END USER LICENSE AGREEMENT
IMPORTANT, READ CAREFULLY
BY DOWNLOADING, INSTALLING, COPYING OR OTHERWISE USING THIS SOFTWARE PRODUCT, YOU AGREE TO BE BOUND BY THE FOLLOWING TERMS AND CONDITIONS:
1. END USER LICENSE AGREEMENT.
This end user license agreement (“EULA”) is a legal agreement between you (whether an individual or a single entity), hereinafter referred to as “You”, “End User” or “Licensee” and Natanael Figueiredo Rodrigues for the product of MHS (Math High Speed) software accompanying this EULA, which includes video game-related software and may include associated media, printed media, and online or electronic documentation (collectively, “Software Product” or alternatively, the “Game” ) . Any and all use of the Software Product is governed by the terms of this EULA. If you do not agree to the terms of this EULA, you must not install, copy, download or use the Software Product and, in that case, you must contact your supplier regarding its return policy. If you are purchasing this Software Product from a Natanael Figueiredo Rodrigues website or a third-party distributor (a “Site”) and you do not agree, click “disagree/decline”. You agree that your use of the software acknowledges that you have read this agreement, understand it and agree to be bound by its terms and conditions, and that you represent and warrant that you are an adult and are accepting this EULA on behalf of yourself or on behalf of his son or ward, as the case may be. If the End User has not reached the age of majority, they are obliged to obtain the necessary authorization in the form required by law from their parents or other legal representatives.
2. PROPERTY.
It is understood and agreed that, as between you and MHS (Math High Speed), Natanael Figueiredo Rodrigues is the owner of all right titles, proprietary rights, intellectual property rights and interests in and to the Software Product and all copies thereof (including, without limitation, any titles, computer codes, themes, objects, characters, character names, stories, dialogue, catchphrases, locations, concepts, artwork, character inventories, structural designs or landscape design, animations, sounds, musical compositions and recordings, audiovisual effects, plots, character likenesses, methods of operation, moral rights and any related documentation), regardless of the media or form of the original download, whether online, on disk or otherwise. You, as Licensee, by downloading, installing, copying or using this product do not acquire any ownership rights in the Software Product.
3. GENERAL.
The Software Product is licensed, not sold, to you by Natanael Figueiredo Rodrigues for use only under the terms and conditions of this EULA. The Software Product is protected by copyright laws and international copyright treaties, as well as other intellectual property laws and treaties. The rights granted herein are limited to the intellectual property rights of Natanael Figueiredo Rodrigues and its licensors in the Software Product and do not include any other patents or intellectual property rights. The Software Product may contain license management software (also known as digital rights management software) that restricts your use of the Software Product.
4. SOFTWARE PRODUCT.
The Software Product, as used in this EULA, means, individually and/or as applicable:
A. The Software Product package;
B. Any and all content, components, attachments, software, media and code with which this EULA is provided and delivered via disk or website;
C. Any and all game designs, characters, images, graphics, photographs, art, artwork, clip art, text, fonts, music, sounds, voices or other sensory content (the “Game Content”);
D. Related written explanatory materials and instructions and any other possible documentation related thereto (“Documentation”);
E. Updates, modified versions, updates, additions, expansion packs and copies of the Software Product (the “Updates”), if any, provided to you by Natanael Figueiredo Rodrigues under this EULA.
The terms of this EULA will govern any updates provided by Natanael Figueiredo Rodrigues that replace and/or supplement the original Software Product, unless such update is accompanied by a separate license, in which case the terms of that license will prevail.
5. GRANT OF LICENSE AND RESTRICTIONS.
A. Subject to your agreement and continued compliance with this EULA, Natanael Figueiredo Rodrigues grants, and you accept, a limited, non-exclusive, non-transferable end user license to: (1) install the Software Product on your local hard drive(s) ) or other permanent storage media of a computer or other gaming device owned or legitimately controlled by you (each, a “Unit”); and (2) use the Software Product on a single Unit at a time and for non-commercial entertainment purposes only. Licensee may physically transfer the Software Product between Units as long as it is used on only one Unit at a time.
B. Natanael Figueiredo Rodrigues authorizes End User to make one (1) copy of the Software Product as an archival backup copy, provided that End User's backup copy is not installed or used on any Unit. Any other copies you make or authorize violate this EULA.
C. Except as otherwise provided in the Documentation, you shall not display, modify, reproduce and distribute any Game Content, or portion(s) thereof, included in or related to the Software Product, if any. Any authorized display, modification, reproduction and distribution will be in full accordance with this EULA. Under no circumstances will your use, display, modification, reproduction and distribution of the Game Content give you any intellectual property or proprietary rights in the Game Content or in any logos and/or trademarks or service marks of Natanael Figueiredo Rodrigues. All rights, titles and interests belong exclusively to Natanael Figueiredo Rodrigues and its licensors.
D. Except for the initial loading of the Software Product onto a hard drive or other permanent storage media for archival/backup purposes as provided above, you shall not, without the express written consent of Natanael Figueiredo Rodrigues;
I. Copy or reproduce, auction, loan, rent, lease, sublicense, donate or transfer the Software Product;
II. Electronically transfer the Software Product over a LAN (local area network) or file sharing network; or
III. Modify, adapt, translate, reverse engineer, derive source code, disassemble, decompile or create derivative works based on the Software Product or any accompanying materials, except to the extent permitted by any applicable law or permitted by the rules of the Game.
Any use of the Software Product in violation of these limitations will be considered a violation of Natanael Figueiredo Rodrigues' copyright in the Software Product.
E. By accepting the terms of this EULA, you further agree that you will not, under any circumstances:
I. use, develop or sell cheats, automation software (bots), hacks, mods or any other unauthorized third party software designed to modify the Software Product;
II. exploit the Software Product or any part thereof for any commercial purpose, including, without limitation, (a) use in an internet cafe, computer gaming center or any other location-based website; (b) to collect in-game currency, items or resources for sale outside of the Game; or (c) perform in-game services in exchange for payment outside of the Game, for example, power-leveling;
III. remove, disable or circumvent any security safeguards, proprietary notices or labels contained in the Software Product; or
IV. use any obscene, pornographic, provocative or racist language or material in the Forums and chats related to the Game.
Any use of the Software Product in violation of these limitations will be considered a violation of this EULA and will be prosecuted to the fullest extent permitted by law.
6. DESCRIPTION OF OTHER RIGHTS AND LIMITATIONS.
A. From time to time, in Natanael Figueiredo Rodrigues' sole discretion, he may provide you with support services related to the Software Product (“Support Services”). Natanael Figueiredo Rodrigues reserves the right to change, suspend and terminate Support Services at any time and for any reason. You can contact Natanael Figueiredo Rodrigues for support services via email at natanael.rodrigues@edu.mt.gov.br
B. Any supplemental software, code, content or media provided to you in the course of the Support Services will be considered part of the Software Product and will be subject to the terms and conditions of this EULA.
C. You shall not modify, sublicense, assign or transfer the Software Product or any rights under this EULA except as expressly provided in this EULA. Any attempt to sublicense, assign or transfer any of the rights, duties or obligations will be void.
D. Natanael Figueiredo Rodrigues will have the right, at any time, without prior notice to the End User, to: (1) unilaterally suspend or modify the Game process and Game conditions; (2) modify or delete any information posted by the End User in the Forum and chats related to the Game, including statement and statements; and (3) improve or modify the Game, or any part thereof. As a consequence, the End User will be able to participate in the Game in its current version.
E. Natanael Figueiredo Rodrigues does not exchange game values provided in the Game for money or anything else.
F. The End User agrees to take appropriate measures to ensure the security of its Game account and passwords and to prevent unauthorized use thereof by third parties. If the End User has reason to believe that third parties have obtained such information or may obtain it, the End Users must immediately inform Natanael Figueiredo Rodrigues and change their data. Unauthorized third party access to the End User's personal information, account and monetary account in the Game is strictly prohibited. End User agrees and acknowledges that it will not sell, give or transfer its account, in-game currency account or personal information to any third party.
G. Natanael Figueiredo Rodrigues will have the right to collect personal and technical information from the End User, including, but not limited to, age, country of residence, IP address, computer configuration and software usage, which is collected periodically to facilitate the provision of software updates, product support and other services related to the Software Product. Natanael Figueiredo Rodrigues may use this information to improve its products or provide services or technologies to the End User. Such information will not be sold or transferred to third parties without the End User's prior consent.
7. ADDITIONAL SERVICES.
“Additional Services” means providing the User with additional and special features in the game for a fee under the conditions specified in this Agreement. Additional services are not a necessary condition for participation in the Game and are provided only upon request by the End User. Additional services consist of in-game currency that can be acquired by the End User in the game and in-game values that can be provided only when the End User is in the game. As a condition of using additional services, End User acknowledges and agrees that:
A. No one under the age of 18 is allowed to purchase in-game currency. If it becomes known to Natanael Figueiredo Rodrigues that an End User under the age of 18 has purchased any currency in the game, Natanael Figueiredo Rodrigues has the right to immediately delete that End User's account and the entire account balance will be considered lost.
B. A maximum limit of three thousand US dollars ($3,000.00) applies to the in-game currency that can be purchased in total per week by an End User.
C. If the End User does not enter the game by “logging in” to their account for a period of three hundred and sixty-five (365) days, Natanael Figueiredo Rodrigues has the right to immediately delete the End User's account and the entire balance of the account. and game currency will be considered abandoned and lost.
D. Natanael Figueiredo Rodrigues does not exchange game values obtained from the services provided, including game currency, for cash or non-monetary money.
E. The list and cost of additional services and the methods and conditions for purchasing game currency are published by Steam. For policies and procedures of payment systems used to purchase in-game currency, End User should refer to Section 4 of the Steam Subscription Agreement ( www.steampowered.com/agreement/ ) and contact the legal holders of such systems of payment. Natanael Figueiredo Rodrigues does not provide any explanation to the End User about the rules and procedures of such payment systems, nor does it provide any monetary compensation to the End User who carried out fund transfer operations to purchase game currency using the payment systems. , if so the payments failed and as a result the money was not received by Steam or Natanael Figueiredo Rodrigues. Notwithstanding the foregoing, the End User is obliged to maintain documents proving payment for additional services throughout the period in which the End User remains in the game and, if such documents are requested by Natanael Figueiredo Rodrigues, the End User must provide them.
F. If you choose to use additional services, you will be obliged to indicate in your Steam account the following data: name, surname, date of birth, billing information and other information requested by Steam that will allow Natanael Figueiredo Rodrigues, if necessary, to identify the real person with the user account in the game. End Users will be solely responsible for the accuracy, completeness, reliability and correctness of their personal data registered in their Game account.
G. If Natanael Figueiredo Rodrigues has reason to believe that the End User carries out illegal activities or fraud related to payments for additional services in the Game, Natanael Figueiredo Rodrigues has the right to send relevant information to law enforcement agencies to investigate these facts.
H. If Natanael Figueiredo Rodrigues has reason to believe or suspect that the End User is exploiting any defects in the Game or maliciously using any third party software to increase its amount of in-game currency, or if Natanael Figueiredo Rodrigues has reason to believe that If the increase in game currency originates from a system failure, Natanael Figueiredo Rodrigues has the right to immediately delete the End User's account and the entire account balance will be considered lost.
I. If the End User is prohibited from receiving online gaming services by the legislation of its country or in the case of any other legal restrictions, including age restrictions, the End User will not be permitted to use the Game or individual services in the Game . In this case, the End User will be solely responsible for the use of the Game in the territory of their country, in accordance with local laws.
J. End User agrees to take appropriate measures to ensure the security of their Game account and passwords and to prevent unauthorized use thereof by third parties in accordance with Section 1 of the Steam Subscription Agreement. If the End User has reason to believe that third parties have obtained such information or may obtain it, the End User must immediately inform Natanael Figueiredo Rodrigues and change their data. Unauthorized third party access to the End User's personal information, account and monetary account in the Game is strictly prohibited. End User agrees and acknowledges that it will not sell, transfer or provide its account, in-game currency account or personal information to any third party.
K. Money paid by the End User for an additional service is not subject to return by Natanael Figueiredo Rodrigues and Natanael Figueiredo Rodrigues will not be responsible for the loss of the End User's game values.
L. The End User agrees, understands and accepts that this game is not a game of chance or for money, contest or betting and that the purchase of additional services is the will and desire of the End User and is not necessary or mandatory to participate in the game. And the game process.
8. DEADLINE.
A. This License is valid until terminated. Licensee may terminate it at any time by destroying the Software Product with all copies, in whole or in part, and removing all of its component parts. Natanael Figueiredo Rodrigues may terminate this Agreement at any time and for any reason. Upon such termination, all licenses granted hereunder will immediately terminate and you must immediately and permanently destroy all copies of the Game in your possession and control and remove the Software Product from your hard drive. The term of this EULA runs concurrently with the period during which you use and retain the Software Product. If the Software Product is transferred (to the extent permitted by this EULA), the license will transfer with it.
B. Your rights under this EULA will automatically terminate without prior notice from Natanael Figueiredo Rodrigues if you fail to comply with any term(s) or condition(s) of this EULA. In this case, no notice will be required by Natanael Figueiredo Rodrigues to effect such termination.
C. Upon termination of this EULA, you shall cease all use of the Software Product and destroy all copies, in whole or in part, together with all backup copies, modifications, printed or written materials and portions merged in any form and remove all the component parts of the Software Product that has been downloaded to your Unit.
9. INTELLECTUAL PROPERTY RIGHTS.
A. As between you and Natanael Figueiredo Rodrigues, Natanael Figueiredo Rodrigues will retain all right, title and interest in the Software Product and any modifications or improvements made thereto, and any updates, upgrades or Documentation provided to End User.
B. You acknowledge the exclusive rights of Natanael Figueiredo Rodrigues over the Software Product – MHS (Math High Speed) and that this Software is unique and original to Natanael Figueiredo Rodrigues and that Natanael Figueiredo Rodrigues is the owner of it. Unless otherwise permitted by law, End User shall not, at any time during or after the Term of the Agreement, contest, directly or indirectly, Natanael Figueiredo Rodrigues' exclusive right and title to the Software Product or validity thereof.
C. You shall not attempt to develop any Software Product that contains the “look and feel” of any Software Product.
D. You expressly agree not to extract information from, reverse engineer, disassemble, decompile or translate the Software Product, or otherwise attempt to derive the source code of the Software Product, except to the extent permitted by any applicable law or permitted by Game rule. If such activities are permitted by applicable law, any information you or your authorized agent discovers will be immediately disclosed to Natanael Figueiredo Rodrigues and will be considered confidential information of Natanael Figueiredo Rodrigues.
10. EXPORT LAW GUARANTEES.
You may not export or re-export the Software Product except as authorized by the laws of the United States and the laws of the jurisdiction in which the Software Product was obtained. In particular, but without limitation, the Software Product may not be exported or re-exported (a) to or from a nation or resident of any country embargoed by the United States or (b) to anyone on the Treasury Department's list of Specially Designated Nationals or the U.S. Department of Commerce's Denied Persons List or Entity List. By installing or using any component of the Software Product, you represent and warrant that you are not located in, under the control of, or a national or resident of any such country or on any such list.
11. DISCLAIMER OF WARRANTIES.
YOU EXPRESSLY ACKNOWLEDGE AND AGREE THAT USE OF THE SOFTWARE PRODUCT IS AT YOUR SOLE RISK AND THAT THE ENTIRE RISK AS TO SATISFACTORY QUALITY, PERFORMANCE AND ACCURACY IS WITH YOU. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SOFTWARE PRODUCT IS PROVIDED “AS IS,” WITH ALL FAULTS AND WITHOUT WARRANTY OF ANY KIND, AND NATANAEL FIGUEIREDO RODRIGUES AND NATANAEL FIGUEIREDO RODRIGUES’ AFFILIATES (REFERRED TO AS “INDIE GAME DEV NATANAEL Figueiredo Rodrigues ”for the purposes of sections 11 and 12) rejects all guarantees and conditions regarding the software product, expressed, implicit or statutory, including, but not limited to implicit guarantees and/or conditions of commercialization, quality SATISFACTORY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, SILENT USE AND NON-INFRINGEMENT OF THIRD PARTY RIGHTS. NATANAEL FIGUEIREDO RODRIGUES DOES NOT WARRANT AGAINST INTERFERENCE WITH YOUR USE OF THE SOFTWARE PRODUCT, THAT THE FUNCTIONS CONTAINED IN THE SOFTWARE PRODUCT WILL MEET YOUR REQUIREMENTS, THAT THE OPERATION OF THE SOFTWARE PRODUCT OR ADDITIONAL SERVICES WILL BE UNINTERRUPTED OR ERROR-FREE, OR THAT DEFECTS NO SOFTWARE PRODUCT WILL BE CORRECTED. NO ORAL OR WRITTEN INFORMATION OR ADVICE GIVEN BY PARADOX OR AN AUTHORIZED REPRESENTATIVE OF PARADOX SHALL CREATE A WARRANTY. SHOULD THE SOFTWARE PRODUCT PROVE DEFECTIVE, YOU ASSUME THE ENTIRE COST OF ALL NECESSARY SERVICING, REPAIR OR CORRECTION. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF IMPLIED WARRANTIES OR LIMITATIONS ON APPLICABLE STATUTORY RIGHTS OF A CONSUMER, SO THE ABOVE EXCLUSION AND LIMITATIONS MAY NOT APPLY TO YOU.
12. LIMITATION OF LIABILITY.
A. To the maximum measure allowed by applicable law, in no case to Natanael Figueiredo Rodrigues, their affiliates or licenses will be responsible for any special, incidental, indirect or consequential damage of any kind (including, without limitation, damage to loss of commercial profits , BUSINESS INTERRUPTION, LOSS OF BUSINESS INFORMATION, LOSS OF CURRENCY AND GAME VALUES OR ANY OTHER PECUNIARY LOSS) ARISING OUT OF THE USE OF OR INABILITY TO USE THE SOFTWARE PRODUCT OR DEFECT IN OR CAUSED BY THE SOFTWARE PRODUCT, INCLUDING BUT NOT LIMITED TO COMPROMISING THE SECURITY OF YOUR DRIVE, OPERATING SYSTEM OR FILES, OR THE PROVISION OR FAILURE TO PROVIDE SUPPORT SERVICES, EVEN IF NATANAEL FIGUEIREDO RODRIGUES HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
B. Natanael Figueiredo Rodrigues is not responsible for: (1) any possible criminal actions committed by the End User; (2) statements by the End User, made or published in the Forums and chats related to the Game, or the behavior of the End User in the Game, including the conduct, manner and ideology of the game characters, managed by the End User, actions of game characters , disrespect towards other end users and their characters in the game; (3) the loss of End Users' means of access to their game accounts (loss of login, password and other information necessary to participate in the Game); and (4) the loss of End User's in-game currency and valuables provided by the Game or purchased by End User.
C. IN ANY CASE, NATANAEL FIGUEIREDO RODRIGUES' TOTAL LIABILITY UNDER ANY PROVISION OF THIS EULA SHALL BE LIMITED EXCLUSIVELY TO THE AMOUNT ACTUALLY PAID BY YOU FOR THE SOFTWARE PRODUCT (EXCLUDING THE AMOUNT PAID BY YOU TO OBTAIN GAME CURRENCY) OR REPLACEMENT OF THE SOFTWARE PRODUCT SOFTWARE WITH PRODUCT OF COMPARABLE RETAIL VALUE, AS NATANAEL FIGUEIREDO RODRIGUES ELECTS IN HIS SOLE DISCRETION; PROVIDED, HOWEVER, IF YOU HAVE ENTERED INTO A SUPPORT SERVICES AGREEMENT, THEN NATANAEL FIGUEIREDO RODRIGUES' ENTIRE LIABILITY WITH RESPECT TO SUPPORT SERVICES SHALL BE GOVERNED BY THE TERMS OF THAT AGREEMENT. BECAUSE SOME STATES AND JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF LIABILITY, THE ABOVE LIMITATION MAY NOT APPLY TO YOU, IN PART OR IN WHOLE.
13. DEFECTS AND SAFETY NOTICE.
A. WITHOUT LIMITING THE FOREGOING, NATANAEL FIGUEIREDO RODRIGUES DOES NOT WARRANT THE CONTINUOUS, ERROR-FREE, SECURE OR VIRUS-FREE OPERATION OF THE SOFTWARE PRODUCT.
B. WARNING: BY INSTALLING AND/OR USING THE SOFTWARE PRODUCT, YOU MAY BE INSTALLING ON YOUR DRIVE SOFTWARE THAT IS OR MAY BE ALLEGED TO COMPROMISE THE SECURITY OF YOUR DRIVE, ITS OPERATING SYSTEM AND FILES. IF AT ANY TIME YOU WISH TO UNINSTALL THE SOFTWARE PRODUCT BECAUSE YOU BELIEVE THAT THE SECURITY OF YOUR DRIVE, OPERATING SYSTEM OR FILES MAY BE OR HAS BEEN COMPROMISED, YOU MAY BE NECESSARY TO RUN A SEPARATE ROUTINE TO UNINSTALL THE FEATURE THAT COULD COMPROMISE YOUR SECURITY. THE DAMAGES THAT YOU MAY RECOVER FOR ANY ALLEGED BREACH OF SECURITY ARE SUBJECT TO THE LIMITATION OF LIABILITY AS SET FORTH HEREIN.
14. INDEMNIFICATION
You agree to indemnify, defend and hold harmless Natanael Figueiredo Rodrigues and its affiliates and their respective officers, employees, directors, agents, licensees (excluding you), sublicensees (excluding you), successors and assigns from and against any and all liabilities, costs , losses, damages and expenses (including reasonable attorneys' fees and expenses) arising from any claim, suit or cause of action relating to and/or arising from (a) your breach of any term of this EULA; (b) your violation of any third party rights; or (c) your use or misuse of the Software Product. Your indemnification obligations set forth in the immediately preceding sentence will survive termination of this EULA.
15. APPLICABLE LAW.
A. Informal Negotiations: To expedite resolution and control the cost of any dispute, controversy or claim related to this EULA (“Dispute”), you and Natanael Figueiredo Rodrigues agree to first attempt to negotiate any Dispute (except those Disputes expressly provided below ) informally for at least thirty (30) days before initiating any arbitration or legal proceeding. This informal negotiation begins with written notification from one person to another. If you have the necessary information, Natanael Figueiredo Rodrigues will attempt to send your notice to your billing address and may send a copy by email to the email address you may provide to us. Notwithstanding the foregoing, you and Natanael Figueiredo Rodrigues agree that the following Disputes are not subject to the above provisions regarding informal negotiations: (1) any Disputes concerning the validity of any of Natanael Figueiredo Rodrigues' intellectual property rights; (2) any Dispute relating to or arising from allegations of theft, piracy, invasion of privacy or unauthorized use; and (3) any request for injunctive relief.
B. Governing Law and Dispute Resolution: This EULA will be governed by and construed in accordance with the laws of Brazil. This EULA will not be governed by the United Nations Convention on Contracts for the International Sale of Goods, the application of which is expressly excluded. By agreeing to these terms and conditions, in the event of any claim you may have arising out of or relating to the Software Product or this EULA, you agree to the exclusive personal and subject matter jurisdiction of the courts located in Campo Verde, Brazil, to make and resolve any claims and hereby waive any right to participate in any type of legal action brought and/or maintained as a class action or class action-like in nature. Natanael Figueiredo Rodrigues reserves the right to make any claim against you and to seek and obtain any legal or equitable remedy against you in any court anywhere in the world.
16. WAIVER AND SEPARABILITY.
Natanael Figueiredo Rodrigues' failure to act with respect to a breach by you or a third party of this EULA does not waive our right to act with respect to subsequent or similar breaches. If for any reason a court of competent jurisdiction finds any provision, or portion thereof, to be unenforceable, the remainder of this EULA will continue in full force and effect.
17. ALL RIGHTS NOT EXPRESSLY GRANTED HEREIN ARE RESERVED BY INDIE GAME DEV NATANAEL FIGUEIREDO RODRIGUES.

1. END USER LICENSE AGREEMENT.
This end user license agreement (“EULA”) is a legal agreement between you (whether an individual or a single entity), hereinafter referred to as “You”, “End User” or “Licensee” and Natanael Figueiredo Rodrigues for the product of MHS (Math High Speed) software accompanying this EULA, which includes video game-related software and may include associated media, printed media, and online or electronic documentation (collectively, “Software Product” or alternatively, the “Game” ) . Any and all use of the Software Product is governed by the terms of this EULA. If you do not agree to the terms of this EULA, you must not install, copy, download or use the Software Product and, in that case, you must contact your supplier regarding its return policy. If you are purchasing this Software Product from a Natanael Figueiredo Rodrigues website or a third-party distributor (a “Site”) and you do not agree, click “disagree/decline”. You agree that your use of the software acknowledges that you have read this agreement, understand it and agree to be bound by its terms and conditions, and that you represent and warrant that you are an adult and are accepting this EULA on behalf of yourself or on behalf of his son or ward, as the case may be. If the End User has not reached the age of majority, they are obliged to obtain the necessary authorization in the form required by law from their parents or other legal representatives.
2. PROPERTY.
It is understood and agreed that, as between you and MHS (Math High Speed), Natanael Figueiredo Rodrigues is the owner of all right titles, proprietary rights, intellectual property rights and interests in and to the Software Product and all copies thereof (including, without limitation, any titles, computer codes, themes, objects, characters, character names, stories, dialogue, catchphrases, locations, concepts, artwork, character inventories, structural designs or landscape design, animations, sounds, musical compositions and recordings, audiovisual effects, plots, character likenesses, methods of operation, moral rights and any related documentation), regardless of the media or form of the original download, whether online, on disk or otherwise. You, as Licensee, by downloading, installing, copying or using this product do not acquire any ownership rights in the Software Product.
3. GENERAL.
The Software Product is licensed, not sold, to you by Natanael Figueiredo Rodrigues for use only under the terms and conditions of this EULA. The Software Product is protected by copyright laws and international copyright treaties, as well as other intellectual property laws and treaties. The rights granted herein are limited to the intellectual property rights of Natanael Figueiredo Rodrigues and its licensors in the Software Product and do not include any other patents or intellectual property rights. The Software Product may contain license management software (also known as digital rights management software) that restricts your use of the Software Product.
4. SOFTWARE PRODUCT.
The Software Product, as used in this EULA, means, individually and/or as applicable:
A. The Software Product package;
B. Any and all content, components, attachments, software, media and code with which this EULA is provided and delivered via disk or website;
C. Any and all game designs, characters, images, graphics, photographs, art, artwork, clip art, text, fonts, music, sounds, voices or other sensory content (the “Game Content”);
D. Related written explanatory materials and instructions and any other possible documentation related thereto (“Documentation”);
E. Updates, modified versions, updates, additions, expansion packs and copies of the Software Product (the “Updates”), if any, provided to you by Natanael Figueiredo Rodrigues under this EULA.
The terms of this EULA will govern any updates provided by Natanael Figueiredo Rodrigues that replace and/or supplement the original Software Product, unless such update is accompanied by a separate license, in which case the terms of that license will prevail.
5. GRANT OF LICENSE AND RESTRICTIONS.
A. Subject to your agreement and continued compliance with this EULA, Natanael Figueiredo Rodrigues grants, and you accept, a limited, non-exclusive, non-transferable end user license to: (1) install the Software Product on your local hard drive(s) ) or other permanent storage media of a computer or other gaming device owned or legitimately controlled by you (each, a “Unit”); and (2) use the Software Product on a single Unit at a time and for non-commercial entertainment purposes only. Licensee may physically transfer the Software Product between Units as long as it is used on only one Unit at a time.
B. Natanael Figueiredo Rodrigues authorizes End User to make one (1) copy of the Software Product as an archival backup copy, provided that End User's backup copy is not installed or used on any Unit. Any other copies you make or authorize violate this EULA.
C. Except as otherwise provided in the Documentation, you shall not display, modify, reproduce and distribute any Game Content, or portion(s) thereof, included in or related to the Software Product, if any. Any authorized display, modification, reproduction and distribution will be in full accordance with this EULA. Under no circumstances will your use, display, modification, reproduction and distribution of the Game Content give you any intellectual property or proprietary rights in the Game Content or in any logos and/or trademarks or service marks of Natanael Figueiredo Rodrigues. All rights, titles and interests belong exclusively to Natanael Figueiredo Rodrigues and its licensors.
D. Except for the initial loading of the Software Product onto a hard drive or other permanent storage media for archival/backup purposes as provided above, you shall not, without the express written consent of Natanael Figueiredo Rodrigues;
I. Copy or reproduce, auction, loan, rent, lease, sublicense, donate or transfer the Software Product;
II. Electronically transfer the Software Product over a LAN (local area network) or file sharing network; or
III. Modify, adapt, translate, reverse engineer, derive source code, disassemble, decompile or create derivative works based on the Software Product or any accompanying materials, except to the extent permitted by any applicable law or permitted by the rules of the Game.
Any use of the Software Product in violation of these limitations will be considered a violation of Natanael Figueiredo Rodrigues' copyright in the Software Product.
E. By accepting the terms of this EULA, you further agree that you will not, under any circumstances:
I. use, develop or sell cheats, automation software (bots), hacks, mods or any other unauthorized third party software designed to modify the Software Product;
II. exploit the Software Product or any part thereof for any commercial purpose, including, without limitation, (a) use in an internet cafe, computer gaming center or any other location-based website; (b) to collect in-game currency, items or resources for sale outside of the Game; or (c) perform in-game services in exchange for payment outside of the Game, for example, power-leveling;
III. remove, disable or circumvent any security safeguards, proprietary notices or labels contained in the Software Product; or
IV. use any obscene, pornographic, provocative or racist language or material in the Forums and chats related to the Game.
Any use of the Software Product in violation of these limitations will be considered a violation of this EULA and will be prosecuted to the fullest extent permitted by law.
6. DESCRIPTION OF OTHER RIGHTS AND LIMITATIONS.
A. From time to time, in Natanael Figueiredo Rodrigues' sole discretion, he may provide you with support services related to the Software Product (“Support Services”). Natanael Figueiredo Rodrigues reserves the right to change, suspend and terminate Support Services at any time and for any reason. You can contact Natanael Figueiredo Rodrigues for support services via email at natanael.rodrigues@edu.mt.gov.br
B. Any supplemental software, code, content or media provided to you in the course of the Support Services will be considered part of the Software Product and will be subject to the terms and conditions of this EULA.
C. You shall not modify, sublicense, assign or transfer the Software Product or any rights under this EULA except as expressly provided in this EULA. Any attempt to sublicense, assign or transfer any of the rights, duties or obligations will be void.
D. Natanael Figueiredo Rodrigues will have the right, at any time, without prior notice to the End User, to: (1) unilaterally suspend or modify the Game process and Game conditions; (2) modify or delete any information posted by the End User in the Forum and chats related to the Game, including statement and statements; and (3) improve or modify the Game, or any part thereof. As a consequence, the End User will be able to participate in the Game in its current version.
E. Natanael Figueiredo Rodrigues does not exchange game values provided in the Game for money or anything else.
F. The End User agrees to take appropriate measures to ensure the security of its Game account and passwords and to prevent unauthorized use thereof by third parties. If the End User has reason to believe that third parties have obtained such information or may obtain it, the End Users must immediately inform Natanael Figueiredo Rodrigues and change their data. Unauthorized third party access to the End User's personal information, account and monetary account in the Game is strictly prohibited. End User agrees and acknowledges that it will not sell, give or transfer its account, in-game currency account or personal information to any third party.
G. Natanael Figueiredo Rodrigues will have the right to collect personal and technical information from the End User, including, but not limited to, age, country of residence, IP address, computer configuration and software usage, which is collected periodically to facilitate the provision of software updates, product support and other services related to the Software Product. Natanael Figueiredo Rodrigues may use this information to improve its products or provide services or technologies to the End User. Such information will not be sold or transferred to third parties without the End User's prior consent.
7. ADDITIONAL SERVICES.
“Additional Services” means providing the User with additional and special features in the game for a fee under the conditions specified in this Agreement. Additional services are not a necessary condition for participation in the Game and are provided only upon request by the End User. Additional services consist of in-game currency that can be acquired by the End User in the game and in-game values that can be provided only when the End User is in the game. As a condition of using additional services, End User acknowledges and agrees that:
A. No one under the age of 18 is allowed to purchase in-game currency. If it becomes known to Natanael Figueiredo Rodrigues that an End User under the age of 18 has purchased any currency in the game, Natanael Figueiredo Rodrigues has the right to immediately delete that End User's account and the entire account balance will be considered lost.
B. A maximum limit of three thousand US dollars ($3,000.00) applies to the in-game currency that can be purchased in total per week by an End User.
C. If the End User does not enter the game by “logging in” to their account for a period of three hundred and sixty-five (365) days, Natanael Figueiredo Rodrigues has the right to immediately delete the End User's account and the entire balance of the account. and game currency will be considered abandoned and lost.
D. Natanael Figueiredo Rodrigues does not exchange game values obtained from the services provided, including game currency, for cash or non-monetary money.
E. The list and cost of additional services and the methods and conditions for purchasing game currency are published by Steam. For policies and procedures of payment systems used to purchase in-game currency, End User should refer to Section 4 of the Steam Subscription Agreement ( www.steampowered.com/agreement/ ) and contact the legal holders of such systems of payment. Natanael Figueiredo Rodrigues does not provide any explanation to the End User about the rules and procedures of such payment systems, nor does it provide any monetary compensation to the End User who carried out fund transfer operations to purchase game currency using the payment systems. , if so the payments failed and as a result the money was not received by Steam or Natanael Figueiredo Rodrigues. Notwithstanding the foregoing, the End User is obliged to maintain documents proving payment for additional services throughout the period in which the End User remains in the game and, if such documents are requested by Natanael Figueiredo Rodrigues, the End User must provide them.
F. If you choose to use additional services, you will be obliged to indicate in your Steam account the following data: name, surname, date of birth, billing information and other information requested by Steam that will allow Natanael Figueiredo Rodrigues, if necessary, to identify the real person with the user account in the game. End Users will be solely responsible for the accuracy, completeness, reliability and correctness of their personal data registered in their Game account.
G. If Natanael Figueiredo Rodrigues has reason to believe that the End User carries out illegal activities or fraud related to payments for additional services in the Game, Natanael Figueiredo Rodrigues has the right to send relevant information to law enforcement agencies to investigate these facts.
H. If Natanael Figueiredo Rodrigues has reason to believe or suspect that the End User is exploiting any defects in the Game or maliciously using any third party software to increase its amount of in-game currency, or if Natanael Figueiredo Rodrigues has reason to believe that If the increase in game currency originates from a system failure, Natanael Figueiredo Rodrigues has the right to immediately delete the End User's account and the entire account balance will be considered lost.
I. If the End User is prohibited from receiving online gaming services by the legislation of its country or in the case of any other legal restrictions, including age restrictions, the End User will not be permitted to use the Game or individual services in the Game . In this case, the End User will be solely responsible for the use of the Game in the territory of their country, in accordance with local laws.
J. End User agrees to take appropriate measures to ensure the security of their Game account and passwords and to prevent unauthorized use thereof by third parties in accordance with Section 1 of the Steam Subscription Agreement. If the End User has reason to believe that third parties have obtained such information or may obtain it, the End User must immediately inform Natanael Figueiredo Rodrigues and change their data. Unauthorized third party access to the End User's personal information, account and monetary account in the Game is strictly prohibited. End User agrees and acknowledges that it will not sell, transfer or provide its account, in-game currency account or personal information to any third party.
K. Money paid by the End User for an additional service is not subject to return by Natanael Figueiredo Rodrigues and Natanael Figueiredo Rodrigues will not be responsible for the loss of the End User's game values.
L. The End User agrees, understands and accepts that this game is not a game of chance or for money, contest or betting and that the purchase of additional services is the will and desire of the End User and is not necessary or mandatory to participate in the game. And the game process.
8. DEADLINE.
A. This License is valid until terminated. Licensee may terminate it at any time by destroying the Software Product with all copies, in whole or in part, and removing all of its component parts. Natanael Figueiredo Rodrigues may terminate this Agreement at any time and for any reason. Upon such termination, all licenses granted hereunder will immediately terminate and you must immediately and permanently destroy all copies of the Game in your possession and control and remove the Software Product from your hard drive. The term of this EULA runs concurrently with the period during which you use and retain the Software Product. If the Software Product is transferred (to the extent permitted by this EULA), the license will transfer with it.
B. Your rights under this EULA will automatically terminate without prior notice from Natanael Figueiredo Rodrigues if you fail to comply with any term(s) or condition(s) of this EULA. In this case, no notice will be required by Natanael Figueiredo Rodrigues to effect such termination.
C. Upon termination of this EULA, you shall cease all use of the Software Product and destroy all copies, in whole or in part, together with all backup copies, modifications, printed or written materials and portions merged in any form and remove all the component parts of the Software Product that has been downloaded to your Unit.
9. INTELLECTUAL PROPERTY RIGHTS.
A. As between you and Natanael Figueiredo Rodrigues, Natanael Figueiredo Rodrigues will retain all right, title and interest in the Software Product and any modifications or improvements made thereto, and any updates, upgrades or Documentation provided to End User.
B. You acknowledge the exclusive rights of Natanael Figueiredo Rodrigues over the Software Product – MHS (Math High Speed) and that this Software is unique and original to Natanael Figueiredo Rodrigues and that Natanael Figueiredo Rodrigues is the owner of it. Unless otherwise permitted by law, End User shall not, at any time during or after the Term of the Agreement, contest, directly or indirectly, Natanael Figueiredo Rodrigues' exclusive right and title to the Software Product or validity thereof.
C. You shall not attempt to develop any Software Product that contains the “look and feel” of any Software Product.
D. You expressly agree not to extract information from, reverse engineer, disassemble, decompile or translate the Software Product, or otherwise attempt to derive the source code of the Software Product, except to the extent permitted by any applicable law or permitted by Game rule. If such activities are permitted by applicable law, any information you or your authorized agent discovers will be immediately disclosed to Natanael Figueiredo Rodrigues and will be considered confidential information of Natanael Figueiredo Rodrigues.
10. EXPORT LAW GUARANTEES.
You may not export or re-export the Software Product except as authorized by the laws of the United States and the laws of the jurisdiction in which the Software Product was obtained. In particular, but without limitation, the Software Product may not be exported or re-exported (a) to or from a nation or resident of any country embargoed by the United States or (b) to anyone on the Treasury Department's list of Specially Designated Nationals or the U.S. Department of Commerce's Denied Persons List or Entity List. By installing or using any component of the Software Product, you represent and warrant that you are not located in, under the control of, or a national or resident of any such country or on any such list.
11. DISCLAIMER OF WARRANTIES.
YOU EXPRESSLY ACKNOWLEDGE AND AGREE THAT USE OF THE SOFTWARE PRODUCT IS AT YOUR SOLE RISK AND THAT THE ENTIRE RISK AS TO SATISFACTORY QUALITY, PERFORMANCE AND ACCURACY IS WITH YOU. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SOFTWARE PRODUCT IS PROVIDED “AS IS,” WITH ALL FAULTS AND WITHOUT WARRANTY OF ANY KIND, AND NATANAEL FIGUEIREDO RODRIGUES AND NATANAEL FIGUEIREDO RODRIGUES’ AFFILIATES (REFERRED TO AS “INDIE GAME DEV NATANAEL Figueiredo Rodrigues ”for the purposes of sections 11 and 12) rejects all guarantees and conditions regarding the software product, expressed, implicit or statutory, including, but not limited to implicit guarantees and/or conditions of commercialization, quality SATISFACTORY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, SILENT USE AND NON-INFRINGEMENT OF THIRD PARTY RIGHTS. NATANAEL FIGUEIREDO RODRIGUES DOES NOT WARRANT AGAINST INTERFERENCE WITH YOUR USE OF THE SOFTWARE PRODUCT, THAT THE FUNCTIONS CONTAINED IN THE SOFTWARE PRODUCT WILL MEET YOUR REQUIREMENTS, THAT THE OPERATION OF THE SOFTWARE PRODUCT OR ADDITIONAL SERVICES WILL BE UNINTERRUPTED OR ERROR-FREE, OR THAT DEFECTS NO SOFTWARE PRODUCT WILL BE CORRECTED. NO ORAL OR WRITTEN INFORMATION OR ADVICE GIVEN BY PARADOX OR AN AUTHORIZED REPRESENTATIVE OF PARADOX SHALL CREATE A WARRANTY. SHOULD THE SOFTWARE PRODUCT PROVE DEFECTIVE, YOU ASSUME THE ENTIRE COST OF ALL NECESSARY SERVICING, REPAIR OR CORRECTION. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF IMPLIED WARRANTIES OR LIMITATIONS ON APPLICABLE STATUTORY RIGHTS OF A CONSUMER, SO THE ABOVE EXCLUSION AND LIMITATIONS MAY NOT APPLY TO YOU.
12. LIMITATION OF LIABILITY.
A. To the maximum measure allowed by applicable law, in no case to Natanael Figueiredo Rodrigues, their affiliates or licenses will be responsible for any special, incidental, indirect or consequential damage of any kind (including, without limitation, damage to loss of commercial profits , BUSINESS INTERRUPTION, LOSS OF BUSINESS INFORMATION, LOSS OF CURRENCY AND GAME VALUES OR ANY OTHER PECUNIARY LOSS) ARISING OUT OF THE USE OF OR INABILITY TO USE THE SOFTWARE PRODUCT OR DEFECT IN OR CAUSED BY THE SOFTWARE PRODUCT, INCLUDING BUT NOT LIMITED TO COMPROMISING THE SECURITY OF YOUR DRIVE, OPERATING SYSTEM OR FILES, OR THE PROVISION OR FAILURE TO PROVIDE SUPPORT SERVICES, EVEN IF NATANAEL FIGUEIREDO RODRIGUES HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
B. Natanael Figueiredo Rodrigues is not responsible for: (1) any possible criminal actions committed by the End User; (2) statements by the End User, made or published in the Forums and chats related to the Game, or the behavior of the End User in the Game, including the conduct, manner and ideology of the game characters, managed by the End User, actions of game characters , disrespect towards other end users and their characters in the game; (3) the loss of End Users' means of access to their game accounts (loss of login, password and other information necessary to participate in the Game); and (4) the loss of End User's in-game currency and valuables provided by the Game or purchased by End User.
C. IN ANY CASE, NATANAEL FIGUEIREDO RODRIGUES' TOTAL LIABILITY UNDER ANY PROVISION OF THIS EULA SHALL BE LIMITED EXCLUSIVELY TO THE AMOUNT ACTUALLY PAID BY YOU FOR THE SOFTWARE PRODUCT (EXCLUDING THE AMOUNT PAID BY YOU TO OBTAIN GAME CURRENCY) OR REPLACEMENT OF THE SOFTWARE PRODUCT SOFTWARE WITH PRODUCT OF COMPARABLE RETAIL VALUE, AS NATANAEL FIGUEIREDO RODRIGUES ELECTS IN HIS SOLE DISCRETION; PROVIDED, HOWEVER, IF YOU HAVE ENTERED INTO A SUPPORT SERVICES AGREEMENT, THEN NATANAEL FIGUEIREDO RODRIGUES' ENTIRE LIABILITY WITH RESPECT TO SUPPORT SERVICES SHALL BE GOVERNED BY THE TERMS OF THAT AGREEMENT. BECAUSE SOME STATES AND JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF LIABILITY, THE ABOVE LIMITATION MAY NOT APPLY TO YOU, IN PART OR IN WHOLE.
13. DEFECTS AND SAFETY NOTICE.
A. WITHOUT LIMITING THE FOREGOING, NATANAEL FIGUEIREDO RODRIGUES DOES NOT WARRANT THE CONTINUOUS, ERROR-FREE, SECURE OR VIRUS-FREE OPERATION OF THE SOFTWARE PRODUCT.
B. WARNING: BY INSTALLING AND/OR USING THE SOFTWARE PRODUCT, YOU MAY BE INSTALLING ON YOUR DRIVE SOFTWARE THAT IS OR MAY BE ALLEGED TO COMPROMISE THE SECURITY OF YOUR DRIVE, ITS OPERATING SYSTEM AND FILES. IF AT ANY TIME YOU WISH TO UNINSTALL THE SOFTWARE PRODUCT BECAUSE YOU BELIEVE THAT THE SECURITY OF YOUR DRIVE, OPERATING SYSTEM OR FILES MAY BE OR HAS BEEN COMPROMISED, YOU MAY BE NECESSARY TO RUN A SEPARATE ROUTINE TO UNINSTALL THE FEATURE THAT COULD COMPROMISE YOUR SECURITY. THE DAMAGES THAT YOU MAY RECOVER FOR ANY ALLEGED BREACH OF SECURITY ARE SUBJECT TO THE LIMITATION OF LIABILITY AS SET FORTH HEREIN.
14. INDEMNIFICATION
You agree to indemnify, defend and hold harmless Natanael Figueiredo Rodrigues and its affiliates and their respective officers, employees, directors, agents, licensees (excluding you), sublicensees (excluding you), successors and assigns from and against any and all liabilities, costs , losses, damages and expenses (including reasonable attorneys' fees and expenses) arising from any claim, suit or cause of action relating to and/or arising from (a) your breach of any term of this EULA; (b) your violation of any third party rights; or (c) your use or misuse of the Software Product. Your indemnification obligations set forth in the immediately preceding sentence will survive termination of this EULA.
15. APPLICABLE LAW.
A. Informal Negotiations: To expedite resolution and control the cost of any dispute, controversy or claim related to this EULA (“Dispute”), you and Natanael Figueiredo Rodrigues agree to first attempt to negotiate any Dispute (except those Disputes expressly provided below ) informally for at least thirty (30) days before initiating any arbitration or legal proceeding. This informal negotiation begins with written notification from one person to another. If you have the necessary information, Natanael Figueiredo Rodrigues will attempt to send your notice to your billing address and may send a copy by email to the email address you may provide to us. Notwithstanding the foregoing, you and Natanael Figueiredo Rodrigues agree that the following Disputes are not subject to the above provisions regarding informal negotiations: (1) any Disputes concerning the validity of any of Natanael Figueiredo Rodrigues' intellectual property rights; (2) any Dispute relating to or arising from allegations of theft, piracy, invasion of privacy or unauthorized use; and (3) any request for injunctive relief.
B. Governing Law and Dispute Resolution: This EULA will be governed by and construed in accordance with the laws of Brazil. This EULA will not be governed by the United Nations Convention on Contracts for the International Sale of Goods, the application of which is expressly excluded. By agreeing to these terms and conditions, in the event of any claim you may have arising out of or relating to the Software Product or this EULA, you agree to the exclusive personal and subject matter jurisdiction of the courts located in Campo Verde, Brazil, to make and resolve any claims and hereby waive any right to participate in any type of legal action brought and/or maintained as a class action or class action-like in nature. Natanael Figueiredo Rodrigues reserves the right to make any claim against you and to seek and obtain any legal or equitable remedy against you in any court anywhere in the world.
16. WAIVER AND SEPARABILITY.
Natanael Figueiredo Rodrigues' failure to act with respect to a breach by you or a third party of this EULA does not waive our right to act with respect to subsequent or similar breaches. If for any reason a court of competent jurisdiction finds any provision, or portion thereof, to be unenforceable, the remainder of this EULA will continue in full force and effect.
17. ALL RIGHTS NOT EXPRESSLY GRANTED HEREIN ARE RESERVED BY INDIE GAME DEV NATANAEL FIGUEIREDO RODRIGUES.
