This End User License Agreement ("Agreement") is entered into between Blend Nesimi (hereinafter referred to as "Licensor" or "we") and you, the end user (hereinafter referred to as "Licensee" or "you"). This Agreement governs your use of the software titled "Crystal Journey - Lum's Adventure" (the "Software") published by Simblend.
1. Grant of License
Subject to your compliance with the terms of this Agreement, Simblend grants you a non-exclusive, non-transferable license to use the Software solely for your personal, non-commercial entertainment purposes. This license does not grant you ownership of the Software.
2. Restrictions
You agree not to:
Reverse engineer, decompile, or disassemble the Software.
Distribute, sell, rent, lease, sublicense, or otherwise transfer copies of the Software to any third party.
Use the Software for any illegal or unauthorized purpose.
Modify, adapt, or create derivative works based on the Software.
3. Intellectual Property
Blend Nesimi and Simblend retain all rights, title, and interest in and to the Software, including all copyrights, trademarks, and intellectual property rights.
4. User Obligations
You agree to:
Comply with all applicable laws and regulations while using the Software.
Respect the rights of other users and refrain from engaging in harmful, disruptive, or inappropriate behavior.
5. Warranty Disclaimer
The Software is provided "as-is" and without warranties of any kind, whether express or implied. Simblend disclaims all warranties, including but not limited to, the implied warranties of merchantability and fitness for a particular purpose.
6. Limitation of Liability
To the fullest extent permitted by applicable law, Simblend and Blend Nesimi shall not be liable for any direct, indirect, incidental, special, or consequential damages arising out of or in any way connected with the use or performance of the Software.
7. Termination
Simblend reserves the right to terminate this Agreement if you breach any of its terms. Upon termination, you must immediately cease all use of the Software.
8. Governing Law and Dispute Resolution
This Agreement shall be governed by and construed in accordance with the laws of Republic of North Macedonia. Any disputes arising under or in connection with this Agreement shall be resolved through arbitration in accordance with the rules of the Republic of North Macedonia.
