1. Agreement
This is an agreement between you (the "Player") and Zach Holbrook (the "Developer"). When you install Malkin (the "Game"), you agree to be bound by the terms of this End User License Agreement ("EULA.") If you do not agree to these terms, do not install or play the Game.
2. Copyright
The Game is protected by copyright laws and international copyright treaties, as well as other intellectual property laws and treaties. The Game is licensed, not sold. The Developer retains all right, title, and interest in the Game, including all intellectual property rights to original music, artwork, story elements, writing, and other original artistic creations therein.
3. License
This agreement grants you a non-exclusive, non-transferable, limited license to use the Game solely for personal, non-commercial purposes, subject to the terms of this EULA.
4. Permissions and Restrictions
You may not copy or distribute the Game. You may make alterations or add to Game files for non-commercial purposes. You may make derivative works for non-commercial purposes as long as the Developer is credited.
5. Termination
This EULA is effective until terminated. Your rights under this EULA will terminate automatically without notice from the Developer if you fail to comply with these terms.
6. Disclaimer of Warranties
The Game is provided "as is," with all faults, and without warranty of any kind. The Developer disclaims all warranties, express or implied, including any implied warranties of merchantability and fitness for a particular purpose.
7. Limitation of Liability
To the maximum extent permitted by applicable law, the Developer shall not be liable for any special, incidental, indirect, or consequential damages whatsoever arising out of the use of or inability to use the Game.
8. Miscellaneous
This EULA is governed by the laws of the United States of America and the State of New York, exclusive of its conflicts of law provisions. If any provision of this EULA is found to be invalid or unenforceable, the remaining provisions will remain effective. The exclusive venue for litigation regarding or arising from this EULA is Rockland County, New York, and you agree to submit to the Jurisdiction of the courts of Rockland County, New York, for any such litigation.
