End-User License Agreement
This End-User License Agreement ("Agreement") is between you (either an individual or a single entity, hereinafter referred to as "User") and Histria Games d.o.o. ("Histria Games"), an indie game development company organized under the laws of the Republic of Croatia. By downloading, installing and playing the "Epic Eon" game (the "Game"), you acknowledge that you have read, understood, and agree to be bound by the terms and conditions of this Agreement. If you do not agree with the terms of this Agreement, you should not download, install, or use the Game.
1. License Grant
Histria Games grants you a limited, non-transferable, non-exclusive license to install and use the Game on a single device owned or controlled by you, solely for personal, non-commercial use.
2. Restrictions
You agree not to, and will not permit or authorize third parties to:
a. Modify, adapt, alter, translate, or create derivative works from the Game.
b. Use unauthorized software or third-party applications to gain an advantage, hack, or otherwise manipulate the Game.
c. Sublicense, lease, rent, loan, distribute, or otherwise transfer the Game to any third party.
d. Reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code for the Game.
e. Use or copy the Game in any manner not expressly allowed under this Agreement.
f. Remove, alter, or obscure any copyright, trademark, or other proprietary rights notice on or in the Game.
3. Intellectual Property Rights
You acknowledge and agree that the Game and all copyrights, patents, trademarks, trade secrets and other intellectual property rights associated therewith are, and shall remain, the property of Histria Games. The Game is protected by copyright and other intellectual property laws and treaties. Any trademarks, service marks, trade names, logos, or other intellectual property not owned by Histria Games that appear in the Game are the property of their respective owners.
Unity Asset Creators Credits:
We wanted to make the BIG EPIC RTS indie game experience, but due to budget constraints, a very small team, and Epic Eon being our first game ever, we’ve incorporated paid and free Unity assets into Epic Eon. These assets, used under commercial licenses from the Unity Asset Store, contribute to the game’s visuals and sound alongside our developed content. We appreciate and respect the work of these creators, and they have been credited accordingly in the game credits.
4. User Content
You grant Histria Games a worldwide, non-exclusive, royalty-free, perpetual, irrevocable license to use any information, data, content, or material you provide through the Game for the purpose of providing the Game, improving the Game, and developing new features and services.
5. Software Updates
Histria Games may from time to time, in its sole discretion, provide patches, updates, improvements or other modifications to the Game ("Updates"). These Updates may include bug fixes, feature enhancements or improvements, or entirely new versions of the Game.
6. Digital Goods
The Game may include virtual in-game items or services that can be purchased with real-world money or earned through gameplay ("Digital Goods"). You understand that you do not own these Digital Goods but instead, you purchase a limited, non-transferable, revocable license to use them.
7. No Warranty
Histria Games provides the Game "as is" and without warranty of any kind. Histria Games does not warrant that the Game will meet your requirements, that operation of the Game will be uninterrupted or error-free, or that defects in the Game will be corrected.
8. Limitation of Liability
In no event will Histria Games be liable to you for any indirect, incidental, consequential, special or exemplary damages arising out of or in connection with your access or use of, or inability to use, the Game.
9. Indemnity
You agree to indemnify and hold harmless Histria Games from any damages, losses, liabilities, costs and expenses incurred by Histria Games as a result of any claim, judgment, or adjudication related to or arising directly or indirectly from your use or misuse of the Game or violation of this Agreement.
10. Termination
Histria Games may terminate this Agreement and your rights to use the Game at any time, for any or no reason, with or without prior notice to you. Upon termination, you shall cease all use of the Game and uninstall the Game from your device.
11. Governing Law and Jurisdiction
This Agreement shall be governed by and construed in accordance with the laws of the Republic of Croatia. Any disputes arising out of or in connection with this Agreement shall be subject to the exclusive jurisdiction of the courts of the Republic of Croatia.
12. Terms of Use and Updates to the Agreement
You acknowledge that you have read and agree to Histria Games' Terms of Use. Histria Games may update or modify this Agreement at any time, and by continuing to use the Game after any such changes, you agree to be bound by the revised Agreement.
13. Privacy Policy
You acknowledge that you have read and agree to Histria Games' Privacy Policy, which governs the collection, use, and sharing of personal data.
14. Changes to the Game
Histria Games reserves the right to change, modify, or remove any features, content, or aspects of the Game at its sole discretion.
15. User Behavior
Users agree to behave in a respectful and law-abiding manner while using the Game, and not to harass, threaten, or cause distress to other users.
16. Age Restriction
By accepting this Agreement, you represent and warrant that you are at least 18 years of age or, if you are under 18, that you have your parent or guardian's permission to enter into this Agreement.
17. Dispute Resolution
In the event of a dispute arising out of or in connection with this Agreement, the parties shall first attempt to resolve the dispute through amicable negotiations. If the dispute cannot be resolved in this manner, it shall be referred to the courts of the Republic of Croatia.
18. Severability
If any provision of this Agreement is held to be invalid or unenforceable, such provision shall be struck, and the remaining provisions shall be enforced to the fullest extent under law.
19. Entire Agreement
This Agreement, including any referenced documents, constitutes the entire agreement between you and Histria Games and governs your use of the Game, superseding any prior agreements between you and Histria Games.
20. Violation and Enforcement of Agreement
By accepting this Agreement, you acknowledge that any violation of this Agreement may result in the suspension or termination of your access to the Game. Histria Games reserves the right to enforce this Agreement at its sole discretion. Any violation or breach of this Agreement, if deemed unlawful under applicable jurisdiction, may lead you to significant penalties, including substantial fines or other legal consequences as prescribed by the relevant laws.
