End User License Agreement (EULA)

THIS END USER LICENSE AGREEMENT (THE “AGREEMENT”) IS A LEGAL AGREEMENT BETWEEN YOU, THE END USER (“USER”), AND VOSSEL (“VOSSEL”). BY INSTALLING OR USING VOSSEL'S STREAM BASKETBALL GAME (“SOFTWARE”), YOU AGREE TO BE BOUND BY THE TERMS OF THIS AGREEMENT.

1. LICENSE GRANT:


Subject to your compliance with the terms and conditions of this Agreement, VOSSEL grants you a non-exclusive, non-transferable, limited right and license to install and use one copy of the Software on a device owned and controlled by you, solely for your personal use. This license does not include any resale or commercial use of the Software or its contents.

2. CONTENT CREATION:

Notwithstanding the restriction on commercial use in the previous section, VOSSEL grants you the right to create, record, and stream videos using the Software, even if such activities generate income for you, as long as these activities do not involve reselling the Software and comply with all other terms of this Agreement.

3. RESTRICTIONS:

You shall not (a) copy, reproduce, distribute, rent, lease, sell, sublicense, or otherwise transfer the Software; (b) modify, adapt, translate, reverse engineer, decompile, disassemble, or create derivative works of the Software.

4. OAUTH CODE STORAGE AND USE:

NOTICE: Please refrain from showing your Twitch OAuth code to the public or on your stream, you can do so by only using game capture for the overlay. The OAuth code provides access to your Twitch account.

This software securely stores your Twitch OAuth code on your local hard drive. This functionality eliminates the need for you to enter your credentials every time you utilize the software.

By utilizing this application, you acknowledge that your OAuth token is stored on your computer's hard drive. It is important to note that if an unauthorized individual gains access to your OAuth token, they may potentially gain control over certain aspects of your Twitch account. As a user of this software, you accept and understand that this risk is inherent and accept responsibility for any consequences arising from it.

6. OWNERSHIP:

All rights, titles, and interests in and to the Software, including any updates, modifications, and enhancements thereto, belong solely to VOSSEL. The Software is licensed, not sold.

7. TERM:

The term of this Agreement commences on your acceptance of this Agreement and will continue in effect until terminated by either you or VOSSEL. Upon termination of this Agreement, the license granted herein will also terminate, and you must cease all use of the Software.

8. DISCLAIMER OF WARRANTY:

THE SOFTWARE IS PROVIDED “AS IS,” WITHOUT WARRANTY OF ANY KIND. VOSSEL DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO ANY WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

9. LIMITATION OF LIABILITY:

IN NO EVENT WILL VOSSEL BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, OR CONSEQUENTIAL DAMAGES ARISING OUT OF THE USE, MISUSE, OR INABILITY TO USE THE SOFTWARE.

10. JURISDICTION AND DISPUTES:

This Agreement shall be governed by and construed in accordance with the laws of the jurisdiction in which VOSSEL is located. All disputes arising out of or in connection with this Agreement shall be finally settled under the Rules of Arbitration of the jurisdiction in which VOSSEL is located.

11. ACKNOWLEDGMENT:

By using the Software, you acknowledge that you have read this Agreement, understand it, and agree to be bound by its terms and conditions.

IF YOU DO NOT AGREE TO THE TERMS AND CONDITIONS OF THIS AGREEMENT, DO NOT INSTALL OR USE THE SOFTWARE.
