END USER LICENSE AGREEMENT (EULA) FOR BOXMAN GAME
This End User License Agreement ("EULA") is a legal agreement between you (the "End User" or "you") and PACKAGED Studios ("PACKAGED," "we," or "us") for the use of the BOXMAN game, including any associated software, updates, and online components (collectively, the "Game"). By installing, copying, or otherwise using the Game, you agree to be bound by the terms and conditions of this EULA. If you do not agree to the terms of this EULA, do not install or use the Game.
LICENSE GRANT
Subject to your compliance with the terms of this EULA, PACKAGED grants you a non-exclusive, non-transferable, revocable, and limited license to use the Game for your personal, non-commercial entertainment purposes.
RESTRICTIONS
You may not:
a. Copy, reproduce, or distribute the Game, in whole or in part, except as expressly permitted by this EULA.
b. Modify, adapt, translate, reverse engineer, decompile, disassemble, or create derivative works based on the Game.
c. Remove, alter, or obscure any copyright, trademark, or other proprietary notices on or in the Game.
d. Use the Game in any manner that violates any applicable laws, regulations, or third-party rights.
e. Rent, lease, lend, or sublicense the Game to any third party.
f. Use the Game to engage in any unauthorized or harmful activities, including but not limited to hacking, cheating, or engaging in malicious behavior.
OWNERSHIP
The Game and all intellectual property rights therein are and shall remain the exclusive property of PACKAGED. This EULA grants you no rights to the Game except as expressly set forth herein.
UPDATES AND SUPPORT
PACKAGED may provide updates, patches, and support for the Game, at its sole discretion. Such updates and patches may be required for continued access to the Game. PACKAGED is not obligated to provide support or updates for the Game.
TERMINATION
This EULA is effective until terminated by either party. You may terminate this EULA by uninstalling the Game and destroying all copies in your possession. PACKAGED may terminate this EULA at any time, for any reason or no reason, with or without notice. Upon termination, you must cease all use of the Game and destroy all copies in your possession.
DISCLAIMER OF WARRANTIES
THE GAME IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. PACKAGED DOES NOT WARRANT THAT THE GAME WILL MEET YOUR REQUIREMENTS OR THAT IT WILL BE ERROR-FREE OR UNINTERRUPTED. NO ORAL OR WRITTEN INFORMATION OR ADVICE GIVEN BY PACKAGED OR ITS AUTHORIZED REPRESENTATIVES SHALL CREATE A WARRANTY.
LIMITATION OF LIABILITY
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, PACKAGED SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF YOUR USE OR INABILITY TO USE THE GAME.
GOVERNING LAW
This EULA is governed by and construed in accordance with the laws of the jurisdiction in which PACKAGED is located, without regard to its conflict of law principles.
ENTIRE AGREEMENT
This EULA constitutes the entire agreement between you and PACKAGED with respect to the Game and supersedes all prior or contemporaneous understandings, whether oral or written.
