Account Registration and Eligibility
To register a Game Account and access parts of our Products, you must be at least the legal minimum age for agreeing to the gathering of personal information in your country.
If you are between the minimum age for collecting personal information and the age of majority in your jurisdiction, your parent or guardian must review and approve this EULA on your behalf. When using our Products, parents and guardians are liable for the actions of their children under the age of 18.
It is important that you give us with accurate, full, and up-to-current information for your Game Account, and that you agree to keep such information up to date. If you do not, we reserve the right to suspend or delete your Game Account..
You may not sell, resell, rent, lease, share, or provide anyone else access to your Game Account. We reserve all legal rights and remedies to prohibit illegal use of our Services, including but not limited to technological barriers, IP mapping, and, in extreme situations, directly contacting your Internet Service Provider (ISP) about such unlawful use.
You may not establish a Game Account for someone else or in a name other than your own.
Prohibited Activites
Use them commercially, for promotional purposes, for the benefit of any third party, or in any other way prohibited by this EULA.
Use or distribute any unauthorized third-party applications that intercept, imitate, or divert any communication between the Services and us, or that gather Game-related information.
Use or provide ancillary offerings to anyone that are not provided by us such as hosting, "leveling" services, mirroring our servers, matchmaking, emulation, communication redirects, mods, hacks, cheats, bots (or any other automated control), trainers and automation programs that interact in any way with the Services, tunneling, third-party program add-ons, and any interference with online or network play.Access or use them on more than one device at a time;
Copy, duplicate, distribute, display, mirror, frame, or use them (or any of our other materials, intellectual property, or proprietary information) in any way not specifically permitted by this EULA.
Sell, rent, lease, license, distribute, or otherwise transfer the Services, Game, or any Content, including Virtual Goods or Game Currency, including participating in or operating so-called "secondary markets" for Virtual Goods, Game Currency, or Content.
Attempt to probe, scan, or test its vulnerability, or circumvent any security or authentication procedures in order to access, tamper with, or use non-public portions of the Services.
Trespass, or attempt to gain access to a property or location where you do not have permission to be or engage in any activity that may result in injury, death, property damage, nuisance or other liability.
Upload, publish, submit, or transmit any User Content, create a user name or account name, or engage in any other activity that:
infringes, misappropriates or violates a third party’s patent, copyright, trademark, trade secret, contractual rights, moral rights or other intellectual property rights, or rights of publicity or privacy, or any other rights of third parties.
violates, or encourages any conduct that would violate any applicable law or regulation or would give rise to civil liability.
is fraudulent, false, misleading or deceptive.
is grossly harmful, racially or ethnically objectionable, disparaging, blasphemous, libelous, defamatory, obscene, pornographic, paedophilic, vulgar or offensive.
promotes discrimination, bigotry, racism, hatred, harassment or harm against any individual or group.
is violent, bullying, or threatening or promotes violence, money laundering or gambling, terrorism, or actions that are threatening or disrespectful to any person or entity.
harms minors in any way or
promotes illegal or harmful activities or substances.
Interfere with or attempt to interfere with any user's, host's, or network's access, including, but not limited to, spreading a virus, overloading, flooding, spamming, or mail-bombing the Services or any of its users.
Collect or keep any information from the Services that could be used to identify an individual, either alone or in combination with other information, from other users of the Services without their express permission
Engage in conduct that, in our sole discretion, is detrimental to other users' enjoyment of the Services, including, without limitation, harassment, use of abusive or offensive language, game abandonment, game sabotage, spamming, disruptive behavior, social engineering, or scamming, or conduct that is contrary to public morals or public policy.
Use IP proxying or other means to conceal your location, whether to circumvent regional restrictions on the Services or for any other reason.
Play on another person's Game Account to "boost" the status, level, or rank of that Game Account.
Use the Services in any way that would affect us adversely or reflect negatively on us or the Services or discourage any person from using all or any portion of the features of the Services.
Encourage, promote, take part in or enable anyone else to do any of the foregoing or breach any applicable law or regulation.
Virtual Goods and In-Game Purchases
We may provide you with various opportunities to acquire a limited license to access Game Currency or Virtual Goods, including:
By purchasing it (for example, with a credit card)
By earning it (for example, by completing game missions or activities).or
By receiving it (for example, as a gift from another player)
Regardless of how you obtained access to the Virtual Goods, you have no ownership or other property interest in it. There is no monetary value to Virtual Goods. Virtual Goods cannot be transferred or redeemed for "real world" money. There are no refunds available for acquiring a license to access Virtual Goods.
Some features of the Virtual Goods may require you to pay a fee, and you agree to give us or the third-party payment provider we use with correct and complete payment information. You also agree to pay any and all fees and taxes incurred on your account.
You are entirely responsible for paying all applicable taxes in connection with the acquisition, use, or access to Virtual Goods or Game Currency.
User Content
You grant us a worldwide, perpetual, irrevocable, sublicenseable, non-exclusive and royalty-free right and license to use, reproduce, distribute, adapt, modify, translate, create derivative works based on, publicly perform, publicly display, digitally perform, make, have made, and import Your Content, including all copyrights, publicity rights, trademarks, trade secrets, patents, industrial rights, and all other intellectual property rights.
You represent, warrant, and agree that none of Your Content will be subject to any confidentiality, attribution, or other obligation on the part of VSI, and that VSI will not be liable for any use or disclosure of Your Content.
You further represent, warrant and agree that Your Content shall not violate any third-party rights.
Termination and Supension
To the fullest extent permitted by applicable law, we reserve the right to suspend, modify, or terminate your access to and use of the Services, including any Game, Virtual Goods, and Content, with no obligation or notice to you if:
You violate any of the conditions of this EULA (including the App Store Agreement(s) and our other policies outlined in this EULA).
The owner of the applicable App Store terminates your App Store Account or
We otherwise deem it necessary to suspend or modify your access to and use of the Services or terminate this EULA in our sole discretion.
You may also terminate this EULA by deleting and uninstalling the Game from all of your devices, as well as by deleting your App Store Account.
Limitation of Liability
We are not liable for any business losses (including any loss of profit, loss of business, business disruption, loss of goodwill, or loss of business opportunity), including:
any loss that was not foreseen when you agreed to these Terms, or
any loss that we both understood would occur solely as a result of your unique circumstances at the time you signed into these Terms (including all indirect damages).
Regardless of anything else in these Terms, we do not exclude or restrict our duty to you in any manner where it would be illegal to do so, including our liability for:
death or personal injury as a result of our negligence.
our fraud or fraudulent misrepresentation.
deliberate or severely negligent conduct.
damage resulting from a negligent breach of a contract-essential commitment to the degree that it is normal and foreseeable.
for any guarantee given by us to you or
for any liability under a jurisdiction’s applicable product liability legislation
Modification Term of Use
We may release patches, updates, or upgrades to the Services that you must install in order to continue using them.
We may update the Services remotely without notifying you, and you agree to such patches, updates, and upgrades being applied. If your device is capable of blocking automatic updates, you may be unable to access the Services until you manually update the Services on your device.
We reserve the right to change, suspend, discontinue, substitute, replace, or restrict your access to any feature of the Services at any time. You acknowledge that, subject to applicable law, any character data, game progress, game customization, or other data related to your use of any particular Game and other elements unique to the Services may cease to be available to you at any time without notice from us, including, without limitation, after we apply a patch, update, or upgrade. You accept that we have no responsibility to provide maintenance or support for the Services.
We reserve the right to adjust the price of the Services, Games, Virtual Goods, Game Currency, or Content at any time and for any reason, with or without notice to you.
Governing Law and Dispute Resolution
This EULA agreement, and any dispute arising out of or in connection with this EULA agreement, shall be governed by and construed in accordance with the Indonesia Law.
