End User License Agreement
This End User License Agreement (hereinafter referred to as "this Agreement") is a legal agreement between MediBang Inc. (hereinafter referred to as "the Company") and the user (hereinafter referred to as "the User") of MediBang Paint for Desktop (hereinafter referred to as "the Program") provided by the Company regarding the use of the Program.
The User may install and use the Program only if they agree to all the terms of this Agreement, and this Agreement shall become effective as a valid agreement when the User installs the Program.
Article 1 (Copyright)
The Program is the intellectual property of the Company. Infringement of copyright may be subject to litigation.
Article 2 (Prohibited Acts)
The User is prohibited from engaging in any of the following acts:
(1) Transferring, selling, lending, or distributing the Program to a third party.
(2) Reproducing, modifying, analyzing, extracting code, or any other act that may infringe on the Company's intellectual property rights.
(3) Analyzing communication protocols or other data used in the Program and using them for other purposes.
(4) Intentionally exploiting any defects in the Program if there are any.
(5) Using the Program on a sharable system.
(6) Allowing a third party to use the Program for a fee or incorporating the Program into a commercial service.
(7) Any act similar to or analogous to the foregoing acts that is detrimental to the Company.
Article 3 (Maintenance and Support)
The Company may provide additions or modifications to the program for the purpose of changing, expanding, or fixing bugs in the program. These will be provided free of charge in principle, but they may be provided at a fee at the discretion of the Company.
The modification of the Program shall be at the discretion of the Company and it shall not be obliged to provide any modifications to the User.
Article 4 (Authentication)
When using the Program, access may be made to servers provided by the Company or third parties other than the Company at initial startup or each startup.
When using the Program, user registration and login to services provided by the Company or game platforms provided by third parties other than the Company (such as STEAM platform provided by Valve Corporation) may be required at initial startup or each time it is started up.
Article 5 (Disclaimer)
The Company makes no warranty whatsoever as to the completeness, operational stability, suitability for the User's intended use or any other matter with respect to the Program.
The Company shall not be liable for any direct or indirect damages arising from or caused by the use or non-use of the Program by the User.
The Company shall not be liable for any damages incurred by the User.
Article 6 (Commencement of Contract)
This Agreement takes effect from the time when the User installs this Program.
Article 7 (Termination of Contract)
The User may terminate this Agreement by uninstalling this Program. In that case, it is necessary for the User to delete all or part of this program.
If the User violates any provision of this Agreement, we may unilaterally terminate this Agreement. In that case, the User is required to delete all or part of this program.
Article 8 (Change of Contract Contents)
The Company may change the contents of this Agreement at its discretion.
Article 9 (Severability)
Even if a provision of this Agreement is determined to be invalid based on laws and regulations, other provisions of this Agreement shall continue to have effect.
Even if a part of this Agreement is invalidated or canceled in relation to a certain User, this Agreement shall continue to have effect in relation to other Users.
Article 10 (Miscellaneous)
This Agreement shall be governed by Japanese law and any disputes arising out of it shall be subject to exclusive jurisdiction in first instance at a district court having jurisdiction over MediBang Inc.'s head office location.
Translations of this Agreement are provided solely for the User’s convenience and do not hold legal power. If there is any discrepancy between the Japanese version and the translated version, the Japanese version will be interpreted as the only official contract.
