End-User License Agreement (EULA) for "That Cowgirl Life" Video Game

PLEASE READ THIS END-USER LICENSE AGREEMENT ("EULA") CAREFULLY BEFORE INSTALLING, COPYING, OR OTHERWISE USING THE "THAT COWGIRL LIFE" VIDEO GAME ("THE GAME"). BY INSTALLING, COPYING, OR OTHERWISE USING THE GAME, YOU AGREE TO BE BOUND BY THE TERMS OF THIS EULA. IF YOU DO NOT AGREE TO THE TERMS OF THIS EULA, DO NOT INSTALL, COPY, OR USE THE GAME.
LICENSE GRANT
Subject to your compliance with the terms of this EULA, Rook Gaming LLC ("Licensor") grants you a non-exclusive, non-transferable, limited, and revocable license to install and use the Game for your personal, non-commercial entertainment purposes. This license does not grant you any rights to ownership of the Game, and all rights not expressly granted herein are reserved by Licensor.
GAME USE RESTRICTIONS
You may not, directly or indirectly:
a. Copy, reproduce, distribute, or publicly display the Game, except as expressly permitted by this EULA or applicable law.
b. Modify, adapt, translate, reverse engineer, decompile, or disassemble the Game, or create derivative works based on the Game, except as expressly permitted by applicable law.
c. Sell, rent, lease, sublicense, or otherwise transfer your rights to the Game to any third party.
d. Use the Game for any commercial purpose, including but not limited to, hosting the Game for third parties, charging others for access to the Game, or using the Game for advertising or promotional purposes without Licensor's prior written consent.
e. Use cheats, hacks, or any unauthorized third-party software that may alter or interfere with the normal operation of the Game.
f. Exploit the Game or its components for financial gain or engage in any form of cheating or harassment while using the Game.
g. Violate any applicable laws, rules, or regulations while using the Game.
h. Use the Game to transmit or distribute harmful code, viruses, or other malicious software.
INTELLECTUAL PROPERTY
The Game, including all associated intellectual property rights, is the sole property of Rook Gaming LLC. You acknowledge and agree that all content, characters, artwork, music, and trademarks included in the Game are protected by copyright and other intellectual property laws. This EULA does not grant you any rights to these intellectual property rights except as expressly provided herein.
TERMINATION
This EULA is effective until terminated by you or Licensor. You may terminate this EULA at any time by uninstalling and ceasing to use the Game. Licensor may terminate this EULA at any time without notice if you fail to comply with its terms. Upon termination, you must uninstall the Game and destroy all copies of the Game in your possession.
DISCLAIMER OF WARRANTY
THE GAME IS PROVIDED "AS IS" WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, LICENSOR DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. LICENSOR DOES NOT WARRANT THAT THE GAME WILL BE ERROR-FREE, UNINTERRUPTED, OR COMPATIBLE WITH YOUR HARDWARE OR SOFTWARE.
LIMITATION OF LIABILITY
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL LICENSOR BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR IN CONNECTION WITH THIS EULA OR THE USE OF THE GAME, EVEN IF LICENSOR HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. LICENSOR'S TOTAL LIABILITY FOR ANY CLAIMS ARISING OUT OF OR IN CONNECTION WITH THIS EULA OR THE GAME SHALL NOT EXCEED THE AMOUNT YOU PAID, IF ANY, FOR THE GAME.
GOVERNING LAW
This EULA shall be governed by and construed in accordance with the laws of the United States of America, without regard to its conflicts of law principles.
ENTIRE AGREEMENT
This EULA constitutes the entire agreement between you and Licensor regarding the Game and supersedes all prior agreements and understandings, whether written or oral.
By installing, copying, or using the Game, you acknowledge that you have read and understood this EULA and agree to be bound by its terms and conditions. If you do not agree to the terms of this EULA, do not install, copy, or use the Game.
