PLEASE READ THIS END USER LICENSE AGREEMENT (“EULA”) CAREFULLY BEFORE USING POW VISTA. BY USING POW VISTA, YOU AGREE TO BE BOUND BY THE TERMS AND CONDITIONS OF THIS EULA. IF YOU DO NOT AGREE TO THE TERMS AND CONDITIONS OF THIS EULA, DO NOT USE POW VISTA.
This EULA is between you and ARAM AUDIO LLC, the owner and operator of the game Pow Vista. Pow Vista is a game developed and owned by ARAM AUDIO LLC, and ARAM AUDIO LLC hosts servers for gameplay for Pow Vista.
1. License Grant. ARAM AUDIO LLC hereby grants you a personal, non-exclusive, non-transferable, limited license to use Pow Vista for your personal and commercial use on a single personal computer or gaming device. You may also stream or create content featuring Pow Vista on online social media platforms or any other website, as long as such use is in compliance with this EULA. You may not use Pow Vista for any other purpose, or on any other computer or gaming device, or network, without ARAM AUDIO LLC’s prior written consent.
2. Objectionable Content and Abusive Users. ARAM AUDIO LLC has a zero tolerance policy for any content or behavior that is offensive, harassing, threatening, or otherwise inappropriate. This includes, but is not limited to, content or behavior that is racist, sexist, discriminatory, or otherwise offensive. You may not use Pow Vista to transmit, distribute, or publish any content that is defamatory, libelous, or otherwise illegal. You may not use Pow Vista to engage in any activity that is abusive, threatening, or harassing to other users. ARAM AUDIO LLC reserves the right to remove any content or behavior that violates this policy, and to terminate the accounts of any users who engage in such behavior.
3. Respect and Kindness. ARAM AUDIO LLC encourages all users to treat each other with respect and kindness. You may not use Pow Vista to engage in any activity that is intended to harm or offend others. You may not use Pow Vista to engage in any activity that is intended to disrupt the normal functioning of the game or the enjoyment of other players.
4. Intellectual Property. Pow Vista and all content and materials included in Pow Vista, including but not limited to graphics, images, text, and software, are the property of ARAM AUDIO LLC or its licensors and are protected by copyright and other intellectual property laws. You may not use any content or materials on Pow Vista for any commercial purpose without the express written consent of ARAM AUDIO LLC.
5. Disclaimer of Warranty. Pow Vista is provided on an “as is” and “as available” basis. ARAM AUDIO LLC makes no representations or warranties of any kind, express or implied, as to the operation of Pow Vista or the information, content, materials, or products included on Pow Vista. ARAM AUDIO LLC will not be liable for any damages of any kind arising from the use of Pow Vista, including but not limited to direct, indirect, incidental, punitive, and consequential damages.
6. Termination. ARAM AUDIO LLC reserves the right to terminate this EULA at any time and for any reason. Upon termination, you must immediately cease all use of Pow Vista.
7. Governing Law. This EULA shall be governed by and construed in accordance with the laws of the State of Delaware, without giving effect to any principles of conflicts of law.
8. Entire Agreement. This EULA constitutes the entire agreement between you and ARAM AUDIO LLC regarding the use of Pow Vista, and supersedes any prior agreements or understandings, whether written or oral. This EULA may not be amended or modified except in writing signed by both parties. If any provision of this EULA is found to be invalid or unenforceable, that provision shall be enforced to the maximum extent possible, and the remaining provisions shall remain in full force and effect.
