1. Legal Contract
This End User License Agreement ("EULA") is a legal contract between you and Sven Steinmetz, Ppinstraße 47, 81249 Munich (hereafter "us") that governs your use of the Software Product. For the purposes of this EULA, includes the term Software Product computer software owned by us and manuals, online or other documentation together with any updates or patches to the original game software that are made available to you or that you download from any of our websites or any other website expressly provided by us for this purpose authorized source, including such software as is necessary to access and/or use any online functionality related to this computer game software. The terms of this EULA are without prejudice to any terms relating to your use of third party proprietary software products. Such third party proprietary software may be included with the software product or downloaded as part of the software package with the software product and may be necessary for the use of certain functions of this software product; such use may be dependent on and subject to your acceptance of and compliance with additional third-party EULAs.
This software product is protected by copyright laws and other intellectual property laws and treaties. The software product is licensed, not sold.
2. Grant of a Limited Non-Exclusive License
As long as you comply with the terms of this EULA, you are granted the non-exclusive right and license to:
2a) install and use one copy of the Software Product on a single hard disk that is under your custody and control and that conforms to the specifications set forth in the Manual for your personal and private use;
2b) transfer the Software Product from one hard drive to another PROVIDED that it is used on only one (1) hard drive at a time and the hard drive on which it is used is under your supervision and control at the time of use;
To the extent permitted by law, all rights not expressly granted herein are reserved by us and our licensors. Your rights of use under this EULA are subject to the strict condition that you comply with the terms of this EULA at all times.
3. Restrictions
You are not allowed:
3a) use or exploit the Software Product commercially in any way,
3b) to install or use the software product on a network server, in a multi-user configuration or in a configuration for remote access for distribution to one or more computers,
3c) use or allow such use of the software product on more than one PC, laptop, smartphone or PDA simultaneously without a separate, additional license from us,
3d) except in the circumstances and to the extent expressly permitted by applicable law, to reverse engineer, derive source code, modify, decompile, disassemble or in any way create derivative products from the Software Product or parts thereof,
3e) remove, disable or circumvent security protection or technical measures controlling access to the Software Product and/or preventing or stopping infringement of copyright or other intellectual property rights relating to the Software Product,
3f) export the Software Product or any copy or adaptation thereof contrary to applicable law.
3g) create data or executable programs that mimic data or functions of the Software Product.
In addition, you agree to comply with any safety information, maintenance instructions, or other relevant notices contained in the manual accompanying the software product.
4. Online Features
This software product may allow access to services that we and/or our affiliates or third party providers authorized by them make available that allow users of this software product to use certain online features related to this software product ("Online Features"). Use such services/online features made available as part of such services require the completion of a registration process and the acceptance of additional terms, including but not limited to privacy terms relating to the use and processing of personal information.Please note that not all Purchasers of this software product will be able to sign up for or use these services (including online features associated with the software product).These services and online features may not be offered in your country and/or may be subject to age restrictions, for example. An internet connection is required to access online features.
When you use online features, we and our affiliates may also collect, store, process, distribute, and publicly display certain information related to your games. This data may include your username, gamertag, game scores, scores, rankings, results, achievements and other personal profile information that you choose to make visible to other players. Subject to any other consents you may have given us under any other agreement between you and us in relation to such data, any data that personally identifies you will be collected, stored, used, processed and distributed by us in accordance with the Privacy Policy.
5. Your consent to our use of certain information
We may collect anonymous, non-personally identifiable information about your hardware system from time to time during your game play, including information about your use of the software product and the successful installation and uninstallation of the software product. This information may also include your IP address. This information is not only required for smooth online functionality, but also helps us to understand how our customers use the software product so that we can improve our computer games and services in the future. However, this information will not be used to personally identify you without your knowledge and without your separate consent.

7. Termination
Without prejudice to any other rights, we are entitled to terminate this EULA immediately without notice if you breach the terms of this EULA. Upon termination, you must destroy all copies of the Software Product and all of its component parts, including any Software Product residing on the hard drive of any computer. You may terminate the EULA at any time by destroying the Software Product and uninstalling it from your hard drive or other hardware.
8. Property
You only own the data medium on which the software product is stored. We retain at all times the property rights to the software product stored on the data medium and to all subsequent copies, regardless of the form.
9. Limited Liability and Exclusions
IN NO EVENT SHALL WE BE LIABLE FOR ANY DAMAGES (INCLUDING, BUT NOT LIMITED TO, DIRECT, INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES FOR LOST PROFITS, BUSINESS INTERRUPTION, LOSS OF INFORMATION, OR ANY FINANCIAL LOSS OF ANY KIND) RESULTING FROM THE USE OF THIS SOFT GOODS PRODUCT OR THE INABILITY TO USE THIS USE OF THE SOFTWARE PRODUCT WILL RESULT EVEN IF SEL HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. YOU ASSUME THE ENTIRE RISK OF USE (INCLUDING BUT NOT LIMITED TO (A) ANY DAMAGE TO YOUR COMPUTER HARDWARE, DATA OR SOFTWARE OR (B) RESULTING FROM FAILURE TO FOLLOW THE PRECAUTIONS DESCRIBED IN THE MANUAL DURING USE).
IN ANY CASE, THE MAXIMUM TOTAL LIABILITY IN CONNECTION WITH THIS EULA OR THE USE OR ATTEMPTED USE OF THIS SOFTWARE PRODUCT SHALL BE LIMITED TO THE AMOUNT ACTUALLY PAID BY YOU FOR SUCH SOFTWARE PRODUCT.
You understand that the Software Product may be updated or corrected at any time and that no obligation arises, whether under this EULA or otherwise, to provide you with such updates or patches.
Interim disposal
Without the targeted enforcement of the provisions of this EULA, we would suffer irreparable harm. Therefore, you agree that we shall have the right, without security or proof of injury, to take any action necessary, including but not limited to seeking injunctive relief or any reasonable remedy, in addition to any other remedy available to us.
10. Indemnification
You agree to indemnify us against any and all claims, damages, costs and expenses (including reasonable attorneys' fees) arising directly or indirectly from your acts or omissions related to the use of this software product or any breach by you of any of the terms of this EULA , to be held harmless and harmless.
11. Miscellaneous
11a) If you acquired this software product in the United States of America, then you may not export or re-export it, except in accordance with the laws and regulations of the United States of America.
11b) You acknowledge and agree that all title, proprietary rights and intellectual property rights related to the Software Product and all copies thereof are owned by Sven Steinmetz.
11c) We reserve the right, at our sole discretion, to change this EULA at any time. Please check back regularly for updates.
11d) If a court or other competent authority finds any provision of this EULA or part thereof to be void, illegal or unenforceable, then that provision or part-provision shall be deemed to be deleted to the extent necessary and the remaining provisions of the EULA shall continue to operate to the fullest extent permitted by law extent valid and practicable.(Bearbeitet)Original wiederherstellen
