End User License Agreement (EULA)
1. Parties
This End User License Agreement ("EULA") is a legally binding agreement between Hüseyin Özbey, hereinafter referred to as the "Owner" or "Licensor," and the individual or entity using the software, hereinafter referred to as the "User" or "Licensee."
2. Definitions
(a) "Software" refers to the game 'Chill of Death's: Breath,' including all related files, documentation, and any updates or modifications provided by the Owner.
(b) "License Key" refers to the unique code or key provided to the User for the activation of the Software.
(c) "User Content" refers to any content or data created, uploaded, or shared by the User within the Software.
3. License Grant
(a) The Owner grants the User a non-exclusive, non-transferable, revocable license to use the Software and any updates or modifications for personal, non-commercial purposes, subject to the terms and conditions outlined in this EULA.
(b) The User acknowledges that the Software is the property of the Owner and is protected by copyright laws and international treaties.
4. Restrictions
(a) The User shall not sublicense, sell, distribute, or transfer the Software to any third party without prior written consent from the Owner.
(b) The User shall not modify, reverse engineer, decompile, or disassemble the Software.
(c) The User shall not use the Software for any unlawful, unethical, or harmful purpose.
5. Ownership
(a) The User acknowledges that the Owner retains all rights, title, and interest in and to the Software, including all intellectual property rights.
(b) User Content created within the Software remains the property of the User.
6. Updates
The Owner may provide updates or modifications to the Software at their discretion. The User agrees to install and use such updates to maintain compatibility and security.
7. Termination
(a) The Owner reserves the right to terminate this EULA if the User breaches any of its terms.
(b) Upon termination, the User must cease all use of the Software and destroy any copies in their possession.
8. Limitation of Liability
(a) To the fullest extent permitted by law, the Owner shall not be liable for any direct, indirect, incidental, consequential, or punitive damages arising out of the use or inability to use the Software.
(b) The User agrees to use the Software at their own risk.
9. Governing Law
This EULA shall be governed by and construed in accordance with the laws of Turkey.
10. Entire Agreement
This EULA constitutes the entire agreement between the Owner and the User and supersedes all prior agreements and understandings.
By installing or using the Software, the User agrees to be bound by the terms and conditions of this EULA.
