END USER LICENSE AGREEMENT
1. INTRODUCTION
This End User License Agreement ("EULA") is a legal agreement between you ("User") and Screaming Cat Studios Ltd ("Company"), located at The Bristol Office, 2nd Floor, 5 High Street, Westbury on Trym, Bristol, England, BS9 3BY. By downloading, installing, or using the video game "The Unseen" ("Game"), you agree to be bound by the terms of this EULA.
2. LICENSE GRANT
The Company grants you a non-exclusive, non-transferable, perpetual license to use the Game for personal, non-commercial purposes, subject to the terms and conditions set forth in this EULA. This license is granted solely for single-user use and excludes use with Steam Family Sharing.
3. LICENSE RESTRICTIONS
You may not:
Reverse engineer, decompile, disassemble, or create derivative works based on the Game, except for modding purposes as permitted by the Company.
Redistribute, sublicense, rent, lease, or lend the Game.
Use the Game in any manner that violates any applicable laws or regulations.
4. OWNERSHIP
The Game and all associated intellectual property rights are the exclusive property of the Company. This EULA does not grant you any ownership interest in the Game.
5. USER RESPONSIBILITIES
You are responsible for ensuring that your use of the Game complies with the terms of this EULA and all applicable laws and regulations.
6. UPDATES AND PATCHES
The Company may release updates and patches for the Game based on community feedback and regular update schedules. These updates and patches may be automatically installed without prior notice.
7. TERMINATION
This EULA is effective until terminated. The Company may terminate this EULA immediately if you fail to comply with any term herein. Additionally, this EULA will terminate automatically if the Company ceases trading or if the Game is removed from Steam. Upon termination, you must destroy all copies of the Game in your possession.
8. WARRANTIES AND DISCLAIMERS
The Game is provided "as is" without any warranties of any kind. The Company does not warrant that the Game will be error-free, accurate, or meet your requirements. Any implied warranties, including those of merchantability, fitness for a particular purpose, and non-infringement, are hereby disclaimed to the fullest extent permitted by law.
9. LIMITATION OF LIABILITY
To the maximum extent permitted by law, neither the Company nor any other party involved in creating, producing, or delivering the Game, services, or content will be liable for any personal injury, incidental, special, exemplary, or consequential damages, including lost profits, loss of data, or goodwill, service interruption, computer damage, or system failure or the cost of substitute services arising out of or in connection with this EULA or from the use of or inability to use the Game, services, or content, whether based on warranty, contract, tort (including negligence), or any other legal theory.
10. INDEMNITY
You agree to indemnify, defend, and hold harmless the Company, its affiliates, officers, directors, employees, agents, licensors, and suppliers from and against all claims, losses, liabilities, expenses, damages, and costs, including reasonable attorneys' fees, arising out of or relating to your use or misuse of the Game, your violation of this EULA, or your infringement of any intellectual property or other right of any person or entity.
11. GOVERNING LAW
This EULA shall be governed by and construed in accordance with the laws of England and Wales. Any disputes arising out of or in connection with this EULA shall be subject to the exclusive jurisdiction of the courts of England and Wales.
12. MISCELLANEOUS
Dispute Resolution: Any disputes arising under this EULA shall be resolved through good faith negotiations. If such negotiations fail, either party may pursue alternative dispute resolution mechanisms.
Severability: If any provision of this EULA is found to be unenforceable, the remainder of the EULA shall remain in full force and effect.
Amendments: The Company reserves the right to amend this EULA at any time. Amendments will be effective upon the posting of an updated version on the Company's website or through the Game.
13. ACCEPTANCE
By downloading, installing, or using the Game, you acknowledge that you have read, understood, and agree to be bound by the terms and conditions of this EULA.
