End-User License Agreement (EULA) for Nephilim Uprising
This End-User License Agreement ("Agreement") is entered into between you ("End User") and RealityPatch Studios LLC ("RealityPatch Studios," "we," or "us") regarding the game Nephilim Uprising (the "Game").
By installing, accessing, or using the Game, you agree to be bound by the terms and conditions of this Agreement. If you do not agree to the terms of this Agreement, do not install, access, or use the Game.
License Grant 1.1 License: Subject to your compliance with the terms of this Agreement, RealityPatch Studios grants you a limited, non-exclusive, non-transferable, revocable license to install, access, and use the Game for personal, non-commercial purposes.
1.2 Restrictions: You shall not: a) Copy, reproduce, or distribute the Game or any portion thereof; b) Modify, adapt, translate, reverse engineer, decompile, disassemble, or create derivative works based on the Game; c) Remove, alter, or obscure any copyright, trademark, or other proprietary rights notice on or in the Game; d) Use the Game for any illegal or unauthorized purpose or in any manner that violates applicable laws or regulations; e) Use the Game to harm, harass, or jeopardize the safety and well-being of others; f) Sell, rent, lease, sublicense, or otherwise transfer your rights to the Game; g) Interfere with or disrupt the integrity or performance of the Game or any related services; h) Attempt to gain unauthorized access to the Game or its related systems or networks.
Ownership 2.1 Ownership: The Game is licensed, not sold, to you. RealityPatch Studios retains all right, title, and interest in the Game, including all intellectual property rights therein. This Agreement does not grant you any ownership rights to the Game.
2.2 Feedback: You may provide us with suggestions, feedback, or ideas for improvements to the Game ("Feedback"). However, any Feedback you provide shall be the sole property of RealityPatch Studios, and you hereby assign to us all right, title, and interest in and to such Feedback. You acknowledge the possibility that RealityPatch Studios may already be working on a similar concept or idea.
Termination 3.1 Termination: This Agreement is effective until terminated. RealityPatch Studios may terminate this Agreement without notice if you fail to comply with any of its terms. Upon termination, you shall cease all use of the Game and promptly uninstall and delete all copies of the Game in your possession.
Disclaimer of Warranty 4.1 No Warranty: THE GAME IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, REALITYPATCH STUDIOS DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. REALITYPATCH STUDIOS DOES NOT WARRANT THAT THE GAME WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE FROM HARMFUL COMPONENTS.
Limitation of Liability 5.1 Limitation of Liability: TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL REALITYPATCH STUDIOS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, OR CONSEQUENTIAL DAMAGES ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE GAME, INCLUDING, BUT NOT LIMITED TO, ANY LOSS OF DATA, PROFITS, REVENUE, OR BUSINESS INTERRUPTION, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR AGGREGATE LIABILITY FOR ANY CLAIMS ARISING OUT OF OR RELATED TO THIS AGREEMENT SHALL NOT EXCEED THE AMOUNT PAID BY YOU FOR THE GAME.
Governing Law 6.1 Governing Law: This Agreement shall be governed by and construed in accordance with the laws of [Your Country/State], without regard to its conflict of laws principles.
Miscellaneous 7.1 Entire Agreement: This Agreement constitutes the entire agreement between you and RealityPatch Studios regarding the Game and supersedes all prior or contemporaneous agreements, understandings, or representations.
7.2 Severability: If any provision of this Agreement is held to be invalid or unenforceable, such provision shall be struck, and the remaining provisions shall be enforced to the fullest extent permitted by applicable law.
7.3 Modification: RealityPatch Studios reserves the right to modify this Agreement at any time, and your continued use of the Game after any modifications shall constitute your acceptance of the modified Agreement.
