WARRANTY DISCLAIMER
THE GAME SOFTWARE IS PROVIDED "AS IS," WITHOUT WARRANTY OF ANY KIND. COMPANY DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. THE ENTIRE RISK ARISING OUT OF THE USE OR PERFORMANCE OF THE GAME SOFTWARE REMAINS WITH YOU.
6. LIMITATION OF LIABILITY
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL COMPANY BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF YOUR ACCESS TO OR USE OF (OR INABILITY TO ACCESS OR USE) THE GAME SOFTWARE, REGARDLESS OF THE LEGAL THEORY, EVEN IF COMPANY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
7. GOVERNING LAW
This EULA is governed by and construed in accordance with the laws of South Africa, without regard to its conflict of law principles.
8. ENTIRE AGREEMENT
This EULA constitutes the entire agreement between You and Company regarding Your use of the Game Software and supersedes all prior or contemporaneous understandings, representations, and agreements.
