Departed Away End User License Agreement (EULA)
This End User License Agreement ("EULA") is a legal agreement between you ("Licensee" or "you") Alperen Torun ("Licensor" or "I") for the use of the video game software titled Departed Away ("Software") and any associated materials.
BY INSTALLING, COPYING, OR OTHERWISE USING THE SOFTWARE, YOU AGREE TO BE BOUND BY THE TERMS OF THIS EULA. IF YOU DO NOT AGREE TO THE TERMS OF THIS EULA, DO NOT INSTALL OR USE THE SOFTWARE.
1. License Grant:
Subject to your compliance with the terms and conditions of this EULA, Licensor grants you a non-exclusive, non-transferable, revocable license to install and use the Software for personal, non-commercial use on a single computer or gaming console, solely for the purpose of playing the game.
2. Intellectual Property:
The Software, including all its content, artwork, characters, music, and any other materials associated with the game, is the property of the Licensor and is protected by copyright and other intellectual property laws. You shall not, under any circumstances, reverse engineer, modify, distribute, sell, rent, lease, or exploit the Software or any part of it without prior written consent from the Licensor.
3. User Content:
You may have the option to create or upload content within the Software ("User Content"). By doing so, you grant the Licensor a non-exclusive, worldwide, royalty-free license to use, reproduce, modify, adapt, publish, translate, and distribute your User Content in connection with the Software and any related marketing materials.
4. Termination:
This EULA is effective until terminated. Licensor may terminate this license at any time if you fail to comply with any of the terms and conditions herein. Upon termination, you must immediately cease all use of the Software and destroy all copies in your possession.
5. Limited Warranty and Disclaimer:
THE SOFTWARE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NONINFRINGEMENT. LICENSOR DOES NOT WARRANT THAT THE SOFTWARE WILL BE ERROR-FREE OR UNINTERRUPTED, OR THAT ANY DEFECTS WILL BE CORRECTED.
6. Limitation of Liability:
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL LICENSOR BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO, DAMAGES FOR LOSS OF PROFITS, GOODWILL, DATA, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF THE USE OR INABILITY TO USE THE SOFTWARE.
7. Governing Law:
This EULA shall be governed by and construed in accordance with the laws of Turkey, without regard to its conflicts of law principles.
8. Entire Agreement:
This EULA constitutes the entire agreement between you and the Licensor concerning the subject matter hereof and supersedes all prior and contemporaneous oral or written agreements and understandings.
