End-User License Agreement (EULA)
Preamble
This End-User License Agreement ("Agreement") is a legally binding agreement between you (the "User") and ASD Games (the "Developer").
By downloading, installing, or using ENTITY: THE BLACK DAY (the "Product" or "Game"), you agree to abide by the terms and conditions of this Agreement. If you do not agree to these terms, you are not permitted to download or use the Game.
Article 1: Definitions
1.1 The Product or The Game: Refers to ENTITY: THE BLACK DAY and any related files, software, updates, and patches.
1.2 The Developer: Refers to ASD Games, the party responsible for developing and distributing the Game.
1.3 The User: Refers to any individual who downloads, installs, or uses the Game.
1.4 License: Refers to the non-exclusive, non-transferable, revocable right granted to the User to use the Game for personal, non-commercial purposes only as specified in this Agreement.
Article 2: License Grant and Restrictions
2.1 License Grant: The Developer grants the User a non-exclusive, non-transferable, revocable license to use the Game on one device for personal, non-commercial purposes only.
2.2 Restrictions:
The User may not modify, distribute, or redistribute the Game or any part of it.
The User may not use any unauthorized tools or software to modify or access the Game's content.
Article 3: Intellectual Property Rights
3.1 Ownership: All intellectual property rights related to the Game, including but not limited to the code, graphics, sounds, text, characters, narrative, dialogue, artwork, environment design, game mechanics, and all other game-related content (collectively referred to as "Game Content"), are the exclusive property of ASD Games. These elements are protected by copyright, trademark, and other intellectual property laws and international treaties.
3.2 Use of Game Content: The User is only permitted to use the Game's content for the purposes specified in this Agreement. The User may not use, copy, modify, distribute, or create derivative works based on any of the Game's content for any commercial or unauthorized purposes.
3.3 Game Identity: The name "ENTITY: THE BLACK DAY", along with all associated logos, character names, plot elements, storylines, and design concepts, are the exclusive intellectual property of ASD Games and are protected under trademark and copyright law. The User agrees not to use, reproduce, or infringe upon any of these elements without prior written permission from the Developer.
Article 3.4: Unreal Engine and Epic Games
The Game is built using the Unreal® Engine (the "Engine"), technology, and tools developed and owned by Epic Games, Inc. ("Epic").
3.4.1 Epic's Intellectual Property
The Unreal Engine, including its code, tools, and libraries, remains the exclusive intellectual property of Epic Games, Inc.. You acknowledge that this Agreement grants you no rights to the Unreal Engine itself, which is licensed to you separately under the Unreal Engine End User License Agreement (EULA).
3.4.2 Independent Developer & No Epic Liability
ASD Games is the independent developer of ENTITY: THE BLACK DAY and is solely responsible for the Game and its content. Epic Games does not endorse, sponsor, or assume any liability or responsibility for the Game. Any claims, warranties, or issues you have regarding the Game are directed solely to ASD Games, and not to Epic.
3.4.3 Prohibition on Engine Modification
This license grants you the right to play the Game as provided. You are expressly prohibited from decompiling, reverse engineering, disassembling, or otherwise attempting to discover the source code of, or modifying, the underlying Unreal Engine technology as it is integrated within the Game.
3.5 Third-Party Assets: Any third-party assets used in the Game, including but not limited to music, sound effects, and models, are licensed for use in the Game and may not be used outside of it without the appropriate permissions.
Article 4: Updates and Maintenance
4.1 Updates: The Developer reserves the right to release updates, patches, or modifications to the Game without prior notice to the User.
4.2 Support: The Developer may provide technical support periodically but does not guarantee that all issues will be resolved.
Article 5: Data Collection and Privacy Protection
5.1 No Data Collection: The Developer does not collect any personal data or sensitive information from the User. The Game is provided with full consideration for the User’s privacy.
Article 6: Disclaimer of Liability
6.1 "As-Is": The Game is provided "as-is" without any guarantees from the Developer regarding errors or malfunctions.
6.2 Liability: The Developer will not be liable for any loss or damage arising from the User’s use of the Game.
Article 7: Termination of License
7.1 Termination: The Developer reserves the right to terminate the license if the User violates any of the terms in this Agreement.
7.2 Post-Termination Actions: Upon termination of the license, the User must stop using the Game and delete all copies from their device.
Article 8: Applicable Law and Dispute Resolution
8.1 Governing Law: This Agreement will be governed by the laws of [Your Country].
8.2 Dispute Resolution: Any disputes arising from this Agreement will be resolved through [designated jurisdiction or dispute resolution method].
Article 9: Amendments to This Agreement
9.1 Amendments: The Developer reserves the right to amend or update this Agreement at any time. Users will be notified of any changes through [appropriate means].
Article 10: User's Acceptance
10.1 By using the Game, the User acknowledges and agrees to abide by all the terms and conditions of this Agreement.
