This EULA ("End User License Agreement" or "Agreement") is a legal agreement between YOU (the "Individual") and Chromosphere Games (the "Company") for the accompanying software product (and any associated media or electronic documentation). By installing, opening, copying or using the software, you acknowledge that you have read this EULA and agree to its terms. If you do not accept or agree to the terms of this EULA, do not install or use the software.
Chromosphere Games grants you a non-exclusive, non-transferable license to use the software. This software (and any associated media or documentation) is licensed, not sold, for your personal, non-commercial use. You may not transfer, distribute, or rent the software (or media).
You expressly agree that use of the software is at your sole risk. Chromosphere Games assumes no responsibility for any damages suffered by you, including, but not limited to, loss of data, items or other materials from errors or other malfunctions caused by the Software. Chromosphere Games shall not be liable for any indirect, incidental, special, punitive, exemplary, or consequential damages resulting hereunder in any manner. Furthermore, you agree to defend, indemnify and hold harmless Chromosphere Games from all damages, losses, liabilities, claims and expenses, including attorneys’ fees, arising directly or indirectly from your acts and omissions to act in using the Software.
