This End-User License Agreement ("EULA") is a legal agreement between you ("Licensee") and Rollergoose ("Rollergoose" or "Licensor") for the use of the video game "Nightfall Wardens" ("Game").
By installing, copying, or otherwise using the Game, you agree to be bound by the terms of this EULA. If you do not agree to the terms of this EULA, do not install or use the Game.
1. License Grant
Rollergoose grants Licensee a non-exclusive, non-transferable license to use the Game for personal, non-commercial purposes in accordance with the terms of this EULA.
2. Intellectual Property
The Game, including all intellectual property rights therein, is and shall remain the property of Rollergoose and its licensors. Licensee acknowledges that no title or ownership interest in the Game is transferred under this EULA.
3. Restrictions
Licensee shall not:
a. Modify, adapt, translate, reverse engineer, decompile, disassemble, or create derivative works based on the Game.
b. Remove, alter, or obscure any copyright, trademark, or other proprietary notices contained in the Game.
c. Rent, lease, lend, sell, redistribute, sublicense, or otherwise transfer rights to the Game.
d. Use the Game for any commercial purpose without the express written consent of Rollergoose.
e. Use the Game in any way that violates applicable laws or regulations.
4. Termination
This EULA is effective until terminated. Rollergoose may terminate this EULA immediately without notice if Licensee breaches any provision of this EULA. Upon termination, Licensee must cease all use of the Game and delete all copies of the Game in Licensee's possession or control.
5. Limited Warranty
The Game is provided "as is," without any warranties of any kind, express or implied. Rollergoose does not warrant that the Game will be error-free or uninterrupted, or that defects in the Game will be corrected. Licensee assumes all risks associated with the use of the Game.
6. Limitation of Liability
In no event shall Rollergoose be liable for any indirect, incidental, consequential, special, or punitive damages arising out of or relating to the use of or inability to use the Game, even if Rollergoose has been advised of the possibility of such damages. In no event shall Rollergoose's total liability exceed the amount paid by Licensee for the Game.
7. Governing Law
This EULA shall be governed by and construed in accordance with the laws of [Your Jurisdiction]. Any legal action or proceeding arising under this EULA shall be brought exclusively in the federal or state courts located in [Your Jurisdiction], and the parties hereby consent to the personal jurisdiction and venue of such courts.
8. Entire Agreement
This EULA constitutes the entire agreement between Licensee and Rollergoose regarding the Game and supersedes all prior or contemporaneous understandings and agreements, whether written or oral.
